Full Version: I need help!!!! My fiance's name is not matching in some of the docs

My fiance's name is Justin... When I filed for the K129F I put Justin. I noticed on the NSO (BC) it says Justine with an "E". What should we do? Do we have to go by the Birth Certificate? and the CFO certificate that he got he put Justin with no E.
And on his passport it says Justin... Are we going to have a problem ? Please help...

Hi, I know when someone applied for their passport, a NSO certified Birth certificate is one of the requirements, why the name on his BC was not followed? I dont know if your fiance will have to go to NSO and have his BC amended.

how did he get his passport?
an authenticated BC is required to have passport, where they will base the name for passport.
what about school records did it match BC too?

i read other members posts, one letter that differ may raise question.
lets hope not.

His Full name is Justin Paul C. Castro... However on the Birth Certificate it says Justine Paul C. Castro.. I just hope this will not be a problem. Please help.....

It should be in accordance with the BC. Just pray that the interviewers won't see the mistakes.

MY surname on my BC was spelled incorrectly (missing 1 letter) but they didn't notice it.

when u have medical and interview schedule .. call USEM immediately .. maybe they will ask u to fax the BC from NSO and they will correct the spelling right away ....... all your worries will be answered by USEM .....

What about the NOA2?? It has Justin....

Maybe you can use a notarized "Affidavit of Discrepancy". A Notary Public in the PI can do it for Php350.00... I have a friend who had the same problems with her name. All her life she's been using the name she thought's her name only to find out that she got "Mary" on her BC. The affidavit helped here and she's now here, enjoying life in California.

just go to any notary public office and tell you need such affidavit and they will provide the document.

Like I said there are lots of notary public in the PI who will do it for him. Make sure he sees a "real" notary public and not a "quack". Some lawyers are notary public too...

My fiance' name at birth was Marieta, but for many many years she went by Marietta. She got Police clearances under both names, had a new birth certificate printed and had affidavits from people who knew her her whole life and attested to a police agency that Marieta and Marietta were the same person, and that several documents had 2 T's. The Passport was the real key though, it had 1 T as well. Bottom line, whatever the passport and birth certificate have are what you need. He may have to have paperwork produced if other official documents have the "E" on the end. If it is only in your application, then you have to submit a change. Perhaps consult an immagration lawyer for the proper way to do so. My lawyer here only had a consultation fee, but it was worth getting the paperwork through without RFE.

An RFE is a delay from the service center, and does not mean the process will end outright, just be delayed a week or two longer. I'd suggest gettting the affidavit I mentioned and have it handy to add to your paper application here, and his interview there.

We are fixing the CFO and the passport. Now my only concern is the NOA2. It has Justin.. I hope this won't be a problem..

What about it? Will you be using it for something else besides AOS application? For AOS, they will go by the Alien Number and since his name in their records will show Justin without an "e", you can always attach a letter informing them of the discrepancy. Attach the Affidavit of Discrepancy for them to correct his name on their records.

My fiance only got the Affidavit of discrepency for his passport. His passport is still showing Justin with out an E. I hope this won't be a problem. It is too late to get a new passport since his Med will be next week March 28..
