We married in 2007. AOS approved and green card received in 2007. Divorced in 2008. If he should decide to apply for the removal of conditions with the I-751 in the futere will it make a different for it's approval if we file 2007 taxes as married filing seperately vs filing join?
thanks, cshell

I would file the ITR the way it would benefit you (both) financially the most (usually Married filing Joint) and let the chips fall where they may with the lifting of conditions. I don't think filing one way or the other would effect the lifting-of-conditions in the future since the divorce has already taken place - that's the hurdle to overcome, not taxes. good.gif
