If these cases were in Nebraska and their last logical processing date was February 10, 2007, why are these cases still pending?

After reading the waivers in the I-751, could have beaten my wife (not very hard, maybe with a feather), gotten a divorce, she could apply for her green card instantly, received it, and we could have gotten married again. Not sure about me dying and coming back to life again. But all this would be over by now.
Gulskjegg
Hey that's not a bad plan. According to current feminist dogma, you probably wouldn't even need to break out the feather. None of us stands anything to lose, USCIS already has us over a barrel. It cant get any worse.
NickD
Well, I certainly is not my plan, it's the USCIS telling us how to bring an immigrant into this country via marriage and how to get out of it.

"My conditional residence is based on my marriage to a U.S. citizen or permanent resident, but I am unable to file a joint petition and I request a waiver because: (Check one.)

My spouse is deceased.

I am a conditional resident spouse who entered a marriage in good faith, and during the marriage I was battered by or was the subject of extreme cruelty by my U.S. citizen or permanent resident spouse or parent.

I entered into the marriage in good faith but the marriage was terminated through divorce/annulment.

The termination of my status and removal from the United States would result in an extreme hardship."

And here we thought by checking "My conditional residence is based on my marriage to a U.S. citizen or permanent resident, and we are filing this petition together."

That our petition would fly through when in fact we had to wait near the expiration date of our spouse's green card, then wait another year and a half or so. When in fact, the second means would permit instant application. We should have thought this over first.

Isn't Friday reserved for discussing your weekend plan with your co-workers, and Monday for discussing with your co-workers what you did on your weekend. Tuesday has a slow start to get into the mood for work, but what we cannot accomplish today, we will do tomorrow. Ha, didn't get much done today, but we will give it hell tomorrow. Wednesday is the day to get work done, Thursday, have to slow down for Friday.

Ha, told my wife about the 3,000 job openings at the USCIS, she was actually quite interested and a pure whiz at office type work and fluent in three different languages, a natural for the USCIS. But was not interested in relocating in Nebraska, maybe that is the problem, but LOL, she wouldn't have to work very hard if at all there.

Side benefits would be processing her own I-751, N-400, and completing a I-130 for her son, ha, I told her to go for it. She comes home beat at night from her present job, has to run from the minute she gets there until quitting time. And she will get off Veterans, King's, Columbus, Christmas and New Year's eve plus all the other holidays, and if doesn't feel like working, can always call in sick.

How do I know this stuff? Worked for civil service for a short time, way too much politics and boredom for me and felt guilty taking my paycheck home. devil.gif

You should expect USCIS staff to be:
• Professional.
• Courteous.
• Knowledgeable.

USCIS also expects certain things from you. You should:
• Treat USCIS employees with courtesy.
• Read and follow the instructions on your application.
• Be prepared at each step of the process.

Making a Customer Service Complaint

USCIS realizes that in some offices it takes a long time to process applications. We are
currently working to reduce processing times. If you have a question about processing,
please visit www.uscis.gov or call Customer Service at 1-800-375-5283 (TTY: 1-800-767-
1833).

If you have a complaint about the way that a USCIS employee treated you, you should
speak with that employee’s direct supervisor if possible. If your complaint is not handled to
your satisfaction, or if you could not speak with the supervisor, you may write a letter to the
director of your USCIS District Office. Filing a complaint will not affect your eligibility for
naturalization.

In all the approved cases, don't people get their email notice in the morning? If you didn't see anything at about 9, I doubt they get anything done for the rest of the day. I get bored easily so I can see why they could get bored all the time reading the materials for the same type of petitions again and again. But I don't sympathize so much with them because they get paid well and good benefits/vacation etc. God I hope I get those in my current job.

QUOTE(NickD @ Apr 9 2008, 07:01 AM) *
For those that received notification they will be getting there new green cards soon, was there any request from the USCIS for new data? Or are they working with proof that was submitted over 13 months ago?

And if they are working with proof that is already 13 months old, what changed since then? So why the long wait? Ironically, the N-400 wanted passport photos that were taken within 30 days of the application, those green card photos are already over a year old.

Suppose no logic in trying to make any sense out of this, but certainly an additional amount of useless stress in making employment and traveling plans that we all are sharing.

Heard about some I-751's that were immediately rejected upon receipt due to lack of evidence, that tells that someone opened the envelop and looked on what was inside immediately and certainly grabbed the check and deposited that instantly. If all the evidence was there, why can't they okay the green card instead of wasting all that time in storing and retrieving it? And in our case, transferring all these applications to yet another service center?

I was not asked to send in any kind of update. I decided that I just wanted them to find my case and update it. That way I could prove that its still there. I am convinced that the found our huge stack of applications after I sent that update. How else do you figure that 4 days after they recieved my update, a ton of us started getting action on our applications. I sent in our new tax returns, or refinanced mortgage details, and a letter asking about the timeframe and the possibility of sending my case to the CSC. Seriously, 4 days after they recieved it, we all started getting updates. It could be a coincidence, but after waiting for over a year and finally seeing action, I dont see how it could be. Thats just me. Go ahead and update your case and see if the remaining ones get worked.

Hi,

My green card has just been ordered and I should receive it in 30 days. I have been waiting since Feb 07. I got an email last week saying my case had been transferred to another office. I hope the rest of you guys don't have to wait too much longer smile.gif

Hi,

My green card has just been ordered and I should receive it in 30 days. I have been waiting since Feb 07. I got an email last week saying my case had been transferred to another office. I hope the rest of you guys don't have to wait too much longer smile.gif

Congrats! You're one of the few from March that I've seen. 3 days after us though, I hope this means our is coming!! Would have been nice to get the email today though since Tom is going downtown to get his passport stamped on Monday (he could have avoided that maybe.)

That's great winterpassing, welcome to the USA!

We received two identical I-797c's today one for my wife, the other for my daughter stating that our case has been transferred to California.

California Service Center
2nd Floor
24000 Avila Road
Laguna Niguel, CA 92607-0111

Gave the link for case status, most of us have that and checking the processing dates, as we are well ahead of the current processing date, we now have the right to call customer service for a case update. Wonder if customer service knows we have that right?

Was hoping it was green cards instead.

Our applications have to be here, someplace, can you spot them?

Great! Congrats to people who got their GCs. I called the USCIS customer service number today. The lady who took my called had a bad attitude! I had my husband call them and sent an service inquiry. The lady he got was really nice and start chitchatting with him, huh. Guess ladies should all have their husbands call.

Hi ,
i just received a letter from USCIS that my case is transfered to CSC ...update me in list plz ...

Thanx kicking.gif
Gulskjegg
I just called the USCIS customer service line. They said as of April 10, 2008 production of my wife's 10 year green card has been ordered and that it will arrive in 30 days. We filed in March of 2007. I will keep everyone updated if there is more progress, but as of now we are preparing to hit warp speed on "Operation: Get The Hell Outta America".
drawbridgep
I just got an RFE sad.gif But hey! I got something from the USCIS!!! Guess I'll flood them with evidence now. At least things are moving. How's that for looking on the brightside?

When can I check my status online or log in, I tried both of them and I couldn't,
By the way I never received an emial or mail telling me that my case was transfered , however when i put my case number online, it said it was transfered to another office, and the last touched date was 04/03, that mean my case was transfered right?? i did not receive email or letter but the status as i said said it was transfered, I am starting to worry now!!!!!

I just got letters today for my son and I transferring to California so hopefully we'll hear something soon !

We received an email on 4/03, file last touched and transferred on 4/02. No letter in the post received though.....and nothing else.... yet unsure.gif

I registered just so I could share with everyone that my case was approved today!! good.gif

Current Status: Card production ordered.

On April 11, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

Thank God it's over, been waiting since Feb. 07 at NE. I guess the transfer to CSC was a sign of good news to come.

God bless America!

Ummmm. Everybody is getting a letter with the information of the transfer... But I haven't gotten one yet sad.gif
kearinne
I just got my transfer to CSC letter mid last week.. Oddly enough it's dated "March 27th 2008" Hmm took em 2 weeks to get to my mailbox? Here's hoping an approval follows close behind.
Gulskjegg
We got no letter, and no email. But my wife checks her status online, and it showed up there. On the 27th of this month, we had planned to send off her passport for a one year extension stamp. But, since her card was ordered to be produced on the 10th of this month, there is a chance we will get the actual 10 year green card before the 27th.

If you are like us and have gotten no emails and no letters, I suggest checking your status online or calling the information line.
NickD
A letter or an I-797C that is an official notice of action? The one year extension notice received was an official document that we used to get my wife back into this country and had some value. This Notice of Action was just to inform us that our case was transferred from Nebraska to California and how to check the case status on-line.

Also states:

"If the service center is within processing time for your particular application or petition, USCIS cannot provide an update on your case. If the service center is outside of processing time for your particular application or petition, please call Customer Service at 1-800-375-5283 to request an update."

Checking our case status on-line, we get this as I am sure the rest of you have received.

"Receipt Number: LIN07129xxxxx

Application Type: CRI89, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED

Current Status: This case is now pending at the office to which it was transferred.

The CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register."

Unlike the old one from Nebraska, this new notice no longer has our processing date. But the recently received Notice of Transfer has a Notice Date of March 30, 2008, but a Receipt date March 27, 2007. So do we go buy the Notice or the Receipt date? Do they honor our application dates or are we the new kids on the block? The CSC Processing Dates uses the term, "Processing Timeframe" that adds a 3rd parameter as to precisely what date they are talking about.

But at least we know which USCIS SC our application is at.

I am happy for those that are happy, and sad for those who are sad.

Not leaving any other stones unturned, sent more proof to CA this morning, 2007 tax returns, property tax bill, AKC registration of our new German Shepherd Dog, and some Christmas photos.

With a minor reminder that our application is already over a year old and thought they would appreciate an update on our proof.

And that we are still here and still waiting, that we didn't die or leave the country or something like that.

I got my approval notice on Friday the 11th only to receive a second notice this morning stating that production of my new card had been ordered on the 12th. blink.gif LOL What, am I getting TWO green cards suddenly? Did they like my application so much they decided to approve me twice? Oh well, at least it's all over and done with. Just...funny, I guess.

Letter in the mail on April 12, 2008, that the application was transferred to CA service center! Notice date was March 27, 2008.

E-mail notice saying it was transferred was received on April 01, 2008 (wthout saying where to). Was touched again April 2. At least the letter offers a location.

Here's the catch: On the letter, under case type it says "CRI89 Approved removal of conditions (I89)."

Do the other letters received regarding the transfer say the same? Does the "Approved" part really mean anything? Please share.

Thanks!
p.s. Online status is still "Current Status: This case is now pending at the office to which it was transferred."
Gulskjegg
Well, at face value, you filed your I-751 a few weeks before us. You also had the bad luck of having it go to Nebraska. That is the bad news. The good news is your claim has been transferred, most likely to California. From looking at the responses, we can see that there are a good many people here that, once their claim was transferred, got an approval letter shortly after. My wife and I included in that list.

So, long story short, I would wait till the end of the month then call USCIS. Plus I would check your status online twice a day. I suspect you will be getting an approval notice very soon.
NickD
Our E-mail states "CRI89, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED"

Our I-797C Transfer Notice states "CRI89 APPROVED REMOVAL OF CONDITIONS (I89)."

But I can't share with your what this means, never had a course in USCIS Languages and my crystal ball has a crack in it.

Only thing I know for sure, my wife's and daughter's PRC's say they are expired. They are crystal clear on that point.

Anybody here speak USCIS?

A bunch of us TSC transferees got that letter with the word "approved" on the top too. It doesn't mean you are approved.

and scroll down to tweety's post #38 where she first reports getting said letter.

Cassie, thanks for the lead - I thought that was too good to be true. But one can always hope whistling.gif

I'll have to call the 800-line anyways. On the original NOA, there was a typo in my last name. At fingerprinting, I asked the lady to correct it - which she did on their system. The NOA I just received still has the same error. How anyone manages to make a mistake in the removal of conditions, which should be linked to the original AOS paperwork, is beyond me mad.gif mad.gif My 2-yr card did not have any errors. I am aftraid if they send a card with the wrong spelling, that it will take them another year to correct that.....After all, this is the USCIS!

Read that http://www.visajourney.com/forums/index.ph...08764&st=30 thread, reads more like the mass media so-called news stations that give 1% facts and 99% speculation, but by the so-called experts. If APPROVED means anything, Nebraska cashed our checks and didn't return the I-751 applications.

The only conclusive thing about this I-797C is that our cases are officially in Vermont or California and at least, hopefully, Nebraska or Texas did not lose them. Key word is processing, are they being processed or sitting on a new shelve in another state? It's still confusing exactly what your application date is as compared to the advertised processing date and are they really using FIFO! (First in, First Out).

Another key word is patience, I can be patient if it doesn't make any difference, but having a valid green card makes a huge difference as to what one can and cannot do.

Ha, someone at the USCIS wrote that trivial civic quiz for US citizenship, but did they read presumption of innocence from the 5th, 6th and 14th amendments? The I-751 states you are guilty until you prove yourself innocent with the main penalty directed at the US citizen spouse. Kind of contradicts these amendments.

What is the most important right granted to US citizens? The right to vote, so if this is so important why are elections held on a Tuesday and not even postponed due to tornado or severe winter blizzards when everything else is closed down? With the electoral system, candidates are already selected in primaries even before our state gets a chance to vote, so why vote? And with winner take all in the big states, your couple of delegates in your smaller states don't make a bit of difference. Most important thing to us is to stop being blackmailed by a foreign country to keep a valid USA required foreign passport. Only congress has the right to declare war? Was I forced to fight in an illegal war? No sense in taking that to the supreme court when only five of the nine executive appointed judges have to rule against that.

But what disturbs me most about this I-751 process is they are not treating us as a family, but isolating my wife and daughter, my signature was at the bottom of that I-751 application, and in any business transaction, it's only the bottom signature that counts. But I am treated as an outsider, hey, this is my family you are talking about!!!! And what about my rights?

Well we just got back from the Cleveland office and she would only stamp his passport for 90 days because according to her computer he was approved on April 12th (a Saturday????) and card production was ordered. I have not gotten an email on that, nor does it say that online. So she better be right, if we have to go back down there in July for another stamp, I'm going to be pissed.
