K-1 should marry and then file I-485 to adjust status, and also file I-765 for EAD (Work permit)

K-1 should not file I-765 BEFORE I-485, this results in an EAD that expires 90 days after entry to the USA, costs $340, and takes about 90 days to get. File I-765 with I-485 or after filing I-485, the fee for I-485 ($1010) covers filing I-765 and also I-131 for travel document.

You have to marry your fiancé first. Then apply for AOS, EAD, AP (AP is only if you need to travel before GC is approved). Until you MARRY your fiancé, you won't be able to apply for your work permit.

I was told at the SSN office that I could have worked here right away after arrival if an immigration officer at the airport you've arrived put a certain type af stamp in your passport stating that you are able t work here. If not, than you should wait till you get married and only then apply for work.

At the moment, the only POE that is doing the temp work stamp....and only IF you ask for it....is JFK. At least that's the only POE that has been mentioned here that is doing this. IF the OP doesn't have said stamp in passport, EAD is the only way to work...ONCE she is married.

The stamp you have means that you've entered USA (you are permitted to enter US only once with your visa). It doen't give you any permission to work. If you leave US the immigration officet take that piece of paper which will mean you have used out your visa.

The only way to work Destiny1 is to get married, and then file for AOS and EAD (you can also apply for AP if you wish as it's included in the price). Once that goes through you'll get authorisation to work. In the mean time just do as the immigration officer said to me when I went on an infopass appointment and "watch Opera". Everyone here who has not had their EAD or AOS done yet is in the same boat at you. We understand that it's a very tedious situation to be in when you're stuck at home not being able to work and having to depend on others. However, not only does this prove the strenght of your commitment towards one another but it also gives you time to adpat to living here and to get all your stuff in order (ex. getting your CV up to notch, getting equivalance certificates for your foreign earned degrees or certifications, start learning about the dynamics of the local job market) not to mention to have the time to spend with your family. Once you are married, and I suggest that you do so asap, and file for AOS and EAD you will have a wait of between 2-4 months before you can start working. I wish you all the best.

Sounds somewhat harsh Destiny1, but the advice is right on. I am currently one fo those bored folks as well smile.gif

We decided to marry fairly soon after entering (2˝ weeks) because then I could apply for the AOS/ EAD and get into the waiting line. It was 3 months practically bang-on on Thurs and I just received news that the EAD has been approved and I should have it within a month. I EXPECTED to be unemployed about 4 months or so and this is a pleasant surprise to know it's nearing it's end!

In the mean time, you can ready that resume, be Henry-homemaker ( it's the pits, I know) , play a few video games (World of Warcraft rocks dude), volunteer and get some exercise. As a formally very employed and self sufficient person, I know that I resent the fact that I have to be 'supported', although I know that my husband appreciates everything I'm doing at home and it does give us a chance for more togetherness before I get back in the rat race.

Come here for support, it will help...venting works

Hahaha!!! It really is the pits! At least this way we fully understand how working is a priviledge rather that a right! I just hope that hubby won't expect the house to be as spotless once I start working!
Just one little thing though.. I asked the immigration officer when I went in for my infopass appointment if I could do any volunteer work as I have always been an active member in associations and she informed me about a 10000 USD fine if ever we were caught.. so in all honesty I would avoid that option... she then proceed with the Opera proposition....
Udella&Wiz I wish you all the best in the job hunt!!!!!! And looking from the timelines we should get our EAD sometime very sooooon (we were approved practically at the same time).
KarenCee
You can volunteer...not sure why you were told there is a fine for it as long as you're not getting paid for it!. My husband (as well as many others here on VJ) did volunteer work before the EAD was approved. My husband volunteered for the school system I teach in. I do think I remember reading that you couldn't volunteer for something that would lead to a job for you...not sure where I read that though. Anyhoo, volunteering isn't a problem.
