I also have the same question. How do would you know if your case has been touched. Mine only says your case has been received Feb 15 and is pending.

Assuming you have set up an account with USCIS, when you "Log In"
there is a column called Last Update, it shows the last date someone looked at your application. It's considered a touch when that date changes. At least that is what I have read. The date has only changed once for me.

You guys have been excellent and soooo supportive.

I called USCIS again to try to explain my plight and I got a very rude officer who barely took my name and info and checked the database - of course I wasn't in there yet

Then she just rattled off "you have to give it 30 to 45 working days" ... and when I tried to explain that I was comparing my timeline to a lot of others who filed in the same month, so just said "every case is different - you should call back in 2 or 3 weeks' ... what a B!tch ... As least the last guy I talked to last week was nice enough to say give it a couple of days and we'll be happy to update you if there's any news ...

ANYWAY - so I went ahead and sent a certified and signature confirmation *YES I'M BEING OCD ON PURPOSE* letters to Vermont S.C. and the Chi. Lockbox ... basically it explains my situation and asks for any information they have - maybe that will get someone to dig up my file and at least enter whatever they can ... I got this idea from a sweet VJ member who PM'ed me ...

Fingers still crossed ...

although i read many posts about canceling k-3 visas, i sent I-129F today 26 feb 2008..uscis didn't say anything about that. good luck to me and to all VJ's.. especialy members of this list,which we all hope to be completed by rajee's NOA1 soon.

Yeah - thank GOD it finally is starting to settle down a bit ... I haven't received my NOA yet, but I see this when I check my case online:

"On February 22, 2008, we received this I130 ..." - my case is at VSC ... the question now is, is this some sort of mistake/typo online? Or will my receipt incorrectly show 2/22/08 ... They got it in Chicago back on 1/17 so I'm gonna call USCIS if my NOA doesn't say sometime around 1/17/08...

Anyone else with experience on a really "delayed" date on their case compared to when it was actually received?

From what I've read on the website, everyone seems to have their case showing online with their NOA1 date ..... me too ..... your NOA1 however, has a received date box too. So, I'd wait to see if yours is correct when it arrives.


I have a couple of thoughts as to why the elves at the service centres are inputting our NOA1 dates as the received date ..... the most humourous thought is ..... maybe like in England .... a lot of the people which work in immigration, are illegal immigrants .... I'm sure my country isn't the only one with that particular problem

..... do bear in mind , this is just a thought, and I have no factual evidence to back it up. However, in England, that stuff has been on the news.

But, if it's true ..... it could be another reason why the system appears to be slow for an immigrant visa .... as opposed to the 2 weeks it takes for the family of someone with a working visa

However, I've also noticed that the processing of the I-130 really seems to be speeding up ..... there are October/November/December filers who all got their NOA1's a month before us ...... maybe we all get thrown into a box and done on the same day ..... as and when they have the energy to wade through our photos, letters, emails, DVD's ..... and other various items of relationship evidence which make our packets look huge and over-whelming

Sorry, I'm really wittering now .... see .... this is what happens when the USCIS keeps me away from my Husband ..... I end up inflicting my spew of general chatter and other verbal uselessness on other people
..... and then there's the excessive use of emoticons ..... I'll finish now ..... I've been wanting to use that one for ages.

it does sound weird that they got your application 5 weeks after you sent it.., but of course , we dont know what theyre doing..
it was even weird that mostly january filers got their NOA1 for less than a month, while december filers waited more than a month... guess theyre speeding up the process... but only USCIS has the control now.. we cant even predict now which service center is faster., CSC or VSC..

with fingers crossed, i wish that we will get our approvals for january filers in 3 months or less... i really hope..
ive read how painful and stressing it is for the july, august, september filers... hope we dont need to go thru that..

I have been following the thread but this is my first post. I have some wonderful news: USCIS received my I-129F and sent out the NOA1 the very next day

My timeline:
I sent our I-130 01/24 and received the NOA1 with notice date 02/14 (best valentine's gift ever!)
I sent our I-129F 02/20 and just received the NOA1 with notice date 02/22!!!

My husband is in Tanzania. I found out a few weeks after I left TZ that I am pregnant. 4 months later, I thought he would miss the entire pregnancy and who knows how much else. But maybe there is some hope...

I for some reason feel we may start getting approvals in the coming weeks (as opposed to 6 months) ..... however, please do not quote me .... but ... if we all wish together as a group, it may work ..... power of the mind and all of that

Actually, that's not a bad idea .... why don't we all concentrate on an approval date for March 2008??? .... worth a shot .... just think about it being next month. Stranger things have happened.

I'm going to see my lovely wife at the end of April - if we could be approved by March, I could potentially have her fly back WITH ME!!!!

I just bought my ticket to go to Kathmandu in May so in less than 3 months I will be back with my husband - it has been sooo long and the wait is really getting to me but it's wonderful knowing there will be an end to it, if only temporary and then we will not need to wait nearly as long for our next reunion....

is this statment(pending) for k-3 filers only, what about you guys going the IR-1 CR-1 route? is your case pending or touched? the reason i am asking is to get a clear picture about some VJ'S posting that k-3 canseled.

My Hubby is planning to come out to see me with his 1 week off in the 2nd week of April

Brian&Mel, please let me know if you get through immigration Stateside when you go back for a couple of weeks, as I've been advised not to step foot on US soil until my visa is in my hand (by an immigration lawyer and an immigration official) as they can be quite likely to refuse us entry due to a pending immigration visa on the system.

It all depends on the immigration officer you see when you get off the plane (whether he's in a good mood that day etc .... and whether he feels you're not just going to stay and do an Adjustment Of Status when you get there and stay) .....

I've got so much free time here (currently enrolled as a student with tons of holiday time), and have cancelled the flight I had booked for Easter (I used to book my tickets months in advance and still had an outstanding one) ..... as the consequences of being denied entry are too much of a risk.

As soon as he scans your passport, it will show you have an I-130 in the system .... and are planning to move there.
Being denied entry will be a pain, as you will have to state it on another piece of paperwork we have to fill out for the next step
I don't want to risk further delay of my visa, and it may be treated as a black mark .....

I've got tons of provable and documented ties to England, but I'm still nervous at the thought they may not be enough, especially if the immigration officer didn't have his cup of coffee that morning
You've also got to pay for the return flight home on the next flight they put you onto ...... regardless of the fact you'll be exhausted from your flight to arrive there.

Be prepared to be grilled ..... so take all the paperwork you can get your hands on to prove that you have to go back home .... a return flight won't be enough.

I really appologise that this sounds negative, but I just want to warn you.

There's a ton of postings on here about people getting through, and people getting denied .... it's not a set thing.
Yes, technically you're allowed to visit, but it's proving to the officer that, that's all you're doing, even with an I-130 pending.

If you get through, I may just gather enough confidence to try it too
..... as like all of you, I miss my Husband and best friend terribly. It's so annoying as I have 4 weeks off over Easter.

For your guys information, I've just asked in the I-130 forum if anyone was allowed to enter the USA or if anyone was refused while an I-130 was pending ..... what information they took with them etc.

I thought it was a good idea, as Brian&Mel have really got my head racing now with thoughts that it may be possible to travel there afterall ..... regardless of the advise I've been given by an immigration lawyer and official.

I've got 2 weeks till my Easter holidays, and I'm teetering on the edge of whether to just get my bag packed and go .... but am really nervous about it because of the possible consequences

Good news, guys

Got my NOA1's today for BOTH the I-130 and I-129F ... Receive date is 2/14 for both, though - so I have to call USCIS and sort that out (both were received on 1/17 in Chicago) ... I hope that doesn't cost me a month!!!

Hi Kip and Sarah,

Thanks for the support.

My husband and I have give it a thorough thought and we feel that this is the right thing to do.

Some of the evidence that I am going to bring is my latest bank statement, current pay slip, parking stub from Kuala Lumpur International Airport, car grant on my name, a letter from my employer to Canadian Embassy saying that I am on vacation and I will return to work after the visit (we planned to visit Canada too) and of course my return ticket.

We have heard of people who made it and some don't. I just wish the officer has his/her morning coffee that day.

We are going to be honest if they ever asked about our pending I-130. As we got married on my previous visit and didn't stay to adjust status, I just hope that they will understand my visit is just for a visit and not going to stay. I mean if I am going to stay, I could have done it in December and don't have to waste $800 for another plane ticket and also $355 for the I-130 fee.

Don't worry about you sounding negative as I know what is your concern. We had the same concern earlier on too but then after a thorough thought, we want to give it a try. I hope with my husband standing beside me, they will be nicer to me.

I will keep you posted on the outcome. If you don't hear from me by 1st May, then you should know that I am being held in a room and waiting for the next flight home!

You are both in my prayers .... and I hope so much you will get through without any problems.
Your planned trip has really given us food for thought, and if you get through it will be one more reason towards why I should stop being scared of trying it myself.

Hi - looks like I'm going to bail on the K-3 option/non-option!! Too much ambiguity for me.

Plus I am taking the plunge and moving to my husband's country to wait out the visa. Which means I probably need to use my mother as a co-sponsor, as I don't know if my freelance income will convince anyone of my ability to support him. And I'm sure there are going to be some nightmares when it come to the NVC paperwork fun 'n' games... how to mail in all the checks from there, etc. But luckily I'll have the VJ resources and shortcuts so I am hoping I have all my bases covered before I leave.

Anyway, please switch me up to the CR-1 list. Should we include service center info? Mine is at @ the CSC.

I guess I'll be spending more time on the CR-1/IR-1 forum, but I'll check in this one, too 'cause I'll want to see your progress. Fingers crossed for everyone!

FYI - My "Receive" date is 2/14/08 ... My notice date is 2/22/08 ... I don't know which one we're putting on the table so I thought I'd clarify

I talked to my congressman's office about the fact that I feel like I lost a couple weeks for no reason ... But he stated that he's never seen them work on changing the actual date based on which they work ... He said "if there's a problem with your application please don't hesitate to contact us - that's what we're here for. If there isn't a problem, you can still get the congressman involved, but you run a chance of that actually delaying your process because your application will be pulled out of the pool to be processed by a smaller number of people who handle 'congressional requests' who will then look over your file to see if they can do anything and then put it back into the mix" ... In other words, he kinda dissuaded me from using the congressman to look into this -- and very clearly stated that he would never tell me what to do - he would be open to receive my case but the above was his explanation ... he sounded earnest ...

What do you guys think???? I'm leaning towards leaving things alone - I mean within (about) 1 month of sending my stuff in, I got BOTH NOA1's ... Can't really complain since I never waited the right way for the I-130 to come back lol

You may have missed the posts recently, but there seems to be some confusion as to whether or not the K3 (I-129F) is going to be cancelled. If you look around in the K3 forum, you'll see lots of threads where it's being discussed, some people have already had theirs cancelled administratively .... whatever that means .... it's a shame.
Please read all the info, and put your mind at rest as I'm sure you haven't done anything wrong.

I still haven't filed my I-129F. i was just wondering for the people applying to Indian embassy, what are your thoughts for going with one visa over the other?

it appears it's split about half way. how long will it take if i just stick w/I-130?
