Full Version: after 221(g) and returning petition to USCIS the embassy sent me new email

it will expire in the USCIS after long monthes of reviewing and waiting then they will fire the approved I-130 to NVC.

what about the CR1 does it expire or they review it if so then for how long till they send back the case to the embassy .??

i believe i read the cr1 doesnt expire but it seems at this time both agencies are just not reviewing returned applications some returned over a year ago (both married and sgl) are just sitting with no action

if it expires like the k1, there will be no further review or approval action, if expired you need to get your rep to see if you are truly expired and can refile

Hello,
I am deeply sorry this happened, please look up the steps given my VJ member Kiyah on what to do upon petitions being returned. Be proactive, follow the steps and see if you can stop the case from going back to the US. Other members have done so, cherylandMedo I believe. Please take my wishes I pray that your case will not have to endure USCIS procedures.

Yes, you need to be proactive and appeal the decision, before the case gets sent back to the USCIS.

What reason did they give for the 221(g)?????

I had alot of evidences for them during the interview and i sent others also after the interview ,but they had made me confused when they told me that the petition is still pending in the embassy for further process.
my wife had contacted the senator after the interview and he sent a letter to the embassy inquiring about the denial reasons but nothing recieved from the embassy till this moment.

From what I highlighted in the red it means that your petition is in AR/AP at the embassy level which could be security checks. You need to see if the petition is still at the embassy in AR/AP? Contact DOS and ask them of the status on your case. If it is in AR/AP the operator will tell you this much but will not tell the types of checks that are being done. Good luck.

i was thinking that but they had sent me the following email when i asked them about if the further processing might result in approving the petition or not

They may be sending the petition back to the service center that approved it and your wife will have to go and interview at a local office. I have seen this happen in the past.

I thought in the first post it was being returned and then he stated it was being processed more at the embassy was the reason I said to verify it with DOS brnidokiegurl.

I would still have your wife call DOS and ask them to clarify the status and see if the petition is still at Jordan or is it enroute to the US? When she contacted the senator did someone discuss with her the case? Did she sign a release form for the senator to act on her behalf? And she should also contact the Congressman as well. I know the congresional staff are usually the ones that deal with immigration instead of senatorial staff.

Yes ,she signed a release upon his demand.

Okay they take some time to get a response from the embassy so just try and have your wife keep in contact with the senatorial staff. I know without a signed release form the staff cannot get involved. Sorry that this happened and hope you can get it resolved soon.

i was able to stop my case in embassy , find some good attorney who can help you
