Hello everyone this is what happened. My husbands case was going well after Oct 24 . We waited for EAD response from USCIS for around 120 days(to give extra time because of the processing delays) and the online status said "case received and pending) It still does to this day ,no Touched updatesor RFE sent or e mails ..nothing I called the National Benefits Center and and the representative told me to wait another 45 days for case to be revised or something. So thanks to Kezzie' s and Bora Bora's advice I didn't wait and scheduled an infopass appointment the same night. We went the next day and inquired about the case and the lady told us that an RFE was sent and they didn't receive response in the service center (MSC). Apparently it got lost in the mail or the mailman didn't deliver So she made a request for them to re mail it.
Today the copy of the RFE arrived.. they want some paperwork and i can get it. What worries me is that the paper states the case will be processed only if you sent the documents within 90 days from receipt of original RFE's date which was Oct 25 ( one days after my husbands biometrics) for EAD and 84 days for AOS. I could send the papers as soon as tomorrow next day delivery but.. will they even look at them since it was from Oct 25? Has anyone gone through the same? Is there a way to ask for an extension since the paper they sent me it says in no way extends the processing period.
I fear the whole process will be denied and it won't be easy to come up with another 1010.00 for everything to be done again, not to mention the wait.
We're lost here if anyone can shed some light we'll be forever grateful.
I cant believe this happened, one tries to do things right ( we waited 90 days as they said before the inquiry and went personally and no one told us what was wrong and now the time is up to answer back) And they never updated the status online or sent e mail or anything (why they ask for you to register anyway?) Sorry for the rant everyone but I need to get this out of my system. Can't stand bureaucracy anymore.
