I married my Chinese fiancee 2 years ago under a k1 visa. She is a legal permanant resident. Her son now 21 wants to live in America with us. It appears we need to file an I130 form to start the process. Is this the best way to go and how long might we expect to wait until he can join us? Years I am guessing. Any thoughts out there? Thanks everyone...

He is not married and was over 18 when we married. Thank you.

According to the current bulletin, it will take about 9 years for your wife to petition him.

If you had used the follow to join option within 1 year of the K1, he would have been eligible to come up to turning 21.

You cannot petition for him as a stepson since he was over 18 at the time of the marriage.

Single Over the age of 21 and the petitioner is permanent resident (2B Family-based second preference – 2B – unmarried children over 21
), umm Right now they are processing 1997 priority dates. So it takes about 9 to 11 years.

Single over the age of 21, petition by a US citizen (F1 First preference – unmarried children of U.S. citizens) takes about 15 years.

Since he is not over 21 yet! umm very conflict myabe you could ask some immigration attorney.........

Your figures for the F1 category appear to be based on the priority dates for the Philippines and not for China. For China, the F1 priority date is 15 Feb 2002 -- 6 years.

Yeah, the Philippines is the only country for which the F1 priority dates take longer than F2B.
