I like to know how do people with AOS status file taxes , what staus am I , am I non resident or resident
I looked trough this site I know Im not a qualified greencard resident ,

I,m not working so I know we have to file married and join
I came here on Nov 12 got married dec 1 ,my AOS is pending
if anyone can help me figure out my status and know what documents I need to profide to IRS profing my status ,I would apriciate it

It would appear you do not survive the greencard test or the substantial presence test, so you are probably a non-resident alien.

ok thank you , and do you know if there is any documents that I have to provide proving the none resident status other then a copy of my passport , is there a form i have to fill out ?

Check with Kezzie on VJ site, she is pretty skilled in this area and works in it I do believe. good.gif

If you do not pass the residency or greencard test, then you are non-resident alien.

But you want to file married filing jointly (MFJ) - then you choose to be resident for tax purposes.

so from what I read here we can file married jointly and my status can be resident for tax puposes , and have to attach a statement signd by my husband and me to the 1040 declair the choice without problems ?

Tax time is going to be so confusing for me this year for so many reasons....
