I'm a USC and my husband, Brazil, is CR1, Permanent Res., do I or my husband file for his mother (which is my mother-in-law) to come and temporarily visit? I'm having a baby, and we want her to come visit for a month or two. Do we file for a tourist visa, or a different kind of visa? On her own conditions, if she were filing for a tourist visa, would NOT qualify. She has no job, no connections or ties to Brazil...but she doesn't want to live here...just come visit. Is there a type of visa that we can get quickly too, because I'm having the baby? Thanks. Andrea

I don't think she qualifies for a tourist visa, as I explained in my original post. She has NO money, no job, nothing to keep her in brazil, even though she doesn't want to live here, and would only be visiting...they don't care about that. they care about the numbers. does having a son, who is a permanent resident change those conditions; because I don't think it would.

It doesn't matter what your situation is here in the States and the reasons for her wanting to visit. The US Embassy is only interested in that she has good enough reasons to go back to Brazil if she travels to the US. If she doesn't then there's a big possibility that she won't be able to come.
You only have two options: 1. Have her go and apply for a tourist visa on her own, which is the only way this can be done. There's nothing you can do about it. or 2. Have your husband become a US citizen and file a petition for her. This of course means that she will have to live here in the States for most of the time.

hi,
This is a tough call because US embassy also sees to it do you have enough financial strength to survive in the US for the time frame. Its 2 ways... I guess it should be a tourist visa only ... there is no other category for her... and she has to say she is visiting her son for the baby and wants to see the baby and come back..
