Taking my own advice -- here is the new Loser list for those of us who filed in TSC between February and June 2007 and were just transferred to VSC on Jan. 31 after enduring all of that time at TSC. (If you are someone who just filed at TSC and were instantly transferred to VSC, this isn't the place for you.)

Looks good to me..anyone want to bet if we get touched again soon? I think there will either be a lot of action within 2 weeks since we are in front of everyone else..otherwise we are treated as newbies and wait another 7 month period!!!

You have to believe all of the transferred cases are at the top of the pile. The newest of those cases is still older than than the oldest petition that was filed directly at VSC.

Within that pile, though, you and I are probably 2 and 3 months down, respectively, because the oldest transferred petition is from mid-late February. Which means, barring some miracle, we'll probably get approved at around the one-year mark of our NOA1s.

Speaking about the one year mark. I spoke to USCIS customer service lady last week (before the transfer). She was one ticked off individual. If you've seen that movie, Anger Management, she was the flight attendant who was saying "come down, sir, it's a difficult time for our country" while I was Adam Sandler. I seriously did not raise a voice and was very polite, but she was definitely borderline between "I just told you that, sir" and "I am going to hangup now, sir."

Anyhow, I asked her why I haven't been approved yet. She said that it is taking now exactly a year to be approved. I don't think she knows what she is talking about though. I asked her if she has any grounds for saying that - and she replied: "well, your wife's letter has been issued for one year, sir."

Well, at least you could hang up on her..imagine her being your officer at a point of entry or interview!
with all TSC cases at Vermont I don't know if they push everything back 3 months or if 3 months worth of old TSC petitions might not all get done in a shorter time. If it took 3 months for me to get approved, all VSC filers now would have an additional 3 month waiting time!

:-)))) You know what I do to get this passed me? I imagine the angry lady sitting on the toilette. The whole aura of righteous fury disappears and the comical situation emerges.

I note aussielad is getting burned up about that possibility in another thread. He's only been waiting five months . . . so he has to wait eight months total, it's still less than any of us.

I agree completely. It has been close to 9 months for me and I am one of the youngest TSC leftovers... it is about time for us..if everyone was done in 6 to 10 months total that would be fine. Over 12 months means trouble wiht expiring extension letter etc... hope to see movement in the next weeks!

Could be, I bet the toilets in the TSC basement men's room backed up a few times and flooded the janitorial closet where they were storing our cases.

i recieved the email stating that my case has been moved to VSC, but i have not gotten the letter saying why and it says in the email that im to follow the instructions provided on the notice. Anyone have any idea what the instructions are?

I haven't gotten the actual letter yet either. But it probably only says something earthshaking like let us know if you move, that kind of thing.

It is Wednesday and we still don't have any approval notices? I was hoping the transfers would spark fireworks of action..back in the waiting game I guess....

It can -- , from what I understand, an N-400 interview with a still-pending I-751 will usually force adjudication of the I-751 right then and there by the interviewing officer -- but unless the time for VSC approvals stretches out to a year from the current 6 to possibly 9 months, your I-751 will be approved well before you are eligible to apply for naturalization.

Look at it this way: there can only be a few I-751s left at TSC, all from RFEs from February. I'd bet you'll be approved before any of us if you've responded to the RFE promptly.

yeah, but James, im eligable in August to send off for naturalization. I sent off the I-751 like in september of 2007, so if its a 6 month mark, that means next month i should be approved, if not, then, i guess maybe....maybe at the rate VSC is going, by the time i send off the N-400, and get called for an interview THEN it might be approved at the rate the VSC is working.

And we pay $545 in the price increase for a slower service??? what i believe is that its just bad management at the top when they switched people to Emilio Gonzalez.

i bet the former director would've had it under control.

Even if VSC approvals do back up because of all of the new transfers, it'd probably only be another three months, so you'd still get approved by June. Plus, who knows, maybe with the fee increase, whatever new workers they hired have finally gone "online" at VSC and there won't be any additional backlog. Unlikely, but who knows.

But you're right -- the fee increase was a clown move by USCIS. They raised the fees so they could clear whatever backlogs they had, and ended up creating bigger backlogs because of the rush of people who filed before the fee increases. (Ironically, all of those people who rushed to beat the fee increase and filed at TSC and NSC were long ago approved by CSC.)

I thought we would have gotten the notice about the transfer in the mail by now (by yesterday's mail, actually -- five days from them sending the notice out the day after the date on the notice). It probably doesn't say anything different than the online case status message, but I'm curious. Anyone get theirs yet?

I just got this WIERD letter from TSC, pretty much says that I was "erroneously admitted as a conditional permanent resident when i should have been admitted as a permanent resident without conditions" This is because I became a PR more than 24 months after marriage...

Therefore, (the letter continues), "Due to that error this office is terminating action on your I-751 petition, and your filing fee will be refunded to you. Termination is without prejudice to your permanent resident status." signed by Director of TSC!

So I guess they did not even review my case. Will wait for card and Check...

So is this correct? Did you receive your conditional card more than 24 months after marriage?

Just got the I797C, Notice of action in the mail. It has the same TSC case number I had before and it was sent from Texas Service Center.
Notice Type: Transfer Notice, the notice date is February 01, 2008 and receipt date March 09, 2007.

What's weird is that in the upper right corner under case type it reads:
" CRI89 Approved Removal of Conditions (I89)"
(I wonder if it means that all transfers will only get card processing done, i.e. we are already approved?!?)

The notice itself says:
" This is to advise you that in order to speed up processing we have transferred the above case to the following USCIS office for processing: Vermont Service center....."


I don't really know what to make of it. So will just sit back and wait what happens next (hopefully soon).

that sounds very promising. I wonder if it means you are approved for processing/transfer purpose only or the case is approved.

That sounds so good. I hope its all good as "worded". I hope that everybody else will get same type of letter.

My letter says the exact same thing tweety, and I noticed that particular wording in the top right hand corner as well. Will be interesting to see what this all means.

diesny, did your online notice mention the interview? some people got a different notice saying their case was forwarded for the interview in vermont.... maybe they just randomly use different notices (taste of officer maybe)...?

So approved and interview? What you guys think?



Sounds like interview, but considering that this was a massive effort on TSC side to get all these transfer notices out, it could well be that one of the case workers accidentally used the wrong code or phrase for your letter.

if even the "interview" cases have the "approved" phrase included I guess it does not mean much but we can still hope...

My letter says the exact same thing tweety, and I noticed that particular wording in the top right hand corner as well. Will be interesting to see what this all means.


We got ours yesterday, too, and it also says the same thing. The "approved" wording raised my eyebrows as well. Although you'd think if it were really approved, they would tell you that it's been approved and that card production has been ordered (through VSC?).

I do note that according to the notice's lengthy paragraph about processing times, you and I and the rest of the later Losers who have been on the far side of the creeping April processing date that TSC has been posting for months are now even further away from the processing date because VSC's posted date is March 1, 2007!

(Tweety, that means you are back within the processing time! No service request for you!)

so James, when you mentioned the above, with no service requested thing, does that mean approved? or "interview"...?? wow this is getting confusing.

One more thing........


Do you count 6 months back from their priority date??? because i did mine in September, someone said you count back 6 months and thats where they really at. is that true???


because if so, ours should be adjudicated this month then.

I hear you James, I try not to get too excited seeing the word approved, it seems like a cruel joke in the light of the processing time paragraph. I have already resigned myself that I will be one of the last Losers to be approved!
