Wanted to know what peoples experience was with the time it takes from USCIS Delhi accepting your I-130 to when you got a Case# assigned to your petition. Thank you.

Here is what I found:
FORM I-130

An immigrant visa is required of anyone who wishes to enter the United States to reside there permanently, whether or not that person plans to seek employment in the United States.

The USCIS Office in New Delhi accepts Form I-130 [Petition for Alien Relative] by U.S. citizens
filing for the immigration of their family members classifiable as “immediate relative” except siblings irrespective of any age.

Immediate Relatives:

The following relatives of U.S. citizens are eligible to qualify for immigration in the immediate relative category.

Spouse or Minor Child of a U.S. Citizen:
An Immigrant Visa may only be processed for a child if he/she has no claim to U.S. citizenship.

Parent of a U.S. Citizen :
U.S. Citizen must be 21 or over

Step-parent or child of a U.S. Citizen:
Stepparent-stepchild relationship must occur before the child’s 18th birthday


Note: Grandparents, aunts, uncles, in-laws and cousins cannot sponsor a relative for immigration.

Effective June 1, 2006, U.S. citizens who wish to file an I-130 (Petition for Alien Relative) for their immediate relatives must provide evidence that they are residents of India. Proof of such residency will include a U.S. passport with an appropriate long-term, valid Indian visa and a Registration Report and Residential Permit issued by the Foreigner’s Regional Registration Office (FRRO) of the Government of India. Additional evidence should include, but is not limited to, on-going employment in India, taxes paid in India, rent/property receipts, and utility receipts in India. In most instances a finding of residency cannot be made with less than 90 days continuous presence in India.

United States Citizens may file their petitions between 9:00 AM and 12:00 Noon on all normal business days. The Petitioners must comply with the filing requirements of this Office.

United States Citizens MUST BE PRESENT to file their petitions. If a United States Citizen is filing for a spouse, it is recommended that the spouse also appear so that immigration officials may ask any questions necessary for the adjudication of the petition.

Applicants who do not meet the above residency requirements must file their petitions in the United States with the Service Center having jurisdiction over their place of residence. The address for the Service Centers can be found on the petition or on the website at www.uscis.gov.



Family Petitions (I-130)

I-130 Petition for Alien Relative
The U.S. Citizenship and Immigration Services at the U.S. Embassy in New Delhi accepts I-130 petitions from U.S. citizens who reside in India.
U.S. citizens whose principal residence is not in India, and/or are abroad temporarily as a visitor or on business, must file the petition in the United States.
If you are not eligible to file in New Delhi, you should file the petition with the U.S. Citizenship & Immigration Service Center having jurisdiction over your place of residence or last residence in the United States. Lawful Permanent Residents must file the petition in the United States.


Evidence of Residence
As per 8 CFR (33) The term "residence" means the place of general abode; the place of general abode of a person means his principal, actual dwelling place in fact, without regard to intent.

Proof of such residency will include a U.S. passport with an appropriate long-term, valid Indian visa and a Registration Report and Residential Permit issued by the Foreigner's Regional Registration Office (FRRO) of the Government of India. Additional evidence should include, but is not limited to, on-going employment in India, taxes paid in India, rent/property receipts, and utility receipts in India.

In most instances a finding of residency cannot be made with less than 90 days continuous presence in India.

Under no circumstances a petition can be filed with a foreign office of the Service or at an American consular post solely for the purpose of obtaining prompt action on a petition.

I-130 PROCESSING

Q. Who can file Form I-130 [Petition for Alien Relative] at the USCIS Office in New Delhi,
India?
A. A U.S. citizen who is a resident of India can file Form I-130 on behalf of
his/her spouse, parents and child (less than 21 years old) at this Office. Normally, a Residential Permit issued by the Government of India would suffice as proof of residence in India.

Q. What documents are required in support of the Form I-130 [Petition for Alien Relative]?
A. For Spousal Cases:
· Form I-130 completed and signed by the U.S. Citizen Petitioner
· Form G-325A completed and signed by the U.S. Citizen Petitioner
· Form G-325A completed and signed by the beneficiary
· Proof of U.S. citizenship (i.e., U.S. Passport, Naturalization or Citizenship Certificate)
· Proof of nationality of the beneficiary (i.e. Passport, birth certificate, school certificate)
· Marriage Certificate
· Proof of termination of prior marriages
· Passport size photograph for both Petitioner and Beneficiary
· Marriage Album/Photographs, if available

For Child:
· Form I-130 completed and signed by the U.S. Citizen Petitioner
· Proof of U.S. citizenship (i.e., U.S. Passport, Naturalization or Citizenship Certificate)
· Proof of nationality of the beneficiary (i.e. Passport, birth certificate, school certificate)
· Marriage Certificate of Parents
· Birth Certificate of beneficiary indicating Parents’ names
· If the child’s name was not entered at time of registration of birth, school certificate must be submitted indicating parents’/father’s name

For Parent:
· Form I-130 completed and signed by the U.S. Citizen Petitioner
· Proof of U.S. citizenship (i.e., U.S. Passport, Naturalization or Citizenship Certificate)
· Proof of nationality of the beneficiary (i.e. Passport, birth certificate, school certificate)
· Marriage Certificate of Parents
· Birth Certificate of the Petitioner indicating Parents’ names

Q. What is the fee and how can it be paid?
A. Please click here for the latest on Form I-130 fee. The fee must be paid in cash
to the Embassy cashier who accepts both the U.S. and Indian currency.

Q. Can I mail the Form I-130?
A. No. You are required to submit this form in person.

Q. Where is the USCIS Office located?
A. The USCIS Office is located at the American Embassy, Shantipath,
Chanakyapuri, New Delhi.

Q. Do I need an appointment to file my Form I-130?
A. No. We accept walk-ins on any business day between 0900 to 1200 hours.

Q. How much time would I require to submit my Form I-130?
A. Filing of Form I-130 at this Office is usually a one-day process. However,
please make adequate travel plans to accommodate unforeseeable events.

Q. When will my case be approved?
A. A decision is usually made within one week of the receipt of your application.

that's good info, but remember that filing the I-130 and getting it accepted is ONLY the first step in the process. After that comes the gathering of supporting documents, the police certificates, medical examinations, and finally the wait for an interview at the consulate.

Yep thats from the US embassy website Delhi

From what is says and my experience is That the USCIS office in Delhi will not accept your application unless you are a Indian resident at the time of Submitting your Petition So #1 you must prove you are a Indian resident
the Minimum time of stay is 90 days, stated above in Sahana Post . In most instances a finding of residency cannot be made with less than 90 days continuous presence in India. then you also need extra's FRRO is the best but they told me they will also accept Utility bills, taxes paid in india, Employer information (must be a credible agency), Bank account in india indian address, drivers license indian not international, affidavits from neighbors.

Then you need
· Form I-130 completed and signed by the U.S. Citizen Petitioner
· Form G-325A completed and signed by the U.S. Citizen Petitioner
· Form G-325A completed and signed by the beneficiary
· Proof of U.S. citizenship (i.e., U.S. Passport, Naturalization or Citizenship Certificate)
· Proof of nationality of the beneficiary (i.e. Passport, birth certificate, school certificate)
· Marriage Certificate
· Proof of termination of prior marriages
· Passport size photograph for both Petitioner and Beneficiary
· Marriage Album/Photographs, if available

ALL this can be submitted in a walk in interview best time to go is 10am you don;t have to wait in line but you do have to wait in the back room may take an hour or so but they usually help every one. I did not see anyone get sent off because they(USCIS) were to busy but I did see them get sent off if they did not bring any one thing from the list above.

ohmy.gif Getting alittle worried NOW .... I saw that VISH and a few other people got a letter form there local consuletes in two to three weeks IT's been 7 weeks and no news for us ClockWatch2.gif AHHHHHHHHHH whats up with this is it by consulet or just random luck. I really starting to getting a little stir crazy ^^^^

Hi Aman Ram - I feel your pain! Have you tried contacting either USCIS in Delhi or the Consulate in Mumbai? Maybe they could check around a little bit...

HI Carolyn yeah had called Delhi Consuler office on Feb 6 they said no case number assigned yet and to call back in three weeks if letter 3/3.5/ (let us know your ready to interveiw packet with case #) does'nt arrive so will call again next friday to see whats up if we don't hear anything sad.gif I did check with USCIS talked with the lady that interveiwed us African Amercain nice lady on Jan 18 she said everything good on their end And as of Jan 15 or 16 can't remember it's been Approved for Filling with USCIS Delhi whatever that means cuz I thought at that point I whould get a case number. In any case I don;t see if The place we submitted the back office I think Department of Homeland Security building and its The Embassy that gives a case number The ENTERANCE building how long could it possible take to get there If People in Mubia and Chennie are getting there letters how is it possible that people whose cases staying in delhi are filled yet. WHAT CHOULD HAVE HAPPENED did someone TRIP AND LOSE MY FILE walking over from one building to the other>>>>>>>>!!!!!!!!!!!!!!!!! NOoo probelly not = Knock on wood. AHHHHHHHHH smile.gif= feel better

New Delhi is the only Consulate to handle DCF ... it has lot of load of applications.. and consulates in India r the busiest all over the world now, Just dont worry . Hang in there and collect rest of the documents and certificates required.

Hi again Aman Ram,

Just a quick question, did you get the 3.5 packet at the USCIS office in Delhi when you submitted your I-130? We did, and if you did, it may just be that you need to submit all those required documents to the Mumbai Consulate to get an interview...

There has been some confusion for us (too many papers, too many places to find too many tidbits of information!), but we are starting to think that we should just send the forms to Chennai. As the person from the Chennai office told me - in a very vague and muddled way - Please send the FORMS ONLY from the 3.5 packet, NOT the documents...

We are going to send the DS 230 (parts I and II), the I-864 and any documents required to support it, and the DS 2001 next week. I don't want to wait and wait and wait for something that just might not show up!

As far as including Police Certificates, etc. copies, I guess that would be a 'document' so we won't send those til we get the Interview date and request to mail things through VFS 15-10 days before the date.

I am sure that whomever wrote the instructions for this process think that they are clear, but man, there are so many little things that can snag you!

Hey, Carolyn Hope this helps and does'nt confuse you more wacko.gif Here goes looked around on delhi website and here at VJ from what I can see your rite they want "Documents" pcc, birth certifacte, etc 10 days before the interveiw date submitted at local VFS and pay a courier fee that also pays for your passport being sent back from consulet or embassy back to your local VFS. Also, I GUESS and this is only a GUESS lol (sorry I can't believe this process has become a Guessing game were did we go wrong) kicking.gif

Anyways, back on topic but I think the consulet guy is rite you do only send the DS230 and readiness for interview form wich form research seems to be a Cheacklist signed I persume BUT one thing nags me how do they get the forms to the rite Petition without a case number???? unless you have one?

I can understand why you would be upset at this point... I remember seeing the woman you are talking about, she did have a friendly face! smile.gif

Why don't you do an InfoPass Appointment with USCIS? It wouldn't hurt to try, and it is unusual that you didn't get the packet... Did you pay and get a receipt for it that day? If you did, I thought that pretty much meant that you were accepted/approved...

You can download the information you need from the Delhi Embassy website, look for packet 4 - it is pretty much the same thing! Also, I don't think we necessarily get Case numbers when doing DCF - it is a little different, as far as I know.

Do you have all the documents you need ready? The birth certificates, the police certs, marriage and proof of relationship, etc., etc.? If you have everything you need, I would courier the DS 230 and DS 2001 (or follow the Delhi steps, they may be a little different than Chennai's) NOW! Maybe I am crazy, but this seems like a bit too long for the Delhi office.

Hi! We just got the 'official' Consular letter from Chennai today with our case number - it was sent on February 13th!! Sooo, if I were you I would definitely schedule an Info-Pass meeting with the USCIS office in Delhi, or at least contact them again via email, telephone, etc. It must have been about 8 weeks now, and that does seem a little bit long considering that our packet was processed, sent to Chennai and they had created our case number and mailed it out within a week.

Be polite, but definitely persistent - at least once a week contact them - DO SOMETHING!

You should definitely get the case number. My wife got it in about 2 weeks after filing in Delhi.....

Hi! We just got the 'official' Consular letter from Chennai today with our case number - it was sent on February 13th!! Sooo, if I were you I would definitely schedule an Info-Pass meeting with the USCIS office in Delhi, or at least contact them again via email, telephone, etc. It must have been about 8 weeks now, and that does seem a little bit long considering that our packet was processed, sent to Chennai and they had created our case number and mailed it out within a week.

Be polite, but definitely persistent - at least once a week contact them - DO SOMETHING!

You need those documents to the interview... that is clearly mentioned in covering letter of packet....

VISH has already gotten his interview date for May I believe...
I think you should make a trip to the office and see what is going on.. I believe that you must get the packet 3.5 from the officer when you filled the application....or call the office.. It has been more than 3 months since you filled the application and am surprised you have not received the case number...

You need those documents to the interview... that is clearly mentioned in covering letter of packet....


It may depend upon the Consulate what you send and what you bring to the interview - we just had to send the DS 230 and DS 2001 letter back to get our interview date. We have to send all the other documents via VFS by the 19th of March for our April 3rd interview in Chennai.

We are going to send the DS 230 (parts I and II), the I-864 and any documents required to support it, and the DS 2001 next week. I don't want to wait and wait and wait for something that just might not show up!

As far as including Police Certificates, etc. copies, I guess that would be a 'document' so we won't send those til we get the Interview date and request to mail things through VFS 15-10 days before the date.

I am sure that whomever wrote the instructions for this process think that they are clear, but man, there are so many little things that can snag you!

You need those documents to the interview... that is clearly mentioned in covering letter of packet....


It may depend upon the Consulate what you send and what you bring to the interview - we just had to send the DS 230 and DS 2001 letter back to get our interview date. We have to send all the other documents via VFS by the 19th of March for our April 3rd interview in Chennai.

I do not have the 2001 forum in the packet which I got from the officer...


I wondering, my agent recomended to wait for the documents to arrive from Mumbai which will have the case number on it..

Why don't you do an InfoPass Appointment with USCIS? It wouldn't hurt to try, and it is unusual that you didn't get the packet... Did you pay and get a receipt for it that day? If you did, I thought that pretty much meant that you were accepted/approved...

You can download the information you need from the Delhi Embassy website, look for packet 4 - it is pretty much the same thing! Also, I don't think we necessarily get Case numbers when doing DCF - it is a little different, as far as I know.

Do you have all the documents you need ready? The birth certificates, the police certs, marriage and proof of relationship, etc., etc.? If you have everything you need, I would courier the DS 230 and DS 2001 (or follow the Delhi steps, they may be a little different than Chennai's) NOW! Maybe I am crazy, but this seems like a bit too long for the Delhi office.

Man I just got the worst news ever!!!!!!!!

So I have been calling Delhi the 2419- 8062 number same guy always answers and is very helpfull.

On FEB 22
This is whats he told me YES IT IS VERY VERY UNUSUAL that WE DON"T HAVE A CASE NUMBER YET!! AHHHHHHHH
then he says that at the delhi office they had some technical issues and they were recovering or fixing something??? He said they were going to be done by end of next week and to call back then.

WELL THEY WERE CLOSED ON THEY 29th SO I CALLED ON MARCH 5th

Just a thought---- Its seems DELHI USCIS is the only place you may submit I-130's BUT USCIS only approves your
I-130 for filing it is The COUNSLER SECTION DELHI or your respective COUNSULIT that assignes it a case number and does the finally processing and interview i.e why case number start with BMB or CHI or NWD.
Don;t know if that helps anyone just thought it might help clear up some of this mystery called PETITIONing FOR A LOVED ONE

P.s It also seems from research done on VJ i.e this thread BMB & CHI are the bomb didictdie counslets while NWD not so much..... tongue.gif ooooooooooooooooo I REALLY MISS HER GUYS!!!

Sahana - we did downloaded DS 2001 from the web (I think the Australian Embassy site), and sent that with the DS 230 (stating that we didn't have a case number yet) on a Friday, then we got the letter from the Consulate the very next day with the case number!! We just let them know via email everything that had happened, and they said not to worry, they would take care of it.

We kept emailing them and got the case number this past Wednesday, and they said that they had mailed the letter out the same day - but mail seems to take about 10 days plus to get to us from Chennai. Thank goodness they emailed us with the date, or we would have gotten the letter the last day that the docs have to be given to VFS! wink.gif

We filed our I-130 on Feb. 6th, and the letter with the case number from Chennai was written and sent on the 13th - so I will say that the Delhi-Chennai connection is tight and fast! Woo Hoo! smile.gif I am not sure if the same is true for Delhi-Mumbai, or Delhi-Delhi (I am soooo sorry AmanRam, I am wishing/hoping/praying for a quick resolution for you!!!).

He said that there is no point filing the forms from package 3.5 without the case number because, it'll be very hard to track it. So we waited and in about two weeks after filing we had the case number and the same package. My wife sent it back and then she now has the Interview date too....hopefully above will clear some confusion regarding the package 3.5.
Also I think residency stamp from FRRO and 60 days stay in India is enough to file from Delhi, cause in my case it was only about 64 days or so only........Also case number are assigned by the respective consulates...so for example if it's from Mumbai then you have BOM in front of you number...

So they send out packet 3 on the 15th and without any kinda anything scedhele the interview on the 4th then we got packet 4 on the 25th thank god for the site We had eveything ready so its all Good to GOOOOOOOOOOOOOOOO......

HEY GUYS man is this some kinda wierd rollorcoster ride!!!!!!!!!!

This process is wierd- Anyways here my quick Recap on total events of what happend and where we're at so far.....

1st Did DFC at delhi I stayed the 90 days filed on Jan 2nd

2nd Waited 3 1/2 months for some kind of response. Calling every few weeks to make sure something had'nt gone wrong. Well it had (What had gone wrong I don;t know just that they kept saying we have NO INFO on your case) after 3 1/2 months On March 18 was told over the phone we were set for an interview on April 4th. By the way had'nt even gotton a packet 3 at this point........!

3rd Got packet 3 on the 20th march and packet 4 arrived on the 25th of march. GOOD JOB EMBASSY!!!! Lucky had found this site and been perparing all along Sent out Packet 3 info on March 24th smile.gif

4th My dear wonderfull amazing wife wub.gif Travels 11 hours to Delhi does the Interview Standered Q's where we met, how, my job, blah Blah BLah BLAh BLAHHHHHHHH nothing outragous there ( ohh just wait it gets good).... Interviewer says everything looks good but we need everything on this list subbmited for proof of relationship.
1.) Phonelog- E-mails- Letters sent- Wedding Certifacte-anything and everything showing our conection with each other
2.) Pre, during wedding and Post/honeymoon pics of us together
3.) Bill for wedding hall and Vendores/caterers
4.) Photo copy of my passport showing when I was in india
5.) Names Phone # and adresses of 20 guests
6.) A Family tree of both of us Parents Siblings Aunts Uncles 1stCousins and contact info OMG WTF!!!!!!
******By the way did have phone bills text messages statement from insurce shes been added as a spouse to my insurence wedding and honeymoon pics wedding Cetifacate goverment and Gurdwara letters sent they already had copy of my passport**** did'nt know eveything else apparrently has been standerized???

Anyways there where 5 women on the day my wife was in delhi 4 Thats rite 4 out of 5 got told to bring more info THAS Carzy if they wanted all this why did they not let us know in advance with at least more then 2 weeks NOTICE if I had'nt called INTERVIEW LETTER ARRIVED MARCH 25TH for an APRIL 4th INTERVIEW WOW!!!!!!!!!! ranting33va.gif all 5 women did get finger-printed and Visa fee was taken.........

So we got everything together Lucky don;t have to go back to delhi everything can be subbmitted at local VFS and they Stated it would be a quick turn around 1 week tops UMMMMMMMM WE"LL SEE I really hope though Please please PLEASE heart.gif

I do not understand, didn't you submit some of those things before - pics, marriage certificate? The family tree and phone numbers, wedding costs, etc. seems to be a little thing (BIG actually!) that Delhi does... sad.gif Especially if it is a Hindu ceremony. I am convinced that because ours was under the 'Special Marriage Act', they did not require as much documentation.

This is great information for EVERYONE going through Delhi, thanks for sharing!

Oh my god......it's just so hard to imagine the hell you had to go thru, AmanRam. But seems like finally you're done.......so congratulations.......and wish you great, happy and prospouous marriage......

But now I'm so worried. I hope Bombay consulate will go easy on my wife. Also the only proof of relation i have, are wedding pics, honeymoon pics, and Phone call bills. No emails or letters........ Also, our Court marriage and Traditional marriage dates are different. And we're planning not to disclose that fact during interview. we'll just tell them everything happened on the day of the Court marriage, so if they ask for Bill for wedding hall and Vendores/caterers or list of Guests, then there's a good chance it can go very ugly for us.....................

any suggestions/information would be great.......

Hey VISH,

I wouldn't worry about the different dates for the marriages - doesn't EVERYONE know that Indian weddings are longgg processes?? wink.gif Seriously, if you have proof for both you should be all set! I would recommend having things like receipts of wedding halls, etc. READY for your interview! If you were married under the Hindu Marriage Act, have plenty of pics, docs, etc. - they seem to be more picky about that for some reason.

Are you still in India? If so, GO TO THE INTERVIEW! If not, would it be possible to fly back for it? I think the COs can be intimidating for anyone going in alone, even under the seemingly easiest of situations.

As far as on-going proof of relationship (or prior) gather anything you can - if you are still in India, your being here is proof, right? wink.gif The last thing we had in our package was our honeymoon pics from early Feb. You still have time to 'gather more evidence' - especially if you are in the US now. Write those emails, send some snail mail (oops, maybe not, the postal system might be too slow!), send those phone records!

Also, I did notice that they gave someone a 221g at the counter ahead of us, they wanted copies of EVERY PAGE of the spouse's passport. They kept mine between interviews and may have swiped it in the system to see when I had been in and out of the US since US passports don't get stamped on arrival/departure. Have copies ready if necessary - better to be safe than sorry!!

Should we tell during the interview that the traditional wedding was on the same day as the Court Registration date, even if it's not true?? What are the chances that they might inquire more about it? I won't be able to fly back to India to be with my wife during interview, and I'm bit worried that if she'll mention that the Court registration and the Traditional wedding were on different dates than they'll just make it tough for her????

Also in the I-130 Application we mentioned the Court Registration date......

I'm Confused.......am getting more and more paranoid as the days get closer.....

cool.gif I always stay with the TRUTH! You had two marriages/weddings - so what?? First of all, if they DON'T ASK, DON'T BRING IT UP! If they do ask, tell the truth with confidence!! Have your backup documents so that she feels prepared and strong going in, and DO NOT GIVE MORE INFORMATION THEN ASKED FOR!! (That is a suggestion that I read somewhere else, and I believe in it!! Answer their questions, but don't give so much that you talk yourself into a circle!)

She will be fine, now you reinforce that with her too!! Practice anything with her that you think will make her too nervous - answers shouldn't be rehearsed, but comfortable.

I mean ofcourse there going to be diff your have your religous wedding one day (we had a cirtifacte from our gurdwara) and then you go to court after honeymoon and stuff And finialize it I mean it not like america where the ordaned minster does it ALL blush.gif Its india Baby! Anyways the other reason is also just in case they do ask around you don't want signed documents biteing you later...

Invitation cards are a great idea, it will show your names, family names, location, place, date, etc! If someone in the family has a list of guests that the invitation cards were sent to, that could be helpful, or any receipts from the hall or food people, music, clothes, etc. Take a lot of pics with as many family members as possible - even if it is too much, better to be safe than sorry! smile.gif
