I would really appreciate if someone can help me. Let me explain my situation.

I have been waiting for my K-3 visa since september. Before I applied k-3visa, I was denied to enter US at POE because I was married and couldn't show strong ties to my native country(Japan). At that time, I tried to enter under visa waiver program.
At the POE one officer told me to get immigrant visa or K-3 visa and another officer told me to get B-2 visa.
so my husband applied for k-3 visa soon after I came back to Japan. He recieved NOA1 in September.
Can I get B-2 visa and visit my husband after the dinial and while my k-3 visa is pending?
I saw many people visit US while their case is pending, but I don't see people who has the circumstances like mine.
Does one time denial at POE make it impossible to visit my husband even if it happened before we applied for k-3 visa?
I reserved the interview date for my B-2 visa in January. We just wanted to try.
If you have any advice, please let me know.
We haven't seen to each other for 6 months and I miss him so much.

Your record will have been flagged when you were denied entry before, and you'll be denied entry again, unless you can show definite ties to Japan rather than the US. The main reason they will deny you entry is because you have a spouse in the US, you are a high risk of staying and immigrating illegally. They don't like people to do that (or rather, they say they don't like it )

If you can show definite ties to Japan, like a home, job, bills to pay, financial obligations, family obligations, etc etc then you might get the B2. Don't hold your breath though. And do get a copy of the NOA for the K3 petition from your husband. This will show that you are in the process to immigrate legally, and may or may not help your tourist visa application.

I was denied twice. The first time I didn't have a return ticket. We had already filed our I 130 when I was in the US and at that time we were pretty clueless about the immigration process. I left the US for what I thought was going to be a 2 week visit and it ended up being 10 months. In hindsight, it all worked out for the best. Being in Canada made it much easier for me to get all the things together I needed (vaccination info, Birth certificates, Police Certificate, etc) Plus I married while on a B2- it wasn't my intent to stay and marry but if I had to prove that was not my intent- that might have been tough.

The second time- I brought as much as I could as far as ties to Canada. They felt I didn't have enough and I don't think being flagged in the system helped me much either. It was humiliating to go through another denial.

As far as getting my Visa- the denials had no affect. I explained both denials at the interview and he said "yup, that happens often" and moved on to the next question.

Unless the circumstances have changed, in that you now can show significant ties to Japan, I don't think a B2 visa will help you.

Agree, you will have to show significant ties to Japan.
My wife applied for a B-2 visa in Osaka and was denied because we had a K1 petition pending. The denial had no bearing on her subsequent K1 visa adjudication.

I guess I cannot visit him untill I get my k-3 visa issued because I cannot show any strong ties to Japan.
We thought waiting for k-3 visa is also a strong tie because I have to have an interview in Japan to get k-3 visa.
Who will give up the proper visa process and stay there illegaly?
I am sorry for grumbling. I just cannot understand.
