Good news! I got my I-551 stamp today with 12-months duration.

I had made an Infopass appointment (reason: speak to an immigration officer) and brought with me the following documents:
- Infopass notice
- old Green Card
- NOA
- passport, valid for more than a year
As supporting documents, I had brought:
- print-out of memorandum CRextensn120203.pdf (attached to this thread and also to pinned thread on top of thread list)
- biometrics notice
- my company's badge
- table of NSC processing time w/ I-751 in jul06

I arrived 15min before my Infopass time, went thru security, and was called up 5min after the Infopass time. I gave the immigration officer my Green Card and said that I was a permanent resident. Then I gave him the NOA and told him that my proof of residence had just expired yesterday. Last I gave him my passport and asked for a 12-months extension of my proof of residence.

The immigration officer looked on the documents and entered something on his keyboard, presumingly checking my status online. He didn't ask any question at first, but disappeared into a back corner with my passport to stamp it. I thought, well, I get a stamp, but I cannot give him my spiel now that I want a 12-months duration and not some 2-months or so. When he came back, he wrote by hand into the fields of the stamp, and I saw that I got an extension until Mar 2009 - relieve! He tucked my old Green Card to a print-out and kept it. He then asked if I wanted to travel, which I denied, and I pointed out that I need the stamp instead to enter facilities of my company that are closed to foreigners without escort and where they don't know me personally. He didn't ask for any proof of that and didn't ask any further question. I thanked him and left with my passport with the stamp.

If I would have been offered a stamp with only 2 or 6 months duration, I was prepared to argue for a 12-months stamp, according to the memorandum. I would have asked if the memorandum had been superseded and, if not, to speak to a supervisor, to get a 12-months duration. I intended to use my company's badge as indication that I indeed need proof of my legal residence. I wanted to show the table of current NSC processing times, from which I would expect another 6.5 month wait for my 10-year Green Card, leading to a repeated visit if given a stamp with 6 month duration or less. I tried to start out the conversation friendly, but I was tense, and my voice may have sounded demanding at the beginning. At the end, I was happy.


Yay!! That's great. Had you heard of St. Paul only giving out 2 or 6 month stamps? I've only heard that for Chicago so far.

I had a InfoPass appointment today trying to figure it out why is talking so long with these I-751 but the guy there was totally hopeless ,basically the same information's calling 1-800-375-5283. No help whatsoever ,not that I expected any !
The only consolation if I can call it this way is that here in Cleveland, you get an extension for one year in your passport .
Next step will be to write a letter to Nebraska and maybe I will get some fresh lies
I'm just sick and tired of this BS

When did your letter expire? And did they ask for any proof of anything (traveling, etc.)??

My letter expired on Feb 27,2008
No, the guy didn't want to see any travel arrangements think he was just happy to get rid of me after all I said to him. If you just want the stamp ,you will get it !
If you want any updates for your case then......you waste your time ,they are hopeless

I hadn't heard anything in beforehand about the standard practice in the Twin Cities (the website says St. Paul, but the office is actually in Bloomington). The USCIS is a federal authority, however, and I expect the various local office to follow the same federal law. The quoted memorandum, for example, is directed to ALL directors, regional, service centers etc. I don't understand why Chicago can have a deviating practice and wouldn't got called on it. If I would be denied in Chicago, I would contact my senator and asked why the people of Illinois get treated worse than those of Minnesota. I was prepared to contact my senator to complain, if they would have ignored the memorandum and not given me sufficient explanation why.

Did anybody write any letter to Nebraska and ask for any information’s about processing time for I-751 and what's the story behind these transfers from NSC to CSC that started in June 2006 ?
I'm just about ready to send one .Maybe we should all start pounding them with a letter like that demanding an explanation

Well, I'm going to find out about Chicago's stamping system in about 1 month. I think it was me who started the myth about the 60 days in Chicago, because that's what I was told at my infopass appointment.
In fact, that's why I did not get a stamp then, since my extension was still valid for 90 days, which would have made a 60 day stamp useless.
@ PeterT, good thing you got yours, this seems to work in other parts of the country wink.gif

I'll let you guys know.

Can it go any worst then it is right now ??????
Are you going to be ok with this situation lets say one year from now when your case will still show PENDING ?
Tell me how do you calculate the processing time for your case when USCIS website is going back and forward on a regular base ?????
I'm afraid that's the worst thing we can do ,just complain here about their lousy job and wait and wait for a miracle to happen .Good luck to you but don't be surprised if next year you are still waiting for the GC

I think I sent them at least 12-15 e-mails ,did I get a replay ? Hell NO !!!!
I did more then that, went to the immigration center in Cleveland with an InfoPass asking for the status of my case .Did I get any explanation ? NO !!!!
Like I said before if that's what you think you can do to have your application processed then ....your’re all set for a long ,long wait

Hey, maybe I'm in for a long wait but it's not like I expect my petition not to be processed... Again, and I've said this before. I'm not treating this as if it's such a desaster because it simply is none. When I had to wait 13 months to see my husband because I-130(K3) took so long at the time, THAT hurt. This? Just annoying, but not (yet) more annoying than getting my vehicle sticker renewed... I'm not "ok" with it but I can definately live with it. Less stressful to think that way wink.gif

It's difficult for some people to get to their local offices (living 2+ hours away etc.) in order to get the stamp in the passport. There have also been issues with people and their jobs (the Sears one most recently). We live 20 min from the Cleveland office, but my husband will have to miss some of work to go down there yet again to get his stamp. Something that could be avoided if they just gave out a two year letter to begin with. It's kind of frustrating, and I feel very badly for the people that have to drive far. (Is the 60 day stamp a myth, I was sure that did really happen to someone in Chicago).

Well....I guess as long as you 're not to much affected by this delay in processing your application I don't see why you would care about these letters sent to USCIS (Nebraska)

Two weeks ago I received 2 month stamp at Chicago office. IT IS NOT A MYTH!!!!!!!!!!!!!!!

Immigration officer gave me a hard time and wanted a proof that I need to travel. I work in sales and my headquarters is in Japan. I have been delaying my trip there for few months because I thought my green card is coming.....I do not believe in it anymore.

He said for the employment purposes, potential employer can contact immigration directly and verify blush.gif

Anyway, CHICAGO DID STAMP MY PASSPORT FOR 2 MONTHS ONLY.

Next time I go there, I will not leave until they give me 1 year stamp.

@ Tammi, yes a two year extension letter would be a great idea! I also do not live 'right around the corner' from the Chicago office, and the $ 12 parking, time in traffic, missing work etc. is not anything I look forward to. It is an inconvenience!

I think I will also take the memo posted on www.uscis.gov next time I go and try for a longer extension in Chicago. I have two trips planned, one immediately in April and one in August. I would have to go back twice between the trips to be 60-day-extended two times through the August trip... wacko.gif

You are right, I am not worried. Just annoyed. And I think that I personally can't do anything other than wait for my turn. I simply don't care enough to drive myself (or others) crazy over it.

I'm fine with a NOA as long as I get my case processed.
I would love to show those SOB that I'm here for someone that I married and not for wasting my time with this stupid GC which I consider very humiliating based on what you have to go through just get one (Processing time ,documents ...$$$$$ and all the other crap they wanted from the first moment I started and until now)

One more for the "stuck in Nebraska" list. Getting the stamp in St. Louis was painless. Every time we have been there the office is not very busy. We arrived about 25 minutes before our scheduled appointment time and were out with the stamp before the appointment time listed on the infopass. They didn't ask if it was needed for travel or employment, they just took the passport and expired green card and in a few minutes we had the passport with an I-551 good for a year.

  • Moved from Chicago to LA Dec 19, 2007
  • Submitted Change of Address Dec 28, 2007
  • Finally got response from NSC that new address on file Feb 15, 2008
  • NOA expired Feb 25, 2008... in limbo now
  • Made Infopass Appt in LA District Office March 7, 2008 at 9:30am
  • Brought in NOA, Passport, Expired GC, print screen of NSC Processing Times
  • Waited 2 hours for my turn wacko.gif
  • Officer requested evidence of Emergency Travel needed to give me an I-551 stamp *** which is an Evidence of Residency Stamp that allows Employment and proves Legal Residency
  • Officer checked my case online and wondered why it hadn't transferred to CSC, meaning my file is still stuck in that big pile in NSC
  • Officer suggested I call the 800 number and somehow have them transfer my file from NSC to CSC (right! like I could get that done on the phone). Then she decided to give it a try and...
  • Officer called "someone" in NSC, "someone" actually picked up the phone for her
  • On the side, she told me people on the 1-800 line are outsourced and they usually just want to close your request and typically don't solve anything, she said to get anything as a real inquiry, we need to elevate to speak to an actual "Immigration officer" on the phone. Meaning, use the "let me talk to the next tier" strategy.
  • When "someone" at NSC talked to her, they said: "Yes her file is still here, but no need for a special request for Transfer. They have a big pile -undetermined filing dates- that they are transferring to CSC soon b/c they can't get to them in NSC and need the help from CSC to process". She said that basically any expired file not sitting in front of an officer at the moment would be sent to CSC for processing.
  • Officer then told me to keep waiting for my I-751 approval
  • Then she showed some compassion and took my passport and went in to get a request for an I-551 stamp. (She did NOT KEEP my GC)
  • I-551 stamp valid until March 6, 2009
  • Officer, when asked, suggested I hold off on applying for citizenship until my I-751 gets approved. Allegedly, having an open application on file only will delay the processing of a N-400

Congrats on getting the stamp. So what was your evidence of travel that you showed? I don't get why they need that, when it may also be needed for work.


Not true what she said about delaying the process of N-400 though. Just this week someone from my local office passed their interview and test, and they applied in November.

When she asked if my travel was an emergency, and I said it wasn't, and I had no evidence of any kind, I just wanted to go see my family. She then just moved on to the subject of my transfer from Nebraska to California, she didn't dwell on it.
Once she figured how backed up they were in NSC, without me asking for it again, she just decided to give me the stamp. So I have no idea what they say is "evidence" for emergency travel. I think it just depends on the officer you get, like everything else, it's just a matter of getting lucky!

Yeah exactly, no consistency! Well that is good news for you at least. We will be driving to Canada so it's not like we will have plane tickets, just a hotel confirmation, which technically anyone could make and cancel (well you could cancel flight tickets too but not without a fine).

You're being a simpleton (as are others who are simply brushing this delay off as 'no big deal').

This removal of conditions process is a Federal validation of whether or not the Federal government considers our marriages as being valid marriages in terms of Federal immigration law. If the petition isn't approved does it make any sense to go out and buy a house, buy a new car, etc. if there's uncertainly over whether the conditions will be removed? What happens if we go out to buy a house and subsequently the USCIS denies the petition?

People's lives are on hold until the petition is approved. No approval = no more legal right to remain in the United States. That's certainly more annoying than simply getting your vehicle's tags renewed.

It certainly is a potential disaster much more than denying the K1/K3 because of the fact that even if our spouse is already here there is no guarantee until that approval notice arrives that our lives can go on together in this country.

I don't think it's too much to ask that the government perform a service that was PAID for over a year ago in a timely manner. My stepdaughter's petition was approved in 2 months. Why is it taking 13 months (thus far) just to approve my wife's?

One: I am not a man.
Two: I am rapidly closing in on a year waiting for my 10 year green card. I choose not to weep and gnash my teeth about it, I have more important things to worry about, like the health of my family.

'ello Illinois! I really didn't think we'd be in one of these beaurocratic messes once again! ok ... a little advice please ...

I'm having surgery in a couple of weeks (bit of the nasties) and really need to get back to Europe in June becuase mum has had cancer surgery too and, whilst not an emergency she really could do with seeing me .. as I could do with seeing my kids.

Obviously there won't be a nice 10 yr green card arriving before then so .. when should I start trying to move those proverbial mountains to get the stamp?

On the bright side .. March 13th I can send in application for naturalization!!

Hi everybody, found this site by typing in "July 05 2006" Nebraska Service Center I-751. I was perfectly content after a terrible divorce to just raise my three remaining children that I had full custody of, try that in the divorce courts today. Eight years went by until I met the woman beyond my wildest dreams, but she wasn't the girl next door like the first one. She is from Venezuela and was an executive assistant to a very well know American Corporation. We saw each other for about 18 months before I asked her to marry me. For some strange reason, I was also the man of her dreams.

Her company used one of the top US immigration services that I checked on, contacted them as to how to get her here. She came with her then 14 year old daughter with a I-94, we got married, it's not only me that loves her, my entire family loves her. I spared no expense, besides the fees, the medical, and all of my wife's and daughter's documentation had to be professionally translated by a certified translator, that cost a couple of bucks. We were married in Oct 04, had problems trying to find a NSCIS certified doctor to get a reasonable appointment, but did find one 300 miles away, that also cost a couple of bucks.

Things are different in Venezuela than here, wife had error in her birth certificates, previous marriage certificates, divorce that were done by sloppy clerks in her country. All these had to be taken to their courts with a notari averaging from $500-$1000 per document to have them corrected before being translated. Heck, it's only money. I am a very well organized person, we wanted everything to be 100% legal, although I heard on the news that Cubans floating into Florida were granted permanent residence without this expense. Ha, teased my wife about that to come into this country.

My own birth certificate was butchered by the State of Illinois when they switched over to a computerized system, can't they hire people that can read and type? But that only cost me ten bucks with about three months of going back and forth, you name it and things went wrong.

We submitted our applications and I was really glad I hired an attorney, I am college educated, hold 22 US patents, but those questions on the forms twisted my brain in late Dec 04. We went in for our interview in St. Paul in Jun 05, had a 2 inch stack of papers all organized, hundreds of photos of our dating and large wedding reception, and my wife and daughter received their CONDITIONAL permanent resident card Jun 27, 2005.

I fell off my chair when we were told we would have to do the I-751 90 days before Jun 27, 2007 after all this madness and expense, wrote down Mar 27, 2007 in big red letters and hung that on my refrigerator. Contacted my attorney, he said I could send that off myself with essentially the same information for the initial. But also could send verification that I couldn't before, thanks to the American Patriot Act. Banks wouldn't allow me to add my wife until she had that PRC and a SS card, she could not get her drivers license in WI until she had that card, very strict in my state.

In reading and rereading the I-751, never saw so many loopholes in my life with this form, can see reason for it as in 1986 when all these limits on immigration quotas were imposed by congress, the only way people could come here was by marriage and apparently the system was abused. While we may live in one country, we also live in 50 states with 50 different sets of rules for even such things as getting married. Had to bring a stack of information just to get a marriage license. As a veteran of a foreign war, also kind of object to being treated as a criminal that has to prove my innocence to the NSCIS, well, also kind of like the IRS if you know what I mean. See all of your are posting charts, here is mine.

03/27/2007 I-751 with all supporting documentation sent overnight express.
03/29/2007 Fee check was cashed
04/09/2007 I-797c received with a one year extensions and biometric appointment
05/01/2007 Trip to Milwaukee for biometrics
05/01/2007 to present, nothing.

Problems since then? Well the very first problem is that my wife needs a valid passport, but can't get one from the USA as a permanent resident, Chevaz changed the front cover of the Venezuelan passport obsoleting hers and these new passport books could only be purchased from their blackmarket for 900 bucks apiece, and that is in USD. We got this done in Chicago, she was treated rather rudely, but we kept our cool, and I had to bring US cash.

Next problem was with her employer, with her background in the medical field, she was hired instantly, but when her PRC expired, I had to spend over two hours with their legal department trying to explain an undated one year extension notice. Came home and printed a bunch of stuff off the NSCIS web, and it was finally accepted. My wife is an angel, she knew the expense I was going through, I didn't mind this in the least, hey, this is the woman of my dreams, and she still is, but she felt guilty that I should be supporting her daughter as well. Heck, it was a package deal.

Next problem was my wife's drivers license was expiring, our DMV never saw an extension notice and refused to issue her a new license. While I can keep my patience in dealing with the Venezuelan government, still very much a part of our lives, I blew my stack at the DMV and called my governor, he was more understanding, and my wife did get her license.

New problem now is we are getting very close to Jun 27, 2007 and again fell off my chair to read the current processing dates of July 05, 2006? My senator did sent an inquiry to Nebraska, but that was four months ago, not sure if that did any good or bad.

Did I marry my wife just to bring her into this country? Hey, if we have to, I am willing to move to any country that would accept my wife and myself, she comes first in my life.

Our daughter? She is well over 18 now, she didn't tell us, but already talked to an army recruiter, hey, instant USA citizenship, but he promised her, she wouldn't be sent to Iraq. But two of her girlfriends did join and are already in Iraq after a six week MP training course in Texas. I shake my head at this, sending young tiny little girls to defend us, I am a big tough guy, sending young girls that can't even open a jar of pickles is beyond my comprehension.

At the advice of my attorney, doing the N-400 now, same old stuff, putting more wear and tear on my copy machine with the same exact information I have already sent in twice. Background checks on the I-751? Only form that applies to us according to the NSCIS website is the I-485 and that is past history!

Heard about a guy that made an infopass appointment 2 months before his extension date expired, they told him to come back 30 days before that date. For us, it's a long 400 mile round trip day, plus they never keep their appointment schedules, last time we sat in the waiting room three hours before being called in with that long drive back ahead of us.

Would be nice if the NSCIS would post useful myth free information on how to deal with their extended delay times. Also find it hard to swallow that 3 million applicants applied before the rate increase, first off, we are way ahead of that date, second, don't people apply when their date is due? Nothing makes sense with this government agency.

You seem to be stuck in the same rut as the rest of us - the NSC has essentially stopped working on I-751 applications. You can contact your congressperson about it, but I wouldn't hold my breath for a speedy processing at NSC.

Even though my Greencard extension letter is also about to expire we know that a pending petition that was submitted in a timely fashion and accepted by USCIS, will extend cond.residency status for however long they need to process.
As long as the "conditions" are still the same (married, same spouse, not a felon...) there is no reason to belive anyone will not be approved. You were approved the first time around so if your life together has not changed what is there to worry about?

I don't think it's too much to ask that the government perform a service that was PAID for over a year ago in a timely manner. My stepdaughter's petition was approved in 2 months. Why is it taking 13 months (thus far) just to approve my wife's?

I think the denial of the K3 (I130) would have been a bigger disaster for me!

And, I don't think it's "too much to ask" either but I just don't worry myself sick about it. I am still legally living in the US, working, paying my taxes, and travelling abroad if I feel like it.
I do have to make sure my paperwork is up to date, watch what they're doing (or not doing) and I will have to go through the inconvenience again of travelling to the local office to get my stamp (and really, I only do that because I plan on travelling. If no travel plans in your future, you don't need to get the stamp even).

Do I find this lengthy process ridiculous? Yes.
Do I wish they would process swiftly? Yes.
Do I think the whole world needs to be shaken up and informed about a slow-moving public service office (like that's new...)? Nope, I don't.

My only worry (seems like people are trying to get out of me that I worry about this) is that when travelling abroad after the expired extension date, that I run into airline personnel that is unfamiliar with an expired greencard but valid stamp in the passport. But I'll find out how that goes, soon.
