Hi VJ troopers,
oh brother. I just read my NOA2 from California for my I-130. I thought it said I-864 and now I noticed it is an I-824 form. Dump. My question.....do I send in the $380- with the I-824 or does someone send me a bill? Also, by me sending the I-824 mean that I have abandoned my K-3 visa?

During your NVC process, you will need to pay $380.00 as IV Fee. I am not sure, what is I-824, as we did not deal with it when we did our process.

This post is confusing. Did you file an I-824? If so, why? If not, why are you asking about it. An NOA2 for and I-130 should mention nothing about either an I-824 or I-864.

Please clarify.

Filing an I-824 at this point would be to get your I-130 moving. It would not stop the I-129F.

It seems like you filed a I-130 and I-129 at the same time, and now both are approved. Looks like they are processing you as a K-3. I think (please check the www.uscis.gov webpage for this) that you'd file the I-824 to have the NVC send the I-130 to the NVC so that you can process as a CR1/IR1 instead of a K-3. I don't know how much the fee for the I-824 or the wait time to have that processed is.
But, given the relative new speediness of Montreal granting CR1 interviews, I'd suggest that you go the CR1 route if it isn't too expensive or timely to file the I-824. That way you'd avoid the adjustment of status fees and your spouse can work in the states right away.

The I-864 is the Affidavit of Support that is sent to the NVC.

If you file an I-824, it will take another 3-6 months to have it processed and approved. So you really need to see if abandoning the K3 visa is worth waiting another 3 months, plus the 3 months the NVC takes to process the CR1/IR1.
