Hi there,

I entered the United States on K-1 Fiance visa. My wife and I got married and I applied for AOS and EAD, but not for Advance Parole. Now that my Grandfather is passing away however I need an Advance Parole as quickly as possible. What is the best and quickest way to get one? I am assuming that just filling out form I-131 will result in a lengthy waiting period.

I got married on September 21st, 2007 and my K-1 visa expired on Dec. 22nd, 2007. I have an I-797C that they received my Application for AOS.

Schedule an Info-Pass appointment, bring I-131 filled out, documentation of emergency, and fee to the Field office.

And two passport photos. The fee needs to be a money order. They don't accept checks.

Will I need to pay the filing fee? It says in the instructions that if you filed for AOS as of July 30th 2007 you don't have to pay the filing fee for an AP.

Oh, okay. If you paid the new fee ($1010, I believe) at AOS filing that included the cost of the AP. Just take your receipt with you to the InfoPass.

Is there no quicker way? I didn't get an appointment with Infopass until February and that is kind of a long time for an emergency. Also what kind of documentation will show them that there was a family emergency?

Ohmygosh. Is there any way you can go to another office, or maybe call them? I have no idea what to tell you. I took faxed copies of letters from the hospital and the attending physician.

No..there isn't a quicker way. You will need to show proof of the emergency. A letter from your grandfathers doctor with details of his condition and that time is of the essence. Make sure too that your local office will issue emergency AP because mine wouldn't (Jackson, MS).
