I got an RFE in the post the other day, looking for an Affidavit from my darling OH and also 3 from others. JMaster very kindly sent me a copy of the ones that he used, but I'm just wondering if anyone's got any advice of the sort of stuff to include?

Also I have to send in corrections to our I-130 and my OH's G-325A because I made stupid errors on them, and now have to explain with evidence. I feel so dumb - the mistakes were:
1) I put and employment on the wrong line - therefore putting my OH in Ireland when it says in his addresses that he was in the US.
2) I put the date we moved in to our flat as 2007 on the I-130 (incorrect) and 2005 on his G-325A (correct).

Do you guys think it's better to send in new corrected ones with the explaination and evidence, or just the explaination and evidence, which is all they ask for. If I send in a new I-130 and G-325A I have to change other details, since we've both changed jobs since I sent them in.

It's a good thing that we don't want to move till the summer, cos otherwise I'd be kicking myself.

Mine went something along these lines:

Now put a paragraph or two about how you know the individual. Where you first met. When you first met the OH. If you know the family, how often you see each other, etc.

It has been lovely seeing _______ and _______ grow as a couple, and I am happy to attest to the bona fides of their marriage.

Should you have any questions, please do not hesitate to contact me if I may be of any further assistance.

As for sending in a new I-130 and G-325A. Hmm, not sure about that. I'd probably go with just sending in what they asked for particularly if the other options means having to change details in other parts of the I-130.

The instructions for Form I-130 are quite clear what is required in the affidavit. I'll copy it here:

NOTE: In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:
E. Documentation showing joint ownership or property;or
F. A lease showing joint tenancy of a common residence;or
G. Documentation showing co-mingling of financial resources; or
H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
J. Any other relevant documentation to establish that there is an ongoing marital union.

Refer to the underlined requirement. Anything beyond that should be the person's explanation/description of your relationship and marriage, but as you can see is not required.

Thanks for that guys, does anyone have any sage advice about resending the two forms with the mistakes on?

Help would be appreciated. Or could the DoS advise what to do?? I'm reluctant to call the London extortion line, because they have a reputation of not only costing a lot of money, but also not knowing what they're talking about.

My advice, based on absolutely nothing (saving myself), is to send in exactly what they ask for and no more. If what the ask for is confusing, then it's your own judgment call!
