If you are still resident in India, there simply is no Indian Embassy that you can even visit first in your own country.... Embassies are government representatives to a foreign country.... located in foreigh countries....

Notarization occurs at the US Consulate
coolgt
itin have nothing to do w/notary with public
if you are a spouse of us citizen, your US spouse file it with the irs
you have to submit a copy of your passport, w7 and us tax form to the irs in the w7 mailing instruction
they give u an itin number and complete your return for you

the foriegn spouse signs it and sends american embassy notarized copy of passport to us citizen to be filed with usa tax forms. all instructions can be found at the irs website and if there are any further questions you can talk with a representative at the irs. the phone number is on the website (not always easy to talk to operator and this time of year could be real tough).
good luck to you

u can get the w7 off the irs website, ahmed filled out over there, signed, sent with his passport copy back to me and i took it to the tax preparer , it will then go along with my tax infor to the irs (after he signs the return also)

You must have your wife fill out a copy of the W-7 tax form. You must also have her to go the United States embassy and get a notarized photocopy of her passport pages. She will then send these to you. When you file your taxes, you will include the W-7 form and the notarized passport photocopies with your return. Additionally, if your wife has any foreign income, you must fill out a form 2555 (Foreign Earned Income). Generally, if India has a tax treaty with the United States, your wife's income will be exempt from US taxes up to a certain amount (I think around $84,500). I also believe you have to include a letter that states that you are married and wish to declare your non-resident spouse as a resident for tax purposes.

I would highly recommend taxing your taxes to a CPA this year!!!!

The cost of a CPA is worth it, since you can have your spouse claim residency for tax purposes, and you can file married joint. There are some threads further down that talk a lot about taxes that you might find useful.

Good luck!

I have notarized copy of her passport but it is US public notary at the bank. will that work

IRS specifically said from notary from US embassy if your spouse in outside USA. But I would call IRS to ask about your specific cirumstances.

sorry to hijack the thread... I asked my wife in Japan to send me a notorized copy of her passport for use with the W-7, but she says it is illegal to copy passport in Japan. I know this sounds crazy. Assuming she is correct, how do I file proper documentation with the W-7?

Does anyone know what the rules are in Japan?

Thanks!

the people at the embassy would know the rules in japan...I would have her go and ask them how to get proof for filing joint taxes in USA, I am sure they will have the answers.

If one reads the instructions on the W-7 it says:

c Notarized by a U.S. notary public legally authorized within his or
her local jurisdiction to certify that the document is a true copy of
the original. To do this, the notary must see the valid, unaltered
original document and verify that the copy conforms to the original.
U.S. notaries public are available at U.S. embassies and consulates
worldwide. Foreign notaries are acceptable as outlined by the Hague
Convention.

Goldtrom

The W7 instructions say a "certified copy" is acceptable... My only guess is that a "certified" copy means issued by the government, which would mean the citizen doesn't make the copy (making it legal). So, maybe this form is what is required in japan... I don't know. My wife just said that it was illegal to copy it and that the government would issue her something to be used in it's place, but she couldn't explain to me what it was she was getting.

Update:
AUTHENTICATION OF DOCUMENTS : Malaysia is not a party to the Hague Legalization Convention Abolishing the Requirement for Legalization of Foreign Public Documents. Documents originating in Malaysia intended for use in the United States must be authenticated before a U.S. consular officer in Malaysia. There is a $30.00 fee per document for this service payable to American Embassy Kuala Lumpur. ...

More at: http://travel.state.gov/family/abduction/h...issues_562.html
which also lists the states which are signatories to the Hague Convention
or http://hcch.e-vision.nl/index_en.php?act=c...atus&cid=41

There are 93 states which are signatories, unfortunately Malaysia is not amongst them <sigh>

I too was asked by my husband to prepare papers for Form W7 end of last year. I first downloaded the form from the website, filled it and got copies of my passport. Then I called the US Consulate in Karachi for the notary and I was given an appointment. On the day of the appointment, I went to the consulate, and there submitted the documents along with my passport to the officer. He sent me to pay the fee for notarizing document which was $30 and any additional papers would cost $20 and so on. After paying that I was asked to sit and wait for the notary. Then I was called by the notary and she asked me a few questions regarding my husband and our marriage. She then stamped the copy of my passport and signed form w7. It is better to take some extra copies of the filled form and of the passport too.

I hope this will be helpful.

No the notary only stamps the page that has biographic information...the first page of the passport where it has your name and passport number etc.

You call the IRS and get ask to be helped with Non-resident alian status filing.

They will take you through a series questions to determine if your foreign spouse is eligible to file a W-7.

If so, then follow the instructions on the W-7 and attach that form with supporting documents verifying (indentity verification of the foreigner) to your 1040 and send it in to Austin, TX (the address on the back of the W-7.

Here are some caveats to remember:

1) Your spouse needs to sign the 1040 also if you are filing jointly.
2) Your foreign spouse needs to declare their world wide earned income on the 1040 if they have any.
3) You must attach a signed declaration to all your tax papers stating both of you (spouse and non resident alien) want to be considered a resident alien for all of tax year 2007.

These are the instructions the IRS has given me after long tedious calls.

Good luck.

I have never done item# 3. With items# 1 and 2, my wife completed and signed W-7, then I mailed all docs to Autin, Texas address, 4 weeks back. Not yet received any reply. They told me it would take 4 to 10 weeks because of the peak tax filing season.

Also, notarized her passport copies by the state (in India) recognized notary.

There is a good news ! I received the ITIN assigned by IRS for my spouse yesterday. It took 4 weeks to get it, though they said 4 to 10 weeks.

I notarized her passport pages from a recognized Indian Notary Public. Other forms submitted were, W-7 and Federal Tax Return.

You don't need to go to American Consulate to get it notarized.
JasonTrue
It's very simple. She should make an appointment with the consulate in her area (or the embassy in Tokyo), and they will make a photocopy and notarize it, marking it "for US IRS purposes only."

They charge 3000-4000 yen for this, I think.

Someone elsewhere on this forum said a foreign notary wasn't accepted in their case, so I asked my wife to go to the consulate, which is accustomed to this process.

QUOTE(Goldtrom @ Feb 12 2008, 11:02 PM) *
The W7 instructions say a "certified copy" is acceptable... My only guess is that a "certified" copy means issued by the government, which would mean the citizen doesn't make the copy (making it legal). So, maybe this form is what is required in japan... I don't know. My wife just said that it was illegal to copy it and that the government would issue her something to be used in it's place, but she couldn't explain to me what it was she was getting.

Depends on the state. For NY, you need to mark your dependent as NRA (Non-Resident Alien), but for CT, ITIN from Federal is needed.
DTAXMAN
I know this is late, but I process W7 applications.

There are only 13 types of documents the IRS will accept.

A US notary, or US State Department Employee may, certify/notarize the documents submitted.

Documents that are faxed to a US notary and submitted will be rejected.

Original Documents are a pain because some poor sap has to mail it back to you.

If you are in a foreign country go to the US Consulate and ask them to Notarize/certify the documents.

If you choose to submit a Notarized Copy of your passport, you ONLY need to submit the pages with your name, picture and issue date. You do not need to send in a copy of your visa IF YOU submit a Passport. Also, you do not need to copy every single page of your passport.

A passport is the ONLY document that can submitted by itself, otherwise you need TWO documents. You do not need to submit your I-94.

Here is the IRS manual for submitting a W7

http://www.irs.gov/irm/part3/index.html

score down to 3.21.263 for all you need to know about W7's
