I can already smell my Greencard... it's just around the corner... I know it!

Interesting "break" in the processing dates though, there were quite a few people "skipped". but I guess they work randomly anyway... hm.

Well, the guy did not really make sense today. He asked why I was there, I said because both my GC and Ext.letter are expiring next week. He nodded, I was certainly not the only one there with this problem. I then mentioned I will travel soon and he immediately wanted to see details. He took my itenerary (and just that.) and vanished to the back for about 5 minutes. Then he came back, and I said that I have another trip planned in August. Then he said "oh, doesn't matter, we will stamp for 1 year anyway". wacko.gif
So no I don't think you have to have any travel plans. I bet you'll get your stamp anyway.

Yep, I am among the "a few people" they skipped. So I ran to the mail box to see if I got a letter for interview. Nope, I just got a letter from the ombudsman's office telling me my case status is still pending and since it is within normal processing time, they can't help me. Nothing I can do now other than wait.

Yes, Peter T. Theorectically speaking I only need the temp I-551 stamp in my passport. But experience tells me I'd better carry everything just in case. Only God knows what ball they are gonna throw at me next time.

Is the stamp you mentioned a I-551 stamp, in your passport or on a I-94(?) form? Then you wouldn't need to carry the expired PRC and the extension letter with you anymore, the stamp replaces both of them.



The officer who put the stamp in my passport specifically said that I would need the expired green card and the 1yr expired extension letter in order to get through immigration. Maybe you do, maybe you don't. personally I'm not carrying my passport around with me, but I will take it, my GC and my letter when I go to England next month. Although I'm still hoping for my 10yr GC by then.

am i mistaken... im sure the time for processing the I751 went up, when I last checked it was December 2006 and now its july 2006... whats going on? I called the helpdesk today and was told that the only reason I would need the stamp is if Im going to leave the US.. does that sounds right?

In our state, (WI), getting your drivers license renewed, keeping your job, and enrolling in a university, and perhaps even prevention from getting deported all depend on having a valid and current green card. They look at an expired green card just like an expired drivers license and say, what in the hell is an extension! Never heard of such a thing, either you are here legally or not! Just like an expired visa!


Several states are cracking down on illegals because they claim they are costing the state a small fortune and either you are here legally or not. It makes sense from their point of view and has caused me problems, even with the extension, first thing I had to do was to find somebody with authority with a degree of intelligence to get my wife's drivers license renewed that is aware of federal law. And spending two hours with my wife's employer legal department proving that we have done everything we can with proof that her case was applied for and is in the processing stage.

We have city, township, county, state, and federal laws to abide for, and many times the left hand doesn't know what the right hand is doing, the states do not have the authority to grant residency nor citizenship, but can deport you or at least make your life miserable in taking counter legal action.

I am getting tired of having to make excuses for the slowness of the USCIS, when they say 90 days maximum it should be 90 days! Either that or change the form. They never asked for additional proof, didn't ask for anything, try and explain that to people of lower authority!

Getting quite a file build up with letters from our governor, congressman, senator, and Ombudsman, perhaps with even more excuses.

Did get a letter from the USCIS regarding the N-400 application with a receipt for payment, and should be notified within 225 days from our local field office to arrange an interview. I hope they looked over that 1/2" stack of paper, printed on both sides of the additional proof they required.

Suppose I can send another letter to Ombudsman and ask them why they thing our case is in Nebraska, even at that, they never explained why Nebraska changed the dates from February 10, 2007 to July 05, 2006. And it is not first come first served.

Yeah, I think we're better off travelling with EVERYTHING. The guy I saw yesterday said I can leave everything at home because Greencard and Ext.Letter are expired anyway, so they won't do me any good. He said all I need is the stamp in my passport. Well smile.gif
And he also put 'PENDING I_751" in huge letters above the stamp, too. I doubt flight attendants know what that means?! Probably doesn't matter, since the stamp is there.

Forgot to mention by the way, he stamped for 1 year starting yesterday and ending on 4/6/09 (instead of 4/22 which is when my extension letter expires). Not that it makes a huge difference.. blink.gif

Our extension notice (I-797C) is worthless without the expired permanent resident card, and in logical progression, that I-555 stamp that extends the extension notice would be worthless without that extension notice and the expired permanent resident card. If we have to go in for the stamp, not leaving there without bringing out all three. And if the I-751's are not processed during that extra one year of delay time, what then? You have nothing.

I saw the form for getting a replacement green card, but nothing on there about replacing an expired green card, and really the only salvation from getting deported if everything else fails.

Wrote to Ombudsman again this morning, not happy with their reply, with a question, just like a drivers' license is issued, why can't they give people like us the full ten year card, and if they are not happy with the I-751 proof, then they have reason to pull that card, just like if you break the law with a valid drivers' license. Doesn't our US Constitution presume innocence until proven guilty? Not the other way around.

Also pointed out that I as a US born citizen and a veteran of a foreign is making the inquiry and expect a reply made to me, not to my wife. This is my family I am trying to protect.

Anybody else from January 2007 got approved, God I hope they go all the way to June2007 so they can approve mine, So it looks like they started with January applications that were received from Nebraska, Hopefully they keep approving them fast, I keep checking my case online in uSCIS website like 15 times a day!!!! The last touch was 04/03/08 so probably they won't come back to it soon, I don't think we were sent all the same time,

Same here. I check my online status and this forum like every hour. My NOA was 1/25/07. I didn't see any change today. Kinda disappointed. Good luck with yours.

I also decided to take a new approach. I sent more information to add to my file today with a letter reminding them that I have not had my case looked at since 3/31/2007. I sent my 2007 tax returns and our new home loan which we got after I had sent the original application. Just trying to stir the pot. Ill let you know if anything happens here.

I didn't have any travel plans when I got my extension stamp. The USCIS officer asked me, however, after my passport was stamped and before it was handed to me if I was planning to travel. I answered No, but added that I need the stamp to get into some ITAR facilities of my company.

I went to the office close to the end of my written proof of residentship (actually I went the first business day afterwards), to make it more difficult for them to deny the stamp with the explanation that the card might come before the extension letter expired. I had read through the memorandum at least twice (check the memo attached to this thread), and I was prepared for their questions, because the memo mentioned the need for job and travel. It doesn't mention documents needed to show the need, but, if asked, you should answer something along the lines that you are looking at another job or at some travel plans - you should actually look on a job or a travel plan for that, but you don't have to go through with it. Be self-confident when speaking to them but not aggressive and ask for a supervisor if they deny a 12 months stamp. They have delayed the process, and you shouldn't be forced to get to their district office for another year.

For those that received notification they will be getting there new green cards soon, was there any request from the USCIS for new data? Or are they working with proof that was submitted over 13 months ago?

And if they are working with proof that is already 13 months old, what changed since then? So why the long wait? Ironically, the N-400 wanted passport photos that were taken within 30 days of the application, those green card photos are already over a year old.

Suppose no logic in trying to make any sense out of this, but certainly an additional amount of useless stress in making employment and traveling plans that we all are sharing.

Heard about some I-751's that were immediately rejected upon receipt due to lack of evidence, that tells that someone opened the envelop and looked on what was inside immediately and certainly grabbed the check and deposited that instantly. If all the evidence was there, why can't they okay the green card instead of wasting all that time in storing and retrieving it? And in our case, transferring all these applications to yet another service center?

I got the email this morning!!! YAY Card production ordered after 15 months.

My case was one of those transferred to CSC last week. Timeline is below.

I was expecting an interview since the evidence was skimpy at best (just a birth certificate for a child and marriage license) but done with Nebraska forever, finally.

If there's a next time I won't be living in Nebraska's jurisdiction.

That's great news, surasak_oregon, also love to see these dates coming closer to ours. Doesn't Oregon border California? Someone should inform the USCIS about that. And do people actually marry immigrants for the sole purpose of bring them into this country and have a baby too? A baby should be more than ample evidence.

Yes, it has always irritated me that I live so close to a much faster service center yet got stuck in Nebraska hell from start until finish (K1 until now). We're planning on moving soon so when it comes time for naturalization there won't be any more Nebraska crap.

Odd thing was that my stepdaughter's visa application went straight to CA and was approved in about 2 months from time of application.

Right about now I'm thinking we'll be tagged for an interview. Not that it's a problem, we've been together since 2003, it's just the hassle and annoyance of the whole process. A day off from work and all that again. We sent plenty of evidence. I guess we're just one of the unlucky ones..... sad.gif

Maybe tomorrow? You really are ahead of many of these people who got approved. But I don't think USCIS is processing them in the order of NOA date though. I am also worried an interview may be ahead. Nowadays they sent out appointment letters without the option to change the date. That is why I have been checking my mailbox every day in case we missed it while we are travelling. Going to Vegas this weekend, and then Going to Europe for two weeks next Month. I will be really annoyed if an Interview letter arrived then. That was what happened for the biometrics appointment letter while we were travelling abroad. The guard at the ACS center almost didn't let me in because I missed the appointment by a day so I have to show him our airline ticket stubs. Maybe we should just quit taking vacations for the whole 3 years while waiting for USCIS to process our case!!!! Good job, USCIS.

Your not alone, I haven't heard anything either. No transfer email, nothing. I called today to try to find out where my file is. I got the most unpleasant person on the line that absolutely refused to let me talk to an IO. Told me I should be patient. wacko.gif

My NOA is Jan.31, 2007 (Nebraska) and my case was last touched on March 11, 2007- Over a year ago!!!!!!!!!!!!!!!!!!!!!!!!!! crying.gif

I am also unlucky and my case was not moved to CSC . I have no luck with USCIS. I gave up calling them after last unpleasant conversation I had.

This is where the USCIS has put us between the frying pan and the fire by not specifying which service center our cases are at.

If you are in the Nebraska district, but them posting that date of July 05, 2007, twice now, it can be assumed that your case is still there, and since Jan.31, 2007 is well after that date, you have no recourse but to wait according to some USCIS officers and even what they say on their answer line. It is very well possible your case file was lost, but can't do anything about it until the last minute.

I am also unlucky and my case was not moved to CSC . I have no luck with USCIS. I gave up calling them after last unpleasant conversation I had.

IMHO, you should not fret too much, because if you haven't been already, you all are being or will shortly be transferred to CSC.

I know most of you have not been following what happened when TSC began transferring all of its old, early 2007 I-751s to VSC in February, but it's worth noting that there were a bunch of the mass TSC-VSC people who did not get the "received and pending" email until 9 days after the first bunch got that email. That is, a lot of us got the email on 2/13, but a number of people didn't get it until 2/22. Then there were a small handful of people -- generally, the most recently filed of the old petitions, from June 2007 -- who did not even get that email until last week.

I am pretty sure this is what's happening here. Indeed, the person with longest-pending petition of the transferees was among those who didn't receive the "received and pending" email until the second blast was sent 9 days later (and that person has since been approved).

I should note that there were a couple of the very oldest petitions that were never transferred. I don't know what happened to those folks.

I must admit that most of the times custoemr service at USCIS was very professional although they did not have any information for me.

Once I was told that things happen and cases get lost. She said it is a human error......... I wish I could tell this line to me boss at work smile.gif

I am always nice on the phone because I do hope they record these conversations, but my last call was nothing but nice. Guy was ignorant and hung up on me.

I have to say, all my dealings over the phone with the USCIS have been more than pleasant. I was shocked when a lady asked me how my day was going the last time and of course I responded in kind. Of course they always didn't have the information I was looking for.

I am trying not to be paranoid. But because USCIS has not been straightforward with us this whole time, how do we know if one's case is really TRANSFERRED rather than "LOST" in the shuffle? I got the transfer email but nothing has happened to my case so far (NOA 1/25/07). Bringing copies of original application is almost impossible for me because I didn't make copies. I have both the congresswoman and sentor's offices sent inquiries. The Ombudsman rejected my complaint. Thinking of calling the customer service again today.

Because you have the experience of a whole group of people who have already gone through a transfer to lean on. It took them a while to confirm that yes indeed, we were transferred to VSC by email, then a while longer to get paper confirmation in the mail, and then about a month after that before we saw transferrees getting approvals. give some time to let the dust clear and see what happens.

Believe me, I would much rather be in your shoes as far as where I'm being transferred goes. CSC is notoriously fast and loose with their approvals.

On Friday, April 11, 2008, at 9:30 to 10:30 AM EDT, certain USCIS web-based systems will be taken out of service for maintenance
so probably on monday we will know for sure if our cases were transferred to CAL or VSC since they are going to pdate the information and probably rearrange those I-751 by date the way it is supposed to be first come-first go

haha, that shows how desperate they made us. To me, maintenance means software update. Nothing more. They just need to change a field in their database to mark all of us APPROVED!

They can't do that because an immigration officer has to see the case first then approve it, I don't know how they order the card, if they check a box in their system or they go to another system,
By the way did anyone get approved to day I mean it should be around 11:00 Am now in california they should have approved some applications, Also another question does anyone know their hours like are they 8 to 5 or 7 to 4 or....

In addition, you will face severe penalties provided by law and may be subject to criminal prosecution." Plus you are making life stressful for the rest of us.

If the USCIS should remove your spouse for any other reason, do they replace that spouse with one of equal or higher value? Mine is priceless, hope yours is too.

Have you watched the old Andie MacDowell movie "Green Card"? It is actually a comedy about a French cook married an American woman for the green card. It is really funny. Somehow I got the impression in the early 90s, they interviewed you once and gave you a 10 year card after that. The I-751 was put in place later to prevent fake green card marriages. The waiver really means if the foreign spouse entered the marriage in good faith but the marriage failed somehow, then the spouse is still entitled to a green card. I know one unfortunate case in which the husband beat up his foreign wife. The police was called in. They got divorced. The woman filed I-751 with the waiver and got her green card. I don't think you guys belong to this category from what you have told us whistling.gif Anyways, they could have the foreign spouse deported by immigration officers. I agree with your previous posting that the I-751 is almost the most simple type of petition they have to look at. If people are showing you a birth certificate of their kid, what other evidence do they need!!!
