Since we dont know if we are stuck in name check or not and no one seems to know when i call USCIS. Can we still Apply for AP ? We did not apply with the package cause we did not think we would need it (dumb of us i know). Anyone here know anything about this?

Hi, i see in ur timeline that u had ur interview for ur AOS on Date : 2008-01-31, which that means you dint wait that long, i was like you but i get rid of that name check on 2 months and 10 days after my interview, so if i am in ur shoes i will wait a lil bit maybe u will get clear on ur name! but if u wanna travel (urgent) i see no problem to file ur AP.

According to the I-485 form notes you should be able to file your request for AP afterwards, for free even, as long as you send a copy of your AOS NOA.

Thanks Sand i know i am getting a little scared about it, I am not sure if we are stuck in name check or not and i guess the interview did not go as good as i had hoped so that is also adding to the stress. Just wish i could know a simple yes or no

Believe me if they wanna deny u, they will let you from ur interview day, but you still safe ..
