Gosh, Misty, I come on here periodically hoping every time that when I do, you'll have fantastic news for us all! Before you know it, you'll hear the good news of an approval. When ever I think that it's going to be forever until ours, I just think of how incredibly fast the past year has gone! We should be able to finally file our waiver next week, at least that's when we're hoping to get a new police report back! Hope all is well for you and your family!

Hi Misty.
Sorry to hear your still waiting. I'm sure it won't be long now. (and i know that doesn't help) The only new news we have is that our paperwork is on its way to London. Probably more than likely there by now. Just waiting on them to send the packet. I've done some more work on the waiver letter but it's just so stinking hard.

At least for me it is. I'm hoping it will help that his record is over 24 years old but who knows. I saw the post on immigrate2us that knight posted where he was trying to say that waivers were automatically approved if it has been over 15 years but I have never seen anyone ever say they were approved for that. Oh well ........... hope your having a good weekend. Hope you do hear something next week.

Good luck to you clmtdg..I am waiting on jpkeswim to see if they are approved this week as it would be 8 weeks since they filed at the consulate..however it could be next week before they could definitely hear something as there is a slight delay of a few days till it reaches DHS.
I am just shaking my head in confusion. They said they'd make every effort to process it in order as to when it was filed...it should have been decided by now. So we'll see I guess...

Still no word yet. It was 8 weeks on Friday since we filed. My fiance is getting really anxious, he is ready just to come back home.

It is has been 10 months since we have been together now and I am planning a wedding and I would really hate to lose all my deposits.

All this stuff is so frustrating! I really hope to hear something in the next 2 weeks. Well Nigel got approved in 10 weeks so I am hoping we do too! John just called and said no package in the mail. He waits for the mail everyday. Talk to you all later

I Know theres been problems on vj site as late and i would like to thank the guys who saved the uk 601 sign up club....i will update everyone soon....and yes you to MistyB....APPROVED!
Anybody got new updates to add to the list..i also know there is 1 or 2 memebers who did not file as they was waiting on new Police cert from scotland yard....if anybody got new updates for the list please post,,,

so lets work this out ....from the 15th Dec05 to 30th March 06 is 15 wks

Now the best case would be that the person who sent ya the e/mail never had a clue and just giving you a answer of some sort..
If they had ya file on the 15 dec 04 then add 8 wks, cas thats about the norm for London then that will bring ya to 9th Feb 05

My Best Guess is that its going to be sometime in mid/late Jan / mid Feb..or maybe sooner rather later...

I would like to ask you Sir/Madam has there been any change/progress in this matter?

Okay I finally got up the nerve and emailed the Embassy yesterday afternoon and I got response this morning. Here is what they said, could you please tell me what they meant. I am just a nervous wreck since I am planning this wedding that might not happen.
The 601 for xxxx xxx was filed with this office on Dec. 13, 2006. (I think they meant 2005) The current processing times for adjudicating I-601 at this office is between 12-15 weeks. (They told us 6-12) IF the 601 is approved, we will notify the Immigrant Visa Unit at the American Embassy Consulate that your spouse had applied for the immigrant visa to let them know that the immigrant visa can be issued. If the 601 is denied; we will advise your spouse directly of the same and advise him of the procedures for appeals.
Can you guys please tell me what you gather from this??

what she/he is saying that your case is not done yet...but even if it was Approved today he/she could not say cas its not there duty to say yes/no to ya case they leave that up to another department DHS Officer...
The 15wks is the Max but more often they sort it out before that date...
My Guess would be in the next 10/14 days you will here something....but that reply they sent you was more info on there than ive seen before so thats a positive point cas they have gone out of there way to let you know everything is still in cargo..so to speak..but very much the same as my reply i had from them..they will just let you know what they want at any point...
You Done what you needed now....so give it a little more time for them to digest your mail...

OMG!!! That is the same generic email I received on Jan. 18th! I had emailed them on the 18th because my husband had faxed them something on the 13th. I was just making sure they received it. I got the same email with my dates in it instead of yours! They wont tell you anything that's for sure! So I just quit emailing them and wasnt going to mail them again until around my birthday on 2 March. Then on the 30th the lady from Stockholm called me and asked me if I had spoken to DHS and I said "no, not in two weeks.." and she was like "I have good news for you!"...
I think you'll get an answer soon! They go by filing date in my opinion.

uhm..stress going away??? yeah sure...

well we're under a little stress. The next big hurdle is the passport thing. We have three kids to get passports for and we're going up to Stockholm on the 15th so hopefully that goes well. A 4 hour train ride with 3 very rambunctious kids is well..HARD WORK!
After that comes the next hurdle which is finding a house (that's not going so well...yet) and after that of course is finding the right shipping company.
It really never ends does it?
How is it going on your end??? When are you planning on moving if you havent yet?

Okay, guys, we got the police certificate finally! So the courier is delivering our waiver app on Monday. Now the waiting and stressing begins well and truly! Let's hope it really is the eight weeks and not the 12! Trying to plan a wedding here!!!
Paul, I'm sorry to hear you had to file a waiver after all. I was hoping good news for you. Did it go well otherwise? Cas said they were very polite and helpful with him.
Misty, I'm so glad to hear things are going well for you. Trying to figure out how you're going to get home is a good kind of stress, yeah?

Sorry about being nitpicky Nigel...I am a control freak!
I read your other post Paul C and I am sorry you had to submit a waiver as well but London is a great place to do it if you must. IMO, Rome is one of the worst places! They are still giving out the processing time as 12-15 weeks but I dont buy that. I think that's worst case scenario like Nigel said.

Yeah my day in London was probably best forgotten (see post in foreign embassy forum), I couldn't beleive they let me wait and stress until 4 pm (after having entering the embassy at 11 am), but hey it's all over now.
I guess you were right about that more than one conviction thing Misty, I really thought I had a chance but I was hardly gonna argue with the guy, besides he was really nice and apologized for the long wait....
so guess this is my new home for a while eh?
I'm in good company though, so feeling ok here
hey Nige, can you change my date to 2nd of feb?, as that's when the waiver was submitted, cheers

Nigel, just a quick question, do they normally inform the applicant by mail or by phone, when the visa's approved?
It's just that the guy in the embassy said that they would write? yet I hear from you guys that they phoned?

Cmltgt...I know you said you have got your police cert back and you was going to file today Monday the 6th but i would like to know when they have your waiver so then the clock will start ticking away once they have got your waiver.....so maybe i might add you for the 7th or 8th Feb.....let me know if you find out they have it please...
Paulc.... If you only committed one "petty" crime before the age of 18 ..then, they can Forgive and sometimes even if you committed one petty crime after 18 sometimes they will let it slip......but more often after 18yrs of age they make you file.....after all if they can get $265.00 it all helps for the goverment...
This all depends on several factors... The crime itself and what would be the max sentance which could be given by the court...Hang in there you be fine im sure...
Paulc...They can do both....but more often i hear they call in the morning most of the time...but somehow they will get hold of ya...make sure they got any contact details...which you proberly did...

Ok....I wanted to ask is anybody on here who has a lawyer to file there hardship letters and waiver for them..
As for our case we just filed everything ourselfs with hardship letters ect....cas there is some good people on here and I2us.net who can help and give great advise on how to go about writeing hardship letters.

We had a lawyer, we were really clueless when all this happened. But if I could do this all over again I probably could of done it myseld with the help of this website. My lawyer was referred to US from my fiance brothers lawyer. Yes he is a really good lawyer but very very expensive. We could have but a brand new car or put a nice down payment on a house with the amount he has charged us. Yes he is out of London but still it is ridiculous how much he has charged. He has tripled the amount that he had originally told us. And we don't even know for sure they will let him back in the US.
BTW still no news...should I start counting the weeks from the original date we filed dec. 2nd or the date they actually started processing it, which was Dec 13.

Yep..i Agrea with my Friend Misty....
I gave my hardship letter on the day of interveiw 12th oct and they put it in the system 19 days later..why i dont know..so yep have that in mind.....and if it comes before all well and Good huh..

Thanks for the good input. Even though we just saw each other 1 month ago we are starting to get crabby with each other again. I think it is because I am so frustrated that I am planning this nice big wedding and he is over there getting aggravated that he is in a country that is foreign to him. As he was raised in the states. THanks you guys...I will let him know to make sure to have his phone on during the day. He is working midnights this week so he turns the ringer off during the day so he can sleep. I will definitely let you guys know the minute I find something out.

Can someone tell me what other payment methods are accepted in London for the waiver fees? (besides credit card) Will they take money order or cashier check? If so who is it made out to?
I emailed the embassy but all they did was inform me of the procedure for the I-601. Told me to wait for the interview to see if we were denied and then we would be instructed on how to pay. I emailed back and they still wouldn't tell me. They just ask me to provide information on my visa and if we had been denied. It this top secrect information? jeez....... We just want to have this all prepared so we can turn this in when he has his interview.

Paulc...The date you file and the date your case goes into the system is two Different things....so we start the clock when you file.....sometimes they put it into the system straight away and sometimes they take there time....Thats why the time to process waivers is anything from 8/15 wks but the norm is about 8wks..from the time they put it into there system....
The Embassy DHS reveiws your case first then the Longest part in any waiver is when the DHS waits on the Fingerprints to come back from the FBI...
When a Waiver is Approved and the Embassy calls/writes to you...the Embassy will tell you to call the SMS Postal company 0870-9501760 to Arrange pick up of your passport and that Blue waiver form the Embassy officer gave you when you filed the waiver also it might be a good idea to write a little cover letter with the details of your case number and date waiver was Approved by doing this then the Embassy knows whats its all about ect...
If Anybody has not got that blue Form then Don't worry the cover letter will cover that for you as the Embassy will have all the details on file anyway...
SMS Postal service..This is the service the Embassy uses for inportant documents to go back and forth the Applicant...once you call SMS then they will take down your details then call you back for your credit card details and Arrange pick up of your Docs...the cost to pick up and return is £19.00 which i think its pricey but the SMS will also ask you if you want to pay a extra £4 i think if you want them to collect your Docs before 12am...which i think thats a bit cheaky as £19.00 is plenty to start with...but what can you do? This is the Embassy ways of doing things....
Myself is waiting on SMS Today Tuesday for them to pick my docs up so ive got to wait for them all day...
Return of your Docs...im not to sure but SMS tells me approx 5/7 days for Embassy to return your docs back...this is anybodys guess when this will happen....more often people miss the post and call sms to come back again cas you just cant wait in for 7 days can you...
I Hope that clears things up....ill keep you posted on this postal stuff....knowing my Luck ill go to the loo or something today and miss the call..Thats my Luck all over!

Thanks for the informative answer, I was just wondering if there was any way that an applicant could find out WHEN their waiver went on to the system (probably not eh?)
Bailey, when I paid for the waiver, I paid via credit card (I think it works out to around 150 pounds!), that's probably the best way. I think you can also pay via debit card, the window that you pay it at has lots of symbols to say what they accept etc.
I certainly wouldn't want to walk around London with that much in cash in my pocket!

Neither one of us are using credit cards at the moment, so we were just trying to figure out the best way. Plus I was under the impression the fee had to be paid with US dollars. We both have visa debit cards so that should work out ok. (sorry if i sound like a hick) lol

I emailed the embassy and they let me know the day that they put it in the system....
Still no word from the Embassy today.

Man this is getting frustrating. From the day it actually went in the system it has now been 8 weeks as of today and it will be 10 weeks that we filed on Friday.

Yes, I do remember reading your emails. I just wish we knew something real soon. I am so aggravated that we paid our lawyer very very good money and he told us 6-8 months at the most. We originally started this process with the lawyer in late April and filed our first form the 2nd week of May. So it has definitely been longer than 8 months. I probably would have moved to England if we knew it was going to be this long. It better be a approval when we hear something......

Yep..Thats what Lawywers do best....take your money and screw you the same time..
A k1 visa takes a short time cas its only a temp visa until you AOS in the usa....I Know you got to add a bit more time for your waiver and all but 8 mths for a K1 seems to me a overdue time...
If only you new about Forums like this and Immigrant2us.net you proberly would have done this yourself saving time and money proberly...
Oh well the end is very near for you guys now i can feel that you will be Approved in the next wk or so...you came this far now so just hang in there a little longer....I think your waiver was put in on the 2nd of dec but was not in the system until the 13th dec so your 8wks is today the 7th Feb...
Our waiver was handed in the 12 oct 05 and got Approved the 30th of Dec so that there was 10 wks...but they never put it into the system when they got it until 31st oct so 19 days was lost somewhere in our case..
so if our was in there system on the 31st oct like they said and was Approved the 30 Dec that brings it to 8wks and 4 days...so going on the way it went for me then yours could be done in the next wk....
Hang in there...you be sorted soon.....

Bailey, we didn't have a credit card either. I thought you could use a personal check because that's what it says on the actual form for the I-601, but apparently that's not true! So I had to also resend him a banker's draft drawn on an American bank (bank check issued by your bank) which would be my bank, made out to US Disbursing Officer. Strange, not mentioned anywhere on any instructions that I got, but that's what the guy interviewing Cas said!

Hi Nigel. Yeah I posted my letter on the other site. I saw there was a post today but I try not to post much when I'm at work. I'll send a thank you tonight Oh and thank you for saying it was a nice letter. I think I will try to beef it up a bit more and then leave it alone. Not sure my poor little pea brain can do much more with it.
thanks for the reply cmltdg. I wanted to reach through the email and smack whoever was sending those emails. I mean really, what is the big deal about answering my question? There is like NO chance they won't be denying the visa so please just answer my simple question so we can be prepared. Anyway enough about that.
Found out Northern Ireland has a postal strike going on right now. Just in time for us to be receiving packet 3.

Oh well we have been pretty lucky so far. Things have been going steady since we filed at the end of November.

Bailey, I dont think anyone was supposed to know about the I-601. Call me crazy, but I believe it's the government's way of weeding out undesirables LEGALLY, kwim? The less people know about how to do it the better in their eyes! So in a way everything is top secret. That's why these forums are great! People get informed and get good information for the most part.

OK...Members...some of you might have seen this on the other site but some may not...
here is a member who just got Approved 601 waiver in London...check out the time it took to Approve the waiver.....so there hope yet for some of you waiting on a Answer soon...

I wanted to let you all know of our approval, me and my husband promised to write and say thank you if we would get approved because at the time we were going through all this really really difficult process of writing a hardship letter and trying to figure everything out, this website gave us the most information and more hope and strength to carry on than anything else. I don't know how I would have been able to do this if my husband wouldn't have found your website. Thank you
I hope our approval gives hope to those who are now right in the middle of writing their own hardship letter, and just don't give up, use all the stickies, use the approved hardship letters, it really really helps.
With my waiver I think we got a very quick answer, London office recieved it Dec. 29 and we got an e-mail from the senator who checked on our case Jan. 20 saying we were approved! So by Jan. 25th. I got my immigrant stamp in my passport. I am very thankful this turned out the best way, It sure was not easy, we were doing all this just before Christmas, the day before Christmas we mailed our letter and we expected to have to wait for an answer at least two months, but the new year really surpriced us with these happy news

Think you're right on that one Misty, when I told my interview officer that I had a I-601 already prepared, he said "how, where did you get that?"

, he looked so suprised! I told him about internet forums etc., and he laughed! anyways it turns out I had to fill out another I-601 form there anyway.
Bailey, I would use your debit card, it doesn't matter if it's paid in UK pounds, it all translates to 265 dollars.
Would it seem a little impatient of me to e-mail London asking them if they had put our waiver on to the system yet? It's only been 6 days since the interview! (or should I wait some more?). I don't want to seem pushy!
