Because he has to go through the process just like the rest of us -- no special treatment for him! -- and if you would take a peek in the Canadian forum you would realize that along the way he has provided a lot of valuable information for us fellow Can/Am couples. Perhaps you may want to dial back on the hostility.

It's just business as usual at NSC...they were doing the exact same thing 3 years ago when we filed our I-130. We filed in January of 2004, then about May or June the new filers immediately got transfers to CSC and we didn't get transfered until September. And as far as filing the N-400 to speed up the I-751, that is pure BULL$HIT!! If that is what's really happening, they really have their heads up their arses...

Again, I don't find it OK that after 1 year of waiting I'm still waiting for a miracle to happen while others are going through this process in a matter of few months ?

And yes ,I'm hostile to affirmations like "we are not so important to USCIS because we're already here " that BS!!!!
I paid the money like everyone else and their slogan is "first come first served” but that's another BS so ....you see my point and my frustration? I hope you do.

I recall having the same problem with my I-129 Application ,same lousy job from Nebraska .
I'm wondering how the hell they managed to get a such a good job where nothing is required from them

I haven't said anything in a while......but I am so sick of waiting. I am becoming obsessed with checking the USCIS website. I like you also feel that they need to process application first come first serve.

There is no excuse they could give me that would make me feel better about this whole situation....I just want my GC!!!!!!!!!

I would be the first to admit that it isn't fair, as I am part of a group from TSC that have been waiting the same amount of time like you all here dealing with Nebraska. Hey, the TSC Losers finally got transferred out of Texas to Vermont and the first thing we heard was "oh crap that's not fair to us" from those waiting in Vermont -- which is completely understandable. There is unfairness all around, but is that really a new thing?

But taking your frustrations out on Zyggy, who made a pretty good point (although it sucks to hear it), isn't going to make things better, or make you feel better. Just a thought.

No man ,I'm not picking on anyone here ,I'm just mad that these AS*****S from Nebraska are playing games with us thinking that we can take all their crap ...AND GET PAID FOR THAT .
I have contacted my Congressman and he promised to look into my case however, I'm more interested to know why older applications were dumped completely while the newer once were transferred to California and approved within 3 to 4 months .What makes some of up better then other? Is it just another scam that they put on our plate to force us to throw another $400 or $500 filling for N400 ?

I got a letter today about the service request from December 14. Standard letter. Useless and a waste of time.

"Service records show your case is currently waiting to be reviewed by an officer. You will receive a decision or notice of other action once your case is adjudicated."

I am going to speak one last time on this issue because it appears that some of you don't want to hear the truth about what is going on... and that is at your option...

Lily... I have always been fair to you and have tried to provide you with insight on the events in your past in order to help you and others who may have found themselves in your stuation. I find you continued vitriol towards me to be extremely dissapointing and counterproductive. I thought we had moved beyond this childishness.

It is growing number of people like you and iansig who increasingly don't want to hear the truth about what is happening on the inside that has cause me to post less and less here and to share my knowledge and perspective with those who have the desire to learn the reasns for what is going on with their journeyat other places. The fact of the matter is that there is a priority order on how and which petitions are processed and which times based on the differing needs of the service. The fact of that matter is that I-751's are one of the lowest priority petitions, especially at Nebraska which processes a lot of what are considered high priority petitions such as employment petitions and asylum petitions.

It is also a fact that I-751's used to take in excess of two to three years to process until very recently. When I first started my journey, it used to be common knowledge that filing an N-400 was the only way to expedite a I-751 since granting of citizenship is a rather high priority for the service.

What we're going through is a reorganization on how petitions are processed. At the begining of our journey, petitions were adjudicated on a entirely geographic based system. All petitions were processed at a center based on where you lived. In the past 18 months or so, the service has been slowly moving toward a system where centain service centers process certain classes of petitions. For instance, CSC has been moving toward processing all family types of petitions. Which is why in in June or so, family types of peittions such as I-485's, I-129F's and also I-751 have been transferred to CSC. We have been caught in the gap of this transition... It would have been better for NSC to transfer all of our petitions at the same time that started transferring new ones to CSC... but for some odd reason they didn't. They chose to keep them for some reason, but there's nothing we can do about that other than let some people know what is going on. We have written letters to our congressman, our senators, and USCIS ombudsman and the DHS Inspector General, and the chair and ranking members of the Immigration Subcommittees of both Houses of Congress alerting them to the point of the inequity in approval of our types of petitions. Obviously nothing has been done about it yet nor do I expect it to, but at least I said something about it and feel better for doing so.

ANd for information, the reason I have been posting here is because we are in the same boat as all of you. My wife filed her I-751 peititon in April 2007 in Nebraska and we are still waiting and are just as frustrated as the rest of you are. But at least we are together and are living our dream... We for one are more that willing to give up our place in the perceived adjudication line so that those who are still waiting to be with their loved one can finally be together, or can fianlly feel safe for probably the first time in years because they have been granted asylum, or have been granted to chance to start their own American dream by being given approval to get employment in the US. If the rest of you are so selfish to wail about keeping your perceived "first come first served" precious place in line... well, more power to you. But the fact is, you're not going to get what you want and you might as well be resolved to the fact that all the complaining and stomping in the world is not going to change the reality.

That is all I am going to say on this topic... VJ used to be a place where hearing different perspectives and reasoning on immigration topics were welcomed and discussed in a civil and reasonable way. Now it is a place where you either preach to the choir or be shouted down and attacked. It is truly sad...

Yes, we are together with our spouses, but it doesn't mean we can't be pi$$ed off that a service that we pay good money for is so f'd up. And since this is the second time my petition is getting caught in the time gap (more like a time warp) at NSC, it's extremely frustrating. Do we have this to look forward to when we send in the naturalization petition also? No one can say. I generally don't moan much about it because I figure the GC will come when it does, but that doesn't mean I can't occasionally feel like I want to stomp about it...and I'm glad there are people along with me stomping as well, because no one else in the outside world understands what this immigration nonsense is like. Agreed... but there is a difference between venting your frustrations (which has always been done, myself included) and attacking those who do not share ones viewpoint with nothing more than vitriol and the mob mentality that follows even when countered with clear evidence supporting one's position... this has been going on a lot more in the last year or so... the tone on this site has changed Frances and not for the better...

This is excatly what I am talking about... totally and completely inappropriate.... what if I told you that some my relatives were killed by that regime because they tried to defend the oppressed... how would you feel then... unbelieveable

I agree with Sister Fracas... although I haven't been waiting as long as some people, I too am frustrated. I paid good money, just like the people who paid the same amount AFTER me, why is it fair that they are approved before me????

My frustration is not at the people who have been approved... in fact, I congratulate them, and I am very happy for them that they were able to get through the process quickly... I'm frustrated at the USCIS because there seems to be no process in place as to how they go about approving applications, and if like some people state, the I751 isn't important to USCIS because we are in the States with our loved ones already... well, then they shouldn't have the process at all. We should just be able to apply for naturalization at 3 years, or renew our GC after 10 years, or 5 years.

I married in good faith and sent them all 4 of the primary things they ask for, joint leases, joint tax returns, our babies birth certificate, joint insurance... why do I have to wait longer to be approved then anyhow who filed after me... if only someone at USCIS could explain that to us - that would be nice, instead of these crap fictional dates they come up with!!! girlwerewolf2xn.gif

believe it or not, the nazi thing was a joke... probably should've put a smiley face next to the sentence. whatever. my opinion is the same - before going around calling folks selfish, find out their individual situations (if you are up to it). i've already talked about it, but in summary, my wife is having trouble finding a new job because hr folks in many companies are not convinced that an expired greencard with an extension letter is proof of permanent residence. also, try applying for a tourist visa at a french consulate general with the expired greencard/extension letter. finally, why did i pay for the darn i-751 in the first place if it looks like it's going to be adjudicated automatically when my wife applies for citizenship.

You all have a lot of patience,I already gave up that USCIS will process our !-751.They Probably are waiting for us to apply for citizen.SO that they can kill two birds(I-751 and N-400) with one stone.I know It is wrong whatever USCIs doing with our I-751 but in the situation that USCIS is right now they cannot make everybody happy.I'll still consider them smart If they Process our N-400 on priority

I have been wondering about that myself...

My 1 yr extension expires in mid-April. So I plan to make an Infopass appointment in March to get another extension. Will that be too early since my extension hasn't expired yet? Also I notice the I-130 that my hubby filed for me back in Jan 2005 (sent to National Benefits Center) hasn't been approved yet. But how can my I-485 (filed at the same time) get approved. The website indicates the status of I-130 was last updated Sept 30 2007 as being processed. The whole thing seems really weird to me. Will the I-130 status block my I-751 processing? We haven't heard anything from USCIS about whether they need any more things from us for the I-130 and we went to the AOS interview like 2 years ago when my I-485 was approved.

I agreed that USCIS doesn't seem to have any process. The only thing that got my hope up before was I knew two acquaintances who filed I-751 in 2003 got their cases approved within 3-4 months time frame. So I was expecting this to be shorter wait. I am trying not to sound whiny but this is so frustrating...

What we're going through is a reorganization on how petitions are processed. At the begining of our journey, petitions were adjudicated on a entirely geographic based system. All petitions were processed at a center based on where you lived. In the past 18 months or so, the service has been slowly moving toward a system where centain service centers process certain classes of petitions. For instance, CSC has been moving toward processing all family types of petitions. Which is why in in June or so, family types of peittions such as I-485's, I-129F's and also I-751 have been transferred to CSC. We have been caught in the gap of this transition... It would have been better for NSC to transfer all of our petitions at the same time that started transferring new ones to CSC... but for some odd reason they didn't. They chose to keep them for some reason, but there's nothing we can do about that other than let some people know what is going on. We have written letters to our congressman, our senators, and USCIS ombudsman and the DHS Inspector General, and the chair and ranking members of the Immigration Subcommittees of both Houses of Congress alerting them to the point of the inequity in approval of our types of petitions. Obviously nothing has been done about it yet nor do I expect it to, but at least I said something about it and feel better for doing so.

ANd for information, the reason I have been posting here is because we are in the same boat as all of you. My wife filed her I-751 peititon in April 2007 in Nebraska and we are still waiting and are just as frustrated as the rest of you are. But at least we are together and are living our dream... We for one are more that willing to give up our place in the perceived adjudication line so that those who are still waiting to be with their loved one can finally be together, or can fianlly feel safe for probably the first time in years because they have been granted asylum, or have been granted to chance to start their own American dream by being given approval to get employment in the US. If the rest of you are so selfish to wail about keeping your perceived "first come first served" precious place in line... well, more power to you. But the fact is, you're not going to get what you want and you might as well be resolved to the fact that all the complaining and stomping in the world is not going to change the reality.

That is all I am going to say on this topic... VJ used to be a place where hearing different perspectives and reasoning on immigration topics were welcomed and discussed in a civil and reasonable way. Now it is a place where you either preach to the choir or be shouted down and attacked. It is truly sad...




Well...lets make this clear as I see that some people got quite offended by our arguments related to I-751 processing time and the lousy job USCIS is doing processing these I-751 applications
I came to this country on a K-1 visa from Canada and from the beginning I got stuck with Nebraska ,same old story ,processing time for my first petition around 600 days .I thought that was the worst and everything after will go a lot faster .It didn't happen !
Am I supposed to be happy and pretend that nothing is wrong now that I'm going through the same BS with Nebraska ? I'm sorry but I can pretend that everything is OK and I should wait one year maybe two before someone will bother to discover actually my application laying down God knows where .Lousy job ,plenty of incompetence and mismanaging of the founds received for processing all these applications .
Zyggy- the slogan "first come first served " was not put on the USCIS website by me and if that's a lie then, they should REMOVE it right away ,don't you think so ? Do I have the right to be upset that after 12 months I still don't have any updates ? How much more patience do I need to have ???
There just seems to be a lot of unfairness in the way these applications are processed and just forcing us to dig dipper in our pockets and submit another application for Citizenship I think is totally wrong ,looks more like a money grab not to mention that maybe some of us do not want to become American Citizens ....anything wrong with that ?????

Since I didn't any reply to my previous post, I went ahead and called USCIS customer service. The lady was polite but didn't seem to have any further information than the website. She told me NOT to worry yet as my case is still within the "NORMAL" processing dates of NSC and I should wait till the posted processing date to be "2/25/08" to call. Then she thought that the cases 30 days ahead of the currently posted 2/10/07 date are being processed. Also she told me my I-130 is still marked pending in the system doesn't affect my other petions. I have no clue why though. This is confusing... But you know what, after dealing with NSC for the past 5 years, I resigned to my fate.

I called them numerous time also but I wasn't able to find anything new and to make the matter even worst the person that I spoke to suggested that I should look on their website for the processing time .WHAT A JOKE !!!!
They must believe that we have no clue at all about what's going on with these processing time updates .
I don't want to sound sarcastic but you can find more informations browsing through the internet from X and Y then from their website and again ......WE PAID $$$$$ for their service mad.gif

Once again I called USCIS today just to get the same answer "call in 30 days " I totally feel that after these 30 days I will get the same answer so what do you guys think..... Shall we start a law suit against them? Who wants to subscribe?

I see a lot of threads about starting a law suit. I'm just curious what the basis of it would be. Did the USCIS guarantee when (and if) an application would be processed? We can't really sue them for taking their sweet time. Can we?
I just feel that even if a hundred of us went up against the USCIS, we would waste years in court and have nothing to show for it other than huge legal bills.

The main criticism of the USCIS seems to be that the USCIS has officially a first-come-first served policy, but that later applications from the second half of 2007with the higher fee were processed long before many applications from the first half of 2007 have even been touched. (If the USCIS had expedited applications, this would be expected, because you could choose your timeline with your price.)

It has been argued that I-751 applicants are in a comfortable position, because they can work and travel. Others have commented that the delayed card means difficulties in getting or keeping some jobs, delays in travelling, and generally an uncertainty about your future. I doubt that anything useful would come out of a lawsuits by I-751 applicants, and I would probably not participate, but I wouldn't advice anyone against it either.

Ah, yes, I know that is annoying. I see people who went through NSC after me who now have their 10yr. So the suit is really based on the fact that the USCIS aren't sticking to their own policy. It seems unlikely to be a case that would win. I think I'll just wait.

Your NOA is just a day before mine, so I'm watching your timeline with great interest.

If we file to remove conditions AND the USCIS gives a one year extention upon receipt of the petition (and, might I add, cashing of out checks) then it seems reasonable to expect that within that one year the petition would be acted upon in some fashion.

If the USCIS is unable to act within that one year then they should at least refund the money and/OR at least send out a new green card with an automatic 2 year expiration date until the petition is adjudicated.

A green card is supposed to be the only evidence needed by an alien to carry around to show proof of legal residence. Now we have to carry the passport around as well? Having to carry around two pieces of documention when one is sufficient ONLY because an agency of the United States goverment exhibits such inefficiency and/or incompetency is not acceptable to this taxpayer. The fact that some here just brush it off and shrug their shoulders further inflames me.

I expect such bureaucratic incompetence from a third world country. The fact that we tolerate it here and allow our representatives in Washington to stick us with this crap is even more unacceptable to me.

I did not believe until today we have the technology for timetravel - but apparently USCIS does! It is outrageous.

I wonder if all of us stalled at NSC should start contacting respective congresspeople with these dates, as well as the fact we are stuck with NSC. I have already contacted mine, and just sent off the new dates.

This is outrageous. From December to January, their posted processing date moved from 2/9/07 to 2/10/07. And Now it went back to 7/05/06? This doesn't make any sense. I think it is time to fire all those people!

It would not be the first time when they go back processing these application .There is no logical explanation about how they go around working on our cases and I'm sure ....lots of people will call them on Monday .
I have contacted my Congressman also, I will do it again this Monday . I also sent a few e-mails to CNN and hopefully somebody will contact me to describe more in detail our situation.
Nebraska should be shut down completely and whoever is in charge there hold accountable for this mess. To many BS lies !!!!!

Whether they mean 2006 or 2007 really does not matter, does it, because obviously, neither would be accurate.
It would make more sense even for it to be 2006 as with the Feb 10th 2007 date, I was already outside the processing window with many others here. If it was July 2007 we would be 5 months outside the window, which would make even less sense. We know we have an approval from December 2006 (@Betrand), so maybe not all hope is lost whistling.gif
All this latest update shows us once again is, that these "processing time status" pages are just not accurate and should not be used as a guideline to anyone's case. These exact things happened with my I-130 petition over three years ago.
@debeselizz, yes, when the expiration date comes close (really close) schedule your infopass and get a stamp. When I was there a few weeks ago they said they'd only stamp for 60 days in Chicago and only if you have already arranged for an overseas trip - I was asked to bring my flight confirmation next time.
For all others, this memo was already posted before but I'll post it again; it can be found in the press release section of uscis.gov, in regards to our status which does not expire.

Thank you for re-posting the memo. Well, they will have to stamp for employment purposes too, as it is listed on the memo, not just for travel purposes!

I wonder if all of us stalled at NSC should start contacting respective congresspeople with these dates, as well as the fact we are stuck with NSC. I have already contacted mine, and just sent off the new dates.


I have contacted USCIS today and all I could find was that USCIS goes back from time to time to process older applications ?%#$#&^$^*#%$# bunch a crap like usual !

I have also contacted my Congressman and he had a different answer from Nebraska .FBI apparently is taking a long, long time to check fingerprints ,names ....etc. 13months +
To me the list with these A.S.S.H.O.L.E.S involved in processing our applications is growing by the day and there is no way you can pinpoint one or the other .THIS IS JUST ONE BIG COVER UP

Thanks for the info. I'm going to be contacting my congressman today. (If I ever get off hold with the IRS for requesting tax transcripts for the N-400).
