Full Version: G325-A Form Question

Toward the end of the G325-A Form, there is a question asking

"The form is submitted in connection with an application for:"

and they give you 3 options -

1 - Naturalization
2- Other (specify)
3- Status as Permanent Resident

This paper is for my wife. I marrierd her in Japan and we choose to do the
CR1 visa so she would be a permanint resident. With that said,
...would I put

"Other" and write I-130 Form

Or

do I put "Status as a Permanent Resident"?

Hi,

You would choose "Status as a Permanent Resident" as that is what the I-130 is for.

You check other and write I-130.

You check "Status as a permanent resident" with the I-130 is submitted together with the Adjustment of Status paperwork.

However, in practice, either will work. They'll quickly see the purpose of the petition with which the G325a is included and proceed accordingly.

Since you are filing for CR-1 visa, you are applying for permanent resident status.

Since you are filing for CR-1 visa, you are applying for permanent resident status.


I think either will work but technically, filing an I-485 is "applying for permanent resident status". In the OP's case, the G325a is not submitted in connection with an "application". It is submitted in connection with an I-130 petition intended to grant a beneficiary the right to apply for a visa. Once the visa is applied for and secured, permanent status will be granted upon entry.

Other and I-130 is the technically correct answer when a visa is involved but either WILL get the job done.

Since you are filing for CR-1 visa, you are applying for permanent resident status.


I think either will work but technically, filing an I-485 is "applying for permanent resident status". In the OP's case, the G325a is not submitted in connection with an "application". It is submitted in connection with an I-130 petition intended to grant a beneficiary the right to apply for a visa. Once the visa is applied for and secured, permanent status will be granted upon entry.

Thank-you for the help everyone! It is very appreciated - I will be returning to the united states January 11 and starting work on the 14th and think work will be very busy so I am working my best while I am here in Japan to complete most of the documents.

To Justin and Masako - I am staying in Umeda (Tokyo) I will try to post some pictures here of the wedding when I get a chance and can figure out how to upload smile.gif

Yes, I agree with pushbrk. In fact, we put "Status as a Permanent Resident" for wife's (beneficiary) G-325A and we checked "Other," then wrote "I-130 Petition" for my (as the petitioner) G-325A.
