Full Version: We just received the denial notice.....

My Baby just received the denial notice from USCIS last night ( Philippines time ). The reason why we're denied is lack of documents. I was wondering, if that's the reason, why they didn't send us an RFE about that? Even just in our emails. They just denied us that fast w/o even telling us to pass the missing documents first. And they sent us the denial notice 3 months after they received our petition. We even hav our case number. My Baby gonna call them tonight ( Philippines time ) to make clear of the decision. I even told him to pls. ask them why they didn't send us the RFE first before making the denial decision. Even at first, we're wondering why they denied us on that stage. So strange. They gave us their contact no. So we know if we hav to make an appeal or maybe, we'll just send them the missing documents. Hopefully, the latter. 'Coz I really want to be with My Baby asap. I really DO miss him a lot. And I want to make a family w/ him. Appealing can make the processing longer than 6 months. And it's so looong..... mad.gif crying.gif

calling USCIS might not get any additional information. your fiance may have to wait until the packet is returned to see a detailed description of what is missing. without knowing exactly what the Notice of Intent to Deny says, would only be speculating as to the reason. hopefully it's something that can be easily resolved.

What did you exactly send them for proof anyways?

USCIS didn't say there whats the missing docs. So my fiance will just call them to clarify everything since they gave him their contact no. And he also gonna go there personally. Hopefully, everything will be okay. He has an option to make an appeal, too.

They're not like that. They do send letter(RFE) or return the documents to the applicant if its incomplete.(They returned mine and also I received few RFE LETTERS mad.gif ) so I do know what's going on.



You have weird case. Your petitioner can fix it..don't worry.

just curoius, did your fiance say if he received NOA1?

Sorry to hear. The embassy doesn't send RFEs, that would be the service centers. If the embassy doesn't believe your relationship is a valid one they can return the petition to the NVC for further processind including denying the petition. What kind of evidence did you submit to prove you have a valid, ongoing relationship?

an RFE would not be issued if there never was an NOA1. from what has been discribed, a document was missing from the I-129f petition. once the petition is returned, it's likely the situation can be resolved. the fiance can try calling, but I've never heard of anyone being able to go to the Service Center to resolve the problem.

Does the Petitioner have any Criminal records in the past?

You have to tell us.. What did your fiance really send to USCIS for proof of bonafide relationship..

Maybe its insufficient and there is nothing can be done at this time..

The OP says the denial was for lack of documents...not missing documents. It looks like something essential, without which the case cannot be adjudicated, was not included in the filing. It also sounds like USCIS decided it was not something that an RFE could be issued for.
What exactly did you include in your petition? You may do better to just cut your losses and re-file....but first you must find out what it was that you did not include the first time. I hope your denial letter tells you what was omitted, so you can include it and re-file ASAP.
