My fiance' name at birth was Marieta, but for many many years she went by Marietta. She got Police clearances under both names, had a new birth certificate printed and had affidavits from people who knew her her whole life and attested to a police agency that Marieta and Marietta were the same person, and that several documents had 2 T's. The Passport was the real key though, it had 1 T as well. Bottom line, whatever the passport and birth certificate have are what you need. He may have to have paperwork produced if other official documents have the "E" on the end. If it is only in your application, then you have to submit a change. Perhaps consult an immagration lawyer for the proper way to do so. My lawyer here only had a consultation fee, but it was worth getting the paperwork through without RFE.
An RFE is a delay from the service center, and does not mean the process will end outright, just be delayed a week or two longer. I'd suggest gettting the affidavit I mentioned and have it handy to add to your paper application here, and his interview there.
