Full Version: Travel Outside US after Marriage w/K-1 Visa

Hi All,

Once my fiancee receives the K-1 Visa, arrives in the US, and we get married immediately (civily), how can we go on a honeymoon outside of the US? I believe we must apply for a Travel Visa, or Adjusted Visa Status, or something. tongue_ss.gif Does anyone know how long this takes? Any stories on your personal situation, maybe how you were able to go outside the US soon after your marriage? Thanks!

You can apply for Advanced Parole when you send in your AOS. You need either that or the greencard.

When you file for adjustment of status, you can also file a request for Advance Parole (AP), I-131, with your I-485. This should be approved within 90 days. Until AP is approved, your fiance cannot re-enter the US after leaving.

There is an opportunity for emergency AP from a local office, but a honeymoon is not an emergency.






And I must add that the USA has plenty of lovely honeymoon spots yes.gif

(not like the honeymoon location is important anyway; it's just about being together)

We are actually trying to go back to Japan (her country), for her brother's wedding in early May '08. If everything works out on the K-1 Visa, she will be in the states in mid-Feb. We get married, apply for the Advanced Parole in end-Feb, that's only 60 days. Do you think this could qualify as an emergency AP?

You have 6 months to use the K-1 visa. It might be better to instead come to the US after her brothers wedding.

Actually, I think you can obtain emergency AP for your stated purpose. At least a friend of mine managed it simply to take his wife on an international business trip that included visiting her family on the return leg. You can check with your local USCIS office as soon as tomorrow if you wish.
