First of all, I want to thanks everybody who really helped us to go trough all this paperwork.

I’ve got great news! My visa has been approved! We filled DCF in Belgrade and in just one month, I’ve got my visa in my hand. I have only one more question, but before it, I would really love to help with my experience.
My husband is an USC whereas I am a Montenegro citizen. We have been married for almost a year. He is retired since 2001 and receives an US pension.
We currently live in Montenegro but wish to move to US.
Since we both live in Montenegro,there were some uncertainty in filling the form I864. My husband’s pension was under the poverty line, and we were wondering if the value of our assets which we possess here in Montenegro could be taken into account.
In my experience this answer is no. They didn’t want to count any asset which are not on US territory and said we could use a joint sponsor.
But, we also had a problem how to prove the domicile, so we made an agreement in written form with a person who currently lives in US and who wishes to exchange our properties for a year.
So, we used this new future residence as domicile, and had a joint sponsor.

And finally, I am booking the flights!

We have some real-estate property (house, land, car...) which want to sell before we move to USA. I am afraid it will not go so easy now, and I don’t want my visa to get expired.

So, I've got one more question. May I travel without my husband to USA and wait for him there? Am I going to have a problems at the Point of entry because I am coming without him?

Hiya...First of all congrats! Right, I am the USC, and my future husband is British. I am in the same boat sort of as you in regards to the assets and what not. The major difference is that I have not been working for the past almost 2 years. I have to also use my future spouses assets which you can use. As long as it can be turned into cash witihn a year you can use it. It doesn't matter where the assets are located. If you read the affidavit of support form, the actual instruction pages prior to the actual form, it even states that you may use the assets. I dont know how to send links in here but I am sure you can find it easily. Just goto downloads and look for affidavit of support forms. Read it all and you will see.

I posted my experience, in Belgrade Embassy they didn't want to count our assets which we own here in Montenegro. We had to have a joint sponsor.
But, thank God, we are over it and I've got my visa.
Only thing which I have to find out now is may I travel to USA without my husband. He will join me after he sells our property here.

As to you traveling ahead of your husband, I actually encourage you to check this out further. I did some searching for you this am but ran out of time. However, I specifically remember this question being answered by the immigration attorney at BE because I was surprised at the answer: the USC must travel with/ahead of the immigrant.

Like I said, I don't have a source, but encourage you to check further into it.

As long as you have a valid visa you can travel to the usa on your own. My wife did so and no problem.

Dianna, I actually stumbled on this thread while looking for something else, but remembered your question. This is where I first got the idea about the immigrant traveling ahead of the sponsor in a DCF case. Since the source is a respectable immigration attorney, I paid attention.
I don't know if there were more posts from him on the subject or not, but as I said, it would be worth getting clarification. Note that the OP in that thread had a similar issue to yours, and that she got her information from the consulate originally. Maybe your Consulate would have an answer for you?

The issue appears not to be traveling alone v traveling together, the issue appears to be traveling before v travling with or after.

When did your wife travel to the USA - before or after you did?

Hello,

The documentation I received with my Immigrant visa was quite clear. The USC must be with you OR already in the US when you arrive. You cannot arrive in the US on your immigrant visa before the USC returns.

Now we all know how things work. It will cost us one more airplane ticket, but what to do, I can't allow my visa to get expired and my hubby will go back to sell our property in Montenegro.
