Anyone can apply for a visitors visa. My wife and I applied together, and were denied. Rarely, they are approved and it only costs $135 or so to try.
Our case:
She owned home and mortgage, still was working in Jakarta
We had not filed any petitions (130 or 129F) before we applied for visitors visa
The consul told us they are instructed specifically in spousal cases that being married to USC pre-empts any other ties to their home countries, and it didnt matter that she still had a mortgage and job, being married made her ties to US too strong. That was us, and if I were to go back I would still have tried.
That is OUR embassy, they are all different and I encourage you to try. Being denied visitors visa does not effect your case especially if you are honest about what you want.
Hope that helps,
David and Nitadyah
Hi,
Thank you for your answers. David and and Nitadyah, if your hope about the entry date is true, you will enter 7 months after filing I-130 which I think is a good record, isn't it?
