Well its christmas and mine is not that good. My GC will expire March 2008. I had a fight with my husband for some issues and things are not tolerable anymore. I have some questions and i need some advices.
1. Should i send my I-751 now, he signs it already. (file jointly). I have enough evidences to support validity of our marriage. but what if in the long run while my petition is pending, divorce is file? what will happen to my removal of conditions?

2. Should i go ahead and file for divorce now? and wait till divorce becomes final? is there a big chance of approval for self-petition? i have enough evidences yes.

please help me i really need your advices here. dont konw what to do.

Well, it's really going to be your decision...but if you will expire in March, you may want to go ahead and file. Please, someone, this is not an area of expertise (if anything is!) so correct me if I'm wrong....but I believe you can file jointly...it's perfectly fine as long as those ARE your circumstances when you do actually file. I wouldn't take the chance to let my GC lapse if it were me....but, again, it's going to be your decision. M.

Divorce is something that in most states can take months to complete, so you may want to file now, jointly, In order to file for the waiver of joint filig requirement the divorce has to be finalized, and you submit a copy of final decree of divorce.
