NOA1=20th of July
so after a few phone calls from my fiancé to the USCIS, he receives an email saying we were approved on the 12/12 which we were not aware of
(no email, no update of the status and no NOA2)
he's asked them to send another NOA2 because he never got the first one supposedly sent on the 12/12 and here's what he got by email alert and this is also our current online status:

"Current Status: We mailed you an amended notice.

On January 4, 2008, an amended notice on this case was mailed describing how we will process your case. Please follow any instructions on the notice. If you move before receiving our notice, call customer service. If this I129F PETITION FOR FIANCE(E) is still pending, you will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, call customer service. If this case is still pending, we process each kind of case in the order we receive them. You can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below for current processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."

what does it mean?
i'd like to be sure we're approved because when he called them they didn't even tell him that we were

it sounds like a standard reply which covers a number of situations... doesn't prove you ARE approved, but in my opinion certainly doesn't prove you're NOT, either

I'd just sit tight and see what comes in the mail... and be cautiously confident; you're about due for an approval, and it doesn't sound like an RFE, so you're probably fine wink.gif

Hopefully it is just that they reissued you the NO2A and your case is approved. If they said on the phone what is was, it would make sense. Like STP said, wait and see what shows in the mailbox. Let us know what happens.

here's what we got wednesday:
The status of this service request is: The California Service Center (CSC) no longer has jurisdiction over thispetition. This case was approved and notification was mailed to the addressof record on 12/12/2007 and was not returned by the post office asundeliverable. This case has been forwarded to the National Visa Center on12/28/2007. Please send any further correspondence to the following address:NVC, 32 Rochester Avenue, Portsmouth, NH 03801-2909. Direct any telephonicinquiries to (603) 334-0700. *NOTE: Always include any identifyinginformation about the petition, including full names and dates of birth forpetitioner and beneficiary, receipt numbers and the NVC case number. If youare writing to upgrade a petition also include a copy of your Naturalizationcertificate.

so this clearly means we're approved whereas the one we got today is confusing...
my fiancé is calling monday to make sure we're approved

YAY!!!! Oh I am so happy for you - sounds like they just missed out your NOA2 and you got to the NVC already - will defo be worth giving them a call to see if they still have your petition or if they have even forwarded it on to the Embassy!!!! biggrin.gif

Hello caro06. We got similar situation. Until now, we dont have the date of our NOA2, yet we surprisingly received letter from NVC with our case number last dec 28. And we just confirmed last Dec 31 that our case was forwarded to the Consulate in Manila last Dec 28, 2007.

So I am sure your case was approved and is now with the NVC, or better yet, with your Consulate. good.gif good.gif good.gif good.gif

I know this all sounds good and all but i cant wait to have the confirmation of all that
it was such a hard wait
my fiance should call the visa center tomorrow and i guess we'll know for sure

i have to get ready for the next steps now!

my fiance called the USCIS again to inquire about thi mysterious email he got
some guy told him they were sending us the I-797 form
I told my fiance there's no form I-797 for us

so here's what the I-797 is:
I-797: This is the CIS document with which an alien applies for an H-1B visa at a United States Consulate or Embassy. To apply for H-1B status while in the United States in some other status, the prospective employer of the alien must submit an H-1B petition to CIS. CIS issues an I-797 upon approval of an H-1B petition submitted by the alien's prospective employer. An H-1B alien can be employed only by the employer designated on the I-797. An I-797 permits an H-1B Temporary Worker to stay temporarily in the United States during the validity of the H-1B alien's authorized stay (while maintaining lawful H-1B status). The I-797 specifies the date to which an H-1B alien has authorization to be employed by the employer listed on the I-797. The CIS dictates that the employer should retain the original top portion of the I-797 form, and give the bottom tear-off portion to the employee. To facilitate visa application and travel and re-entry, however, we will give the original top portion to the employee, with the understanding that it will be returned to the International Office as soon as he or she returns to the U.S.

It seems they don't even know what they're talking about!!!

As for the NOA2, he said that they dont have to send it the day it's issued and that they have 30 days to send it so he toldmy fiance to check in another 30 days!!!!
and not to call before!!!!

That is really dumb... so the guy you spoke to gave you some BS about a worker's visa?! I'd call back and ask to speak to their manager!!!

my fiancé called back and talked to a girl who had a brain and she confirmed we were approved! biggrin.gif
she also said that no one got alert emails because their computer system was not working at the time
this lady supposes that the amendment email was sent because they're sending a 2nd NOA2 as my fiancé requested

USCIS is a madhouse
you can call 10 times, talk to 10 different people and get 10 different answers!
