Full Version: Fiance deported WITHOUT luggage!!

Hi everyone...
My fiance is finally out of jail and deported back to Yemen. (I don't know if I should be hapy or sad!! At least he is out of jail...) But the problem does not end here, they left us with one last annoying problem.
I had his luggage packed and ready to go all the time he was in jail. I tried to drop it off to the immigration building when he first got arrested but they did not take his luggage and said I had to come back and give them the luggage when I knew the date he was leaving.
Here is the problem.. They told my fiance on FRIDAY NIGHT that he would be deported on Monday. Immigration building is closed friday night, saturday and sunday and opens at 8AM on Monday. I went on Monday morning to the immigration office even before 8 am waited until they opened to drop off his luggage. And guess what... They tell me he is gone already!!! And I have to mail his luggage to Yemen.
He has no warm clothes, he has no money, he has nothing with him, only the things he was wearing the day he was arrested, and maybe $20 in his pocket from that day!!
What am I supposed to do?? Mailing the luggage is $400. I have to pay for their stupidity?? or what? Can I make them pay? It is not only about the money, I will pay if I have to but I just want to let these people know this is not how they are supposed to treat people and make everything harder for us.
Never been this angry before in my life!!!!
What should I do complain? To who?
Any advice anyone??

I'm sorry this happened and you're upset. I think you will be further frustrated if you try to get them to pay or make an official complaint. I'm not sure how far a dollar will go in Yemen, but given his situation (no clothes, money, etc.) would it be better to send him $400 instead of spending $400 to send his belongings?

What does Homeland Security suggest? That would seem to be the place to start. Doubtful that you could get them to pick up the tab...it's not their responsibility. Not likely they'd be any more sympathetic to anything that concerns him either, regardless of the circumstances. Doesn't he have family or friends in Yemen that can help when he arrives, with food, money, etc?

It's good of you to be concerned about his luggage but it is not the US government's responsibility to gather the belongings and reunite them with deportees. I suggest you determine what to do based on your own priorities and resources.

Sounds more like an Airline issue, which Airline?.

His luggage allowance would depend on the ticket he bought. As he did not use his allowance there might be something they would be prepared to do.

Don't think its an airline issue, they took him from the immigration building by the time they opened at 8am. Airlines will not ship luggage without the ticketed passenger on board. Its a rule post 9/11.

Edited: they'll only ship if they mess up and ship to wrong location or cause delay. But this situation seems he was taken from immigration jail before they opened in time at 8am for OP to give the luggage.

Other than sending him the money as Reeses suggests, the only other thing I can think of is to bring them with you when you visit. You can check with the airline with regard to baggage allowance and overages costs.

I know my luggage has been on a different plane to me, but they can probably bend the rules to suit themselves.

Do not remember the name, but there is a company that basically sends your luggage for you, targetting those people fed up waiting for luggage to come off, they pick it up in advance from your home and its there at your destination when you arrive.

I would at least try the Airline and see, just a phone call, especially if he is a Frequent Flyer with them.

On a practical point of view, Money, well even in the most 3rd World country I have always found a bank machine to get money out, especially at Airports.

And for minor personal effects, probably has replaced them by now anyway.

You seem to be missing the "deported" in the subject line. The passenger didn't make his own flight arrangements. Somebody with a gun and badge escorted him to a flight the authorities arranged for him. This is not an airline issue.

The situation was the result of illegal presence in the U.S., not stupidity by ICE.

Usually good practice to pay your own way in such circumstances.

Complaining about luggage when you have been flown out at the public expense would be taking the piss big time.

Maybe you could sell his luguage and give the proceeds to the taxpayer to compensate for the cost of his flight out of the USA....

Just looked back at the OP's prior posts, was refused Assylum a long time ago, could have left under own steam.

Deportation is not something taken likely. If, after all the proceedings, they were in a hurry to get him out of here for whatever national security reason, it's no accident. Don't they blow things up in and around Yemen? And no...his luggage is not anyone else's problem.

No offense intended but your beloved was unlawfully present. I know it is difficult to swallow, but his asylum case was denied more than 5 months and he knew that he was here on borrowed time. I am curious that you were thinking he would be released? Frankly, I am surprised they detained him so long

I was thinking the same thing to bring the lugguage with you when you visit, but either way I am so sorry to hear of your situation sad.gif

He was not here illegaly. He had a pending asylum aplication for 8 years. When it got denied, he was put in jail. You are not considered illegal while you have a pending case.

I did not think he would be released. I was waiting for him to be deported (better than being kept in jail). I just did not think jail time was necessary, not only for him, but for anyone who has a pending or denied asylum case. They should have deported him without jail.

No, could not have left a long time ago, since his passport was also taken from him when he appealed the first decision and reapplied. His passport was never given back to him even though he asked for it and said he wanted to leave the USA a long time ago.
