But I have good news I am sending back the RFE today and hopefully will have AOS approval in the next couple of weeks .

They requested an original copy of his birth certificate, they said the Affidavit of Age was not good enough. HUH... my first thought was are they serious. An affidavit was good enough to get a passprt and good enough for the embassy....HUH

I can be a hot mess when need be , you know really show my azz ; so, I am sending a little history on the conditions during the Biafra War, and documented information on the conditions of the government hospitals and the way in which paperwork was NOT DONE at the time. I am also enclosing copies of my SO's passports from 12 years of age to current, a copy of Nigerian driving license, national id card, the same affidavit of age, copies of visas from 3 European countries, documents listing the criteria for a Nigerian passport (i.e. affidavit of age), 40 pages of history and a 2 page cover letter stating how all of these items should be acceptable in conjunction with the affidavit to verify age .

Now what!!! I'm ready..... CSC make your move

We_Destiny, I don't understand why they are requiring an original birth certificate. What he provided at the interview was enough to get the visa...why not enough for AOS

Because they are NUTS , and they think we can pull a rabbit out of our hat .
The RFE

As evidence you submitted a photocopy of a statutory declaration of age attesting to your bith and parentage, which indicated that the applicant's birth was not registered. However, at this time, this document is not sufficient for immigration purposes.

Demonstrating that a record is not available. Where a record does not exist, the applicant or petitioner must submit an original writen statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist, and indicate whetehr similiar records for the time and place are available.....An applicant or petetioner who has not been able to aquire the neccessary document or statement from the relevant foreign authority may submit evidence that repeated good faith attempts were made to obtain the required document or statement. Howerver, where the Service finds that such document or statements are generally available. it may require that the applicant or petitioner submit the required document.

As such, the applicant MUST submit a certificate of non-availability from the civil authorities of the applicant's birth place. "

I think there on "crack, shooting or smoking something" the letter negates itself (the options contradict). So I called them; and I was even advised to send in the same identical document to reiterate its validity and to highlight the govenment stamp and seal. It was also suggested that I locate info from the internet to back up my documents... HUH...

They have already fast tracked my application to CSC (no interview required) now this crap. I'm just going to assume the person is new and give them a boat load of paper-work to look at. They are just smelling themselves, and I refuse to worry about it.

Dang, girl, fight for your man's AOS! After you kill them with that evidence they better not say it isn't sufficient. Good job on all the supporting evidence.

yeah, you would think the documents to clear the embassy would be sufficient for AOS.....
and removing of conditions.....and citizenship ....geez
I feel you on giving history lessons, had to do that at the embassy level.

We got the same RFE on our AOS, needed original birth certificate....we also used Affidavit of Age...anyway we jumped through thier hoops and they were happy,(his sister back home went and got the BC for us at the place they designated and mailed it to us) once we were at the interview, they tried another curve ball with the fact that he did not have his chicken pox vaccine so we went to one of thier MDs ( he was like 100 years old LOL) who was close by, paid the $105 got the vaccine and went back for our approval!!! They just llike to freak us out !!! You will be fine

Wow..I wonder if this is a common issue. Cuz my hubby has a "Declaration of Age" that was done by his father at a courthouse, and it is a sworn statement with a magistrate stamp on it. Hmmmm... Maybe I should have him try to get something else while he is still there, instead of waiting till we file the AOS. Where should he go?

We have his cousin obtaining another Afidavit of Age. Kings was born during the war and the hospital is no longer there and there was his birth was never registered.


Please..... if there is an actual place to obtain these documents please tell. Wherever it could possibly be we will find someone to get the documents.

Today is dragging I am soooo ready to get off.

If I had not come in late, I would go home early today

It's snowy and icy here, so I figure I might as well be at work. Many employees stayed home today, so it's good for me, less visits and phone calls, I can get some more work done. Well, unless I'm on VJ.

So, Does anyone have great plans for the weekend? I hope to drive up to Yosemite, if the road isn't closed, just to hang out with the deer and other prancing animals.

Chispas sounds very peaceful ....hope you have a nice time.

On Saturday my plans include hanging out with my brides maids and checking out wedding halls, and picking out a shade of fabric for their dresses....

The sad part is I'm kind of looking forward to it ........but not really .

I will see what I can find out for you...I think that it was at a "local" office in Lagos, I will have to ask him. They sent us where to go when we got the RFE It is jsut a blue half sheet of paper, kinda like a card, that says when he was born and who his parents were, nothing at all like ours here...I will see what I can find out though.... ok?

What you are describing is what we had as well, but we had to go get a BC. When they sent us the RFE it said where to go...but when you send the docs back in you send the "RFE request" back as well, I am not sure if I still have it, but I will see if I can get more info from his sister....as to where she went.

Thanks so much...I would really appreciate it. If he can get something before he leaves it would be much better. We haven't even had the interview yet, and I'm already stressing the AOS...!!

The bride-maids will have two dresses one in western fabric (something that flows and sways July wedding) designed in a native style probably a 2 piece for the ceremony and the first set of pictures, and then we will all change into native traditional attire during the reception for the dancing and spraying.


Yeah it is kind of exciting. My wedding dress is being sewn in Ghana and all of our traditional attire is coming from a Nigerian tailor in London.

hmmmmmm....I guess I'm the only fool up at 2:30am.. Where's all the night owls at?

Wow that sounds beautiful, can't wait to see pics. I am also trying to think what to wear for the wedding.
