Full Version: K1 Visa and study / work status

Hello all,

First a brief background: I met my fiance in India in December 2007 and we got engaged before I left. I mailed the K1 fiance visa petition yesterday so now I have joined the "club" smile.gif From researching on this website, it seems like I will have to wait about 6 months to see this process through. She just finished her studies couple months ago and we anticipate that she will have to take a few more courses to validate her degree here in the USA.

What I couldn't find while digging was the rules specific to allowing her to study or work here. When she does arrive here sometime in presumably middle or later 2008, will she be able to study right away ? If not and if we file the AOS, can she study within the waiting period ? If that is also a No, how long does it approximately take for the AOS status to change and she can start studying ? Would she possibly be able to start in the Spring of 2009 semester? We no doubt expect things to be done before the Fall of 2009 semester begins but we're hoping to not have such a big gap between her studies.

Are the rules for working the same ?

Thank you all in advance and I'm glad for the existence of this website! We primarily used the k1 guide on this site to submit all of our application.

Thats a good question! I have been trying to find that out as well. I have emailed a few colleges around here and no one responds. My fiancee is from South Africa and wants to begin studying asap when she gets here. If I could, could I add to this question what she needs to bring with her from south africa to begin studyng? I believe all she would need is a certified copy of her high school diploma, but if any one on here knows, please help me and gujraja. Oh and gujraja welcome to the club!
