Line 23 of i-864: do I put my income including my husbands(the intending immigrant) if I am unemployed or do I put $0 and include his income on line 24b then add together in the box below. Also, do I include money I received from student loans as income or just leave it as zero since I'm unemployed?
Should we put our assets on the form(we don’t have much maybe 3 to 4 thousand dollars each) or just ignore it because we meet the income requirement with his job?
Should I include a letter with explanation as to why I’m unemployed(I am a full time university student) and also mention why my tax records don’t show work for the last year?
Actually "his or her income can be included if it
will continue from the same source after he or she obtains lawful permanent resident status". (from page 2 of the instructions for the I-864).
However, that probably isn't the case?
If not, you are either going to need a cosponsor or sufficient assets to meet 3 x the 125% poverty level for the two of you (more if you have children).
If you have a regular student loan - where a bank or other financial entity loaned you money for school - no, that can't be counted.
Right now, in terms of the affidavit of support, with your Husband having income from overseas which I assume will not continue when he moves to the U.S. - your income is zero. I would recommend that you read the instructions for the I-864 - it covers a lot of important information.
