Full Version: passport renewal - non-us citizen wife

aloha,

respect and due props to visajourney and all the people who make it go........we are not alone!

my situation;

fiance comes to usa via k-1 fiance visa.

we marry in the states, but personal family situation require her immediate return home before we complete her change of status in usa.

now in her home country, her passport near expiration. time to renew.

do we renew her passport with her previous name?

do renew her passport with her new/married name?

after passport is renewed, then we can begin her k-3 spouse visa process.

If she is using her married name then yes, go ahead and have the new passport issued in that name.
I would wait until after the passport is issued before starting the process either K3 or CR. Have a look at the CR/IR there is not much time between the 2 at the moment and the biggest advantage is not having to AOS when arriving here. You have some time to think about which way to go with that while they are processing the I-130 and K3. Send in the K3 as a backup.

Official documents like passports should always be in the current legal name. If her legal name changed since her last passport was issued then the new name is what you want in the new passport, IF her government will recognize the new name as her current legal name. They may not.

Claudeth's Filipino passport was getting close to expiring so we went to L.A. to renew it and to change her name. We had to furnish all the same documentation we sent with the original K-1 including my divorce final, copies of our registered marriage certificate and all sorts of other stuff I can't remember. We were there for about four hours as I was running up and down the building getting copies made. They would never tell you what needed to be copied until you came back with the latest copied document tongue.gif The Filipinos learned well how to run a government laughing.gif
