huhuhu i went to a social security office last week to get a SSnumber but the lady said as a K1 you cant get one unless you have the EAD with you i showed her the documents i read here that says that as a K1 you are entitled to one and she said that i didnt read the entire thing coz it says you have to have an EAD to get a SSN grrrrrrr

I don't know if the laws are different in Georgia, but we got a SSN back in August and just got the EAD two weeks ago! The person you dealt with doesn't seem to know what they were doing. Try calling.

same here..i got my SSN here in Arizona simply by showing my birth certificate, my passport with US Visa & marriage certificate.
try to find some VJ members from georgia & find out how they deal with this.

if you can find a note in USCIS website that says K1 visa holder who already got married is entitle for SSN, then better to show such print out instead from this forum..just a thought..

When does your I-94 expire? If you have been in the U.S. for less than 76 days, the clerk was incorrect and you should ask to speak to a supervisor. If you have been in the U.S. for 76 days or more, you are too close to the I-94 expiring and the clerk was correct.

SS rules do not vary by state.

SS rules are federal.

K1s are permitted an SSN as long as your I 94 is valid (and it has not been 76 days or more since you entered the US - as johnandmarlene mentioned).

Print off the following document and go back. Obviously your SSA office do not know the rules - educate yourself, then them, and make them do their job.

i have just been here for a little more than a month arrrived jan 15,, i told the lady so that k1 is entitled but she insisted no i should have an USCIS document to show that im entitled to one

That is patently untrue. If you have the K1 in your passport and a valid I 94, there is no reason the SSN cannot be issued.

THEY are supposed to do an electronic verification of your immigration status (through the SAVE system).

Print off the link I gave above and go back. If you don't get anywhere with the person waiting on you, ask to speak to their supervisor.

thanks tracy!! gr i really hated it coz we drove for more than an hour to get to this SS office waited for more than an hour coz there was a long line and just to be rejected saying k1 isnt entitled ill try it again thanks so much!

can you go to a different office?

if you go back to the same office, make sure you don't get the same person again.

Some people just cannot admit to being wrong, even if they know they're wrong, and if they know that they're affecting someone's life by being wrong, its more than their psyche can tolerate. A low-level public-facing official at a government agency fits the profile exactly. Only fight them head-on if you enjoy arguing and fighting against stubbornness. As long as your I-94 is not close to expiring, you are allowed to acquire a SSN... In your case, you need to bring a printout of that Tracy's link. Make sure to bring along your (originals) I-94 BC, passport and marriage certificate (if married).

i did go to SSA office in new bern coz we live in jacksonville north carolina,,there is one here in jacksonville but it only opens during thursday..now we are looking for other SSA office around the area..i think ill give it a second shot,,i really dont want to wait for my green card to arrive or the EAD before getting one i need SSN to get my own account in the bank sinc emy husband will be leaving for iraq

Yikes, the office in New Bern didn't issue you SSN? That's weird! I'll be getting my SSN after we get married there... I hope they issue us SSNs! Pleae update if you were able to get one.
