Full Version: anyone have problems getting a California State ID?

My fiancee came to the US on K1, we got married and got our social security within a month. We went to the DMV to get a State ID so that we could open a bank account etc., however the lady at the counter and her supervisor turned down our application saying that the I94 was expiring within 60 days and so they could not issue a state ID.
We explained that my wife entered on a K1 and we were married within the stipulated time, so the I94 expiration date should not really count, but they did not agree. How can we convince them otherwise? Has anyone else faced this problem?

BD/LP = The I-94 card in passport, EAD card, Passport with I-551 stamp, OR Green-card.

Thank you Yu and Dan. You are always so prompt in your replies and very helpful.

So, this means I cannot get a State ID until I at least get my approved Notice of Action on my AOS application which I have not yet submitted. How does one go about opening a bank account or even getting a job then? It seems everyone needs a US government issued photo -ID...

I opened a joint bank account with my husband using my passport, and, as a second means of identification, with my Romanian ID. True that the account is still on the name before marriage (as my passport still says), but that is perfectly ok for me so far, as I can still make banking operations with my credit cards (still on the old name), bank accounts in my country etc. Also, I think it's proof enough for the interview as well, when the time will come.

Depends on the branch. In all honesty I just went into my DMV and applied as if I was an American. No one blinked. I am white, don't have a Canadian accent anymore etc. When I said I didn't have an SSN they photocopied my passport and gave me a DL.

Most US citizen's do not have a US government issued photo IDs, they have state issued IDs in the form of driver's license.

K-1 can get SSN within 76 days after entry, with the SSN the K-1 can get added to spouse's bank accounts, all that is needed for photo ID is foreign passport.

K-1 cannot take a job after I-94 card expires unless they have EAD or Green-card.
