I am filing for k1 via consulate located in india. Since my fiance's initial interview back in May 2006 he has been on AP for the last 19 months and 5 security checks. This last check is still pending since Oct 2007. I was told he has a very common name. Okay! but this is ridiculous. How do they resolve this problem. Each security check takes an avg of 3-4 months. I am 38 yrs of age and he is 39 yrs of age, both of Indian origin .

In Oct 2007 the consulate was already to give visa, they told him to send passport asap. Two weeks went by, and I found out via DOS that a 5th security check was requested by consulate.

This has gone beyond my patience. Can anyone advise. Much appreciated.

I can't help u with the waiting or give u an easy answer but I can explain a little. My fiance also was told his visa was ready and after flying to Turkey and waiting over a week was told he was sent for additional checks.
Prior to issuing the visa the embassy must run a CLASS check (dont' know exactly what all databases it checks) and if there is any sort of a hit they must send the case back to DOS for additional checks.
Thus although he may be clear this week, if new information arises tomorrow containing a name similar to his he will be sent back for more checks.
I was told by DOS this is not uncommon and can happen, as in your case, multiple times.
There is nothing that can be done, there is no point at which they say, OK we have done enough checks, nothing. So long as a name similiar to his comes up his visa will not be issued.

I don't see anything that you can do, your hands are tied. If they deny it is one thing, you can take steps to appeal. But when they are just checking, you are stuck. sad.gif

All we can do is offer our heartfelt thoughts and prayers that they will complete the checking and approve the visa ASAP. rose.gif

Thats Frustrating as hell..... I am now frustrated in a year... i can imagine your life... I just want to start living my life as normal married couple do.... just tired of living alone in helll

Your situation sounds so similar to mine. I still don't understand how the consulate resolves this issue b/c the hit name will always be on their list. So how will my fiance overcome this or this their way of saying it's a dead end deal.
I am waiting for nothing at the end. If you find out anything about how they resolve this please let me know.
