My brother he overstay and I'm going to be UScitizen. I just wondering if I can sponsor my brother and support him to do legal to live in United State? Could you please help me and tell me how. Also, it possible or not? thank you helpsmilie.gif

he over stay about 4 or 5 years now. So, can I do any paperwork for him to live legal in Unitedstate?

he over stay about 4 or 5 years now. So, can I do any paperwork for him to live legal in Unitedstate?


If you are a USC you can sponsor him.

He will have a 10 year ban, and for most countries it should take say 13 years.

So roughly he has 3 years before he would need to leave, wait out his ban by which time your sponsorship should have gone through.

Can he stay here and waiting for do all the paper work? My brother he can't go back to his home town right now. He have to work for support his family. So, do you think have another way to do for support him? thank you Any Idea?

He can stay I guess unless he is picked up and deported, but he still has his 10 year ban to serve, He does not have to return to his home town, just leave the US.

If I am not mistaken, the 10-year bar due to his overstay would be triggered by his departure from the USA. So he wouldn't gain anything staying in the USA longer than a couple of years if the priority dates advanced. Of course, any choice he makes should be at the direction of a qualified immigration attorney, familiar with overstays.

I dont understand this 3 or 10 year ban deal , how is that established? my mother and i arrived in june of 94' on 90 day I-94 and never left, I am now a USC by marriage, can sponsor her or does she need to go back home, what do i do? it is a similar situation as this gentleman!

After so many years why the concern now?

A USC can sponsor a parent and I think not sure can seek a waiver for the ban. Would have to be unusual circumstances to kustify a waiver.
