so 13 months, just like Bertrand's petition filed 12/06, approved 1/08. So did in fact all of the contacting really speed up the petition? hmmm

Well congrats anyway, now you can be less stressed out.

Yes, I do think that based on the numerous calls I made for the past 40 days kinda fixed the problem.
Something tells me that this approval is not coincidently
No,I wasn't stressed out, I was and I'm still mad that it took so long to process this stinking application while for other took only 3-4 months .This was not fair to me nor to you guys and it's up to you to do something about it

I'm done here , I'm sure a few of you would like to see me gone !

Congrats. I thought we can't contact them unless we are out of the processing window, and now that it's back to July of 06, we are not technically out of the processing window. We did contact the congressman and it got us no where so far.

Yes ,YOU ARE out of the processing window :

Q : When can I expect USCIS to process my case?

USCIS processes applications in the order they are received by application type. Due to the significant increase in the number of applications filed, processing times have been affected. As a result, average processing times for certain application types filed after June 1, 2007, may become longer. For example:

Naturalization applications may take approximately 16-18 months to process;
Family-based adjustment of status applications may take 10-12 months; and
Immigrant petitions for relatives and workers may take 9-10 months.

Sure some very long posts here loaded with quotes with only a two word comment added, makes it difficult to follow a dialog. Also what you see is not what you get when I tried to post that table on the number of I-751 applications. According to the USCIS, that had 360 less applications in 2007 than 2006 with about 140K applications of this type per year. These zillions of application increases before the fee increase apparently are not I-751 applications.

Was told by my senators office that neither Texas nor Nebraska are not doing I-751's anymore, Texas was shifted to Vermont, and Nebraska to California, so why are we looking at the Nebraska and Texas processing dates.

When I call the USCIS, they tell me not to pester them until I check on their processing dates and if those dates are before our application date, don't pester them, our case status still shows our application is in Nebraska with that infamous July 05. 2006 date, but if it is in California with an August 19, 2007 date, our application must have been lost.

From the USCIS site:

"Will I Get a Work Permit?

As a legal permanent resident, you should have received a permanent resident card. This card will continue to prove that you have a right to live and work in the United States permanently. If you file your USCIS Form I-751 (Petition to Remove the Conditions on Residence) on time, the USCIS will extend your conditional resident status for up to 12 months while your Form I-751 petition is under review."

That is enough to blow one's brain, on one hand they are saying your expired PRC card is valid, on the other hand, saying it is expired.

"On March 30, 2007, we received this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our NEBRASKA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."

The only e-mail I have received was acknowledgment that we signed up for the automated e-mail updates.

I plugged in different numbers on the least significant digit on my wife's application number and did get different statements than above just to check if they are recognizing her specific application number, so I know they have that in their system and apparently it is unique. Can carry a far more effective communication when I talk to my wall, least I get an echo.

Did you contact the Ombudsman ?
Citizenship and Immigration Services Ombudsman
Department of Homeland Security
Attention : Case Problems
Mail stop 1225
Washington, D.C. 20528-1225

The processing time for I-751 according to USCIS website should be between 8 to 12 month.
Did you wait more then that ? IF YES ..then you are out of the processing window and you should call them every week until they send a "Service Request " for your case .That 's one of the tings I did too
danutuke
Hello,

I-751 Filled on January 31, 2007 (Nebraska).

I did placed service request on January 31, 2008, but I did not hear from USCIS since then.
I placed another service request on March 18 (today).

I am giving up calling USCIS every few days. Each time I call there I get different answers. One girl even told me that there is a possibility that my case was lost smile.gif She says that human error happens and I should just wait.

The sad thing is that I was supposed to take my GMAT yesterday, but they require to bring green card (mine is expired now). I could use my passport, but since my passport lists maiden name, they told me they can not allow me to take this exam!!!!!! After I screamed on the phone for half hour, they said that I might be admitted to exam if I bring the following:

ID, passport, expired extension letter, green card and marriage certificate, and then testing facility MIGHT (or might not) allow me to take the test.

Basically, I have to pay US$250 exam fee again, go to the testing center and pray that 5 documents proving my identity would be enough.

I understand that GMAT has crazy rules, but if my I-751 would be processed in a timely manner- I would have a green card by now and fell like a human again. wacko.gif wacko.gif wacko.gif

Best regard to All,

danutuke

Now that is useful information, iansig40, thank you.

I did a web search on your address and found this site:

Says something about doing an online form, a DHS Form 7001, see if I can find that and get it off.

Updating the list to show my I-551 stamp.
Didn't get a lot of information. The officer didn't have specific details and just told me that Nebraska was processing applications from December 06.
I didn't bother explaining that the website was set at July 06 or that it had gone back in time from Feb 07.
No point talking to the monkey when the organ grinder isn't around. And i'm not too sure there is an organ grinder.

We are technically not at the 12 month mark until Sunday, but we will put this form etc. in the mail to Ombudsman on Monday. Thanks.

I'm done here , I'm sure a few of you would like to see me gone !

that is what I'm saying to everyone do something together rather than just complaining onthis thread.

I always think it's funny when someone says you should be doing something other than posting on a thread and yet, here they are, on the thread.

I'm saying about the collective action,For that we all need to come together at one task.I'm not saying we should not be on this thread but we should on this thread to use this thread to unite and do something together.

I-751 Filled on January 31, 2007 (Nebraska). (...)
Basically, I have to pay US$250 exam fee again, go to the testing center and pray that 5 documents proving my identity would be enough.

danutuke, that sucks. I'm sorry to hear that the disorganization or laziness at the USCIS has such consequences for you. I wish you Good Luck at the testing center - if they are only slightly more customer friendly there than at the USCIS, you shouldn't have a problem with proving who you are and which status you have.

You wrote once that you had received only a 2-month stamp into your passport - is that stamp still valid? Could you write your dates into this thread, please, that other readers can compare your dates with theirs?

Exactly what are you recommending? We are sharing tips together and all of our information is confidential, are you suggesting we put all of our forms in one envelop and sending those in together?

On another board, they are giving this e-mail address

1. USCIS online status
2. Make InfoPass appointment
3. Contact USCIS national customer service
I have done 1 and 3. Waiting to do 2 on 3/28. I am going to send out that form today.

No ,the e-mail is not working ,don't use it .
You can't put all the application on one single big envelope and send it over ....this is supposed to be private and confidential.
What you can do is ..have everyone send a letter separately and by the time they will get bombed with lets say 100 or 200 letters describing the same issue maybe somebody out there will address the problem

They did say that was optional, ha, like checking your case status on line. What disturbed me was to allow an additional 14 days so your letter will be screened, several days to review it, then another 45 days before they will notify your claim to the respective USCIS office. Can also try calling them, but it seems like an infopass appointment would be the best deal before the time runs out.

Some updates about calling the USCIS customer service today. I called and they told me now that since NSC's current processing date for I-751 is July 2006, they can't file a service request for me because my receipt date (1/25/07) is still within the NORMAL processing window. They also have no information on NSC stopping processing I-751 or what is gonna happen to the I-751. Now I am glad that I have my ombudsman letter ready to mail.

Just call back again. If you get lucky, they are going to give you a service request. I called yesterday and they said they are processing Sept 2007 so I am definitely out of processing window so she gave me a service request. Who knows where she get the Sept from. It doesn't even make sense, just happy I got what I needed. I am sending out the DHS-7001 form today.... ready to me mailed out.

Yes ,YOU ARE out of the processing window :
http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

Q : When can I expect USCIS to process my case?

USCIS processes applications in the order they are received by application type. Due to the significant increase in the number of applications filed, processing times have been affected. As a result, average processing times for certain application types filed after June 1, 2007, may become longer. For example:

Naturalization applications may take approximately 16-18 months to process;
Family-based adjustment of status applications may take 10-12 months; and
Immigrant petitions for relatives and workers may take 9-10 months.

You've been waiting more then 12 months .
The processing date on USCIS website is pointless

Wasn't going to send in the DHS-7001, but must have dreamed about it, woke up at 4:00AM this morning and armed with a new toner cartridge in my laser printer and a new roller in my copier, filled out the form and provided all the supporting documentation, also did a cover letter, wife thought it was a bit strong, but accustomed to being strong when things go bad. Also made duplicate copies of everything and prepared a folder, the letter is on it's way. See what happens, leave no stone unturned and wonder if this country is going to go bankrupt before my wife and daughter get their new cards.

We also elected to rehire our immigration attorney firm, the best in the country for the N-400, if we run into more problems, they will answer for us and know how to talk to the USCIS. We used them initially and everything went smooth, they must have been busy with the I-751 and told me I should be able to handle it. The USCIS does treat immigration attorneys differently than individuals, already learned that. We already agreed on a fixed fee.

Checking case status on line:

"It was reported to us that your IP address or internet gateway has been locked out for a select period of time. This is due to an unusually high rate of use. In order to avoid this issue please take this opportunity to create a Customer account (single applicant) or a Representative account (representing many individuals, such as lawyers, charitable groups, or corporations). Each account allows you to generate a Portfolio of receipt numbers. Building a portfolio containing your receipt number(s) eliminates your need to manually enter the receipt number and extract each case status. You will automatically be emailed changes to each case as updates occur. This email notification will occur within 12 to 24 hours of any progress made for every receipt number contained in your portfolio. There is no lockout feature associated with your portfolio and there is no wasted time on your part checking a receipt number where no advancement has been made."

Anyone else experiencing this statement when trying to check their case status? At least it is something different.

I called the (dis)service line yesterday. Managed to get through to an immigration officer - who was useless. Surprise, surprise, my application is still within processing time, and they cannot submit a service request! Was advised to send a letter to NSC - like they will respond to a letter when they cannot review applications filed over a year ago!

Today, sent off a substantial & strongly worded petition to the senator's office, closing with a complaint that our elected officials seem to be either unaware or uninterested in how USCIS conducts its business. Will see how that works out - although I am not holding my breath. This weekend will assemble package for the ombudsman's office. Thanks to all for posting that information.

I called a few weeks ago, was told I was outside the window (NOA 1 was 1/25/07) and they tried to put a service request through but were having difficulties with the computer. I was put on to an immigration officer who just told me to make an infopass appointment when my extension expires. Yep, very helpful.
I have an infopass scheduled for April 2nd in Chicago.

What a location for a field office, 101 West Congress Parkway Chicago, IL 60605, right smack in downtown Chicago. Is there parking there or do you have to pay 18 bucks an hour and get your car back loaded with new dents? Wasn't down in Chicago for a year now, last time all that road construction, took seven hours to go 20 miles.

Do you have to bring a current foreign passport just to get it stamped, do they keep their appointments or make you wait several hours in a jammed room with folding chairs?

Milwaukee office is on the outer edge of their downtown, not quite as bad and can find free parking two blocks away, the St. Paul office is not located in St. Paul but rather 15 miles south at 2901 Metro Drive, Suite 100 Bloomington, MN 55425, but very close to the Mall of America where they have a zillion shoe stores, my favorite kind of shopping. But still is a 400 mile round trip for us.

Seems like a waste just to get a stamp, gas alone will cost 70 bucks, plus with us, three days of lost pay. For a government that takes 70% of our wages either directly or indirectly in taxes, doesn't sound like very good service. And how come they get Veterans day off and I don't? Is it asking too much that only veterans get Veterans day off?

Yes, your wife will have to bring a valid passport so she can get the stamp .
My passport was just about to expire so I got a new one and then I scheduled my infopass and got the stamp on the passport .Two weeks later I got my GC approved

@Nick,

re: Chicago office... I think I paid $12 for parking, just a block South on State street (that's the intersection to the East, right?) there is a garage w/valet parking. The office has security, and folding chairs smile.gif but my wait was actually pretty short. I was there first thing in the morning, a small crowd had gathered to be let in when they opened but they all went their seperate ways once inside.
Bring a print out of your appointment confirmation and the valid passport for your wife. I would also bring copies of the I751 petition and NOAs and Bio.Appointment letter. Can never have too much, who knows what they'll ask for.

What is your actual local office though? You plug in your ZIP code when scheduling the infopass, so I don't think that you can pick where to go?! GOod luck anyway. I'll be back at the Chicago office in a couple of weeks myself.

@Iansig, congrats on your approval! smile.gif The squeeky wheel gets the oil... biggrin.gif biggrin.gif It paid off for you. Let us know how quick you actually receive the card.

Have you created a portfolio? I think that is what they're asking you to do (instead of checking case# without logging in).

No, I think he tried a combination of other numbers .After viewing three or four other cases you get something like that if you keep continuing

I have learned to bring my full brief case loaded with all the original documents and copies I can leave so the interviewer can quickly check the copies are exactly as the originals. That included full hi res color copies of every page of my wife's and daughter's passports.

Also full color copies of their permanent resident cards, but don't try that at any professional copying place, they claim it's illegal to copy this document, but yet the USCIS wants it. So I invested in a high quality scanner and color printer and did it myself.

Another problem is getting certified copies, no such thing, was able to get that done at my register of deeds, but they don't do that anymore, claim budget cuts, but just see a bunch of people sitting around there doing nothing. Said I would be happy to pay, we can't do that.

Same with the SS office where I went personally to get cards for my wife and daughter, no way in hell was I going to send an original document to that cost me a thousand bucks with court costs and a professional translation. Already had copies made of it, and showed it, not even allowing the person behind the counter to touch the pages, I turned them over one at a time wearing latex gloves, teasing about that. That was a 80 mile round trip for me, go in and pull a number and sit and wait until that number is called, took half a day for a two minute conference.

At least when I go to a store and make a 89 cent purchase, they say thank you for shopping at X-Mart, but go in with a huge fortune to pay my property tax bill, never get a thanks. So fed up with government agencies and don't they realize it is us that is paying their paychecks?

Did have one wasted trip to the SS office, didn't check my calendar, but knew it wasn't Veterans day, was Mickey Mouse's birthday or something like that, and they were closed.

@Nick,

re: Chicago office...

Thank you !
Sure ...I willl let you know as soon as I get my GC. It says 30 days but hopefully this time will be less however ....it's USCIS so you never know .Can't wait to be done with them !!!!!!!!! crying.gif

Another mistake on my part. I didn't think to make a copy of my I-751 before I mailed it out. Other than that, my letter to the ombudsman's office will be on its way today. I seriously hope USCIS still have all the files for I-751 I sent them. Keep my fingers crossed.

Good luck !

Thanks for this, letters on the way.

Your Mistake is very small Compared to what I did.I send My condtional GC with Package hoping that they will approve it in few weeks and I dont need it anyway(that is what my attorney said).and now when I went to Social security office today and wanted to remove wording"Not Valid for work" on my SS card they asked for green cardTO My surprise at social Security office they dont Recognize your extention letter,They said it is just a receipt not a proof of Permanent resident.I wonder If one GOverment agency dont Recognizes other's document,How my employer will approve it.So Basically I dont have no proof that Ican work in US.

My sympathy... I can totally understand your frustration. Maybe by showing the I-551 stamp in your passport, they will let you remove those words on your SSN card. Otherwise, you will have trouble with employers since they ask for either (1) PRC or (2) SSN and Driver's license and you don't have either. The DMV has changed my name before by putting an extra space in my name because they insisted the spelling on the US visa (mistakenly spelled) is official instead of my "original" name on my country's passport. It took my 5 years to correct this mistake. From then on, I always had a USED name though involuntarily. So trust me, I know your frustration. Wish you the best in solving this problem.
NickD
With the I-765 application approved, wife and daughter got a "Valid for work only with DHS Authorization", stamped on their SS cards. Got that removed the instant they received their PRC's with a trip to my nearest SS office. Major concern of SS is to get that 15% of your gross wages between you and your employer and since they are getting that, haven't heard a word from them.

Our DMV wouldn't recognize that one year extension and refused to renew my wife's drivers license, daughter is okay yet until the end of August 2008. They didn't pull their licenses, just wouldn't renew them. I got on the horn with our governor and again making excuses for the USCIS for their delays, and showed all records to the head of the DMV that we did everything we could, the I-751 was sent precisely 90 days before their PRC's expired. The same with my wife's employer.

How do you answer this simple question? Allow 90 days before your PRC expires to allow time for the USCIS to process your case and instead of sending you a new PRC, they send you that extension notice, why did they send you that extension notice instead of a new card?

The extension notice gives no reason why it was sent instead of your card, so am asked if we falsified information on this application causing further investigation. Not to my knowledge, but also bring in my I-130, her I-485 and G-325A and we go over line by line on the I-751, and backed up with that I-797C, "Welcome to the United States of America". And I bring in a printed off statement from the USCIS where my wife underwent a background check for her I-485. What else can I do? I do not know why she didn't receive her new card in the timeframe given by the USCIS, and I show out a print out of her case status and even give them a link so they can check it out on their own computer. I bring in the stamped biometrics appointment to show we kept our appointment and it was completed.

Am told they do not understand this, I can only reply, I do not understand it either. But they let it go, but keep us informed as to the progress, what progress? On the processing dates, only advance a couple of days than goes backwards seven months. Oh, and I also brought in my canceled check and fee schedule to the USCIS and show that they accepted and cashed that.

And then to top everything off, the USCIS expects you to maintain a valid current passport from a foreign country while expecting that person to give full allegiance to the USA. Did it ever occur to them that a foreign country may not want to grant a passport to one of their former citizens that left their country?

I am kind of use to this stuff, as a veteran of a foreign war, applied for benefits after my honorable discharge served with distinction and was told I was NOT eligible because all of my records were burnt in a fire in St. Louis. Said no problem, I have all of my original records and brought those in, was told, they would not recognize those. I had to pay for my own college, and was really teed off about that. Thirty some years later I get a letter out of the clear blue sky with an apology and am now fully covered with VA benefits, ask about a refund for my college, oh, we can't do that, but you are fully eligible for all benefits now. It's a one way street with our government, have to learn how to deal with that.
