Full Version: running out of time to get SSN # please help

Hi everyone!

Is there anyone who can advise me with my problem? Here is my situation:
We went to the Social Security office to apply for my social security number today but the staff told us that since my I-94 is about to expire on December 17, he can't process my application, but he told us that when we file a permanent residency (adjustment of status) and filed the EAD we can always come back to the SS Office to get a number.... is there going to be a problem to my adjustment of status since i didn't get my social security number? Me and my husband are already married on december 5, 2007.

No...there would not be any problem at all. You are not required to apply for SS card before getting your work permit but you are supposed to apply for the I-485 (AOS) immediately, preferably before the 17th of December.

There are fields in the AOS and EAD applications for SSNs, but they are not necessary for the forms to be complete.

So, just move on, submit your applications, and when you get your EAD card, then you can go back to the SSN office and apply for a SSN.

A Social Security Number is not required for the Adjustment of Status. Put "none" in the block that asks for social security number.

They will not issue a SSN within 2 weeks of I-94 expiration, you will need to wait until you will now have either EAD or green-card to apply for SSN.

SSN is not required to file for AOS.

Thanks Sue n Tom for the advice you gave to me, i really appreciate it. What happen if we didn't apply for the AOS before 17th of December? Can we still apply for the AOS next year preferably january or february because you know that filing the adjustment of status is so much money and we need to save to that.

This only means i should not worry about filing the AOS? Thank you so much for this ideas, you make me feel at ease

Thanks Scott, this is why i ask everyone here in VJs because this freaking me out but this helps me alot. I just thought it will cause a problem on adjusting my status.

No...there would not be any problem at all. You are not required to apply for SS card before getting your work permit but you are supposed to apply for the I-485 (AOS) immediately, preferably before the 17th of December.


That is not correct. You have to get married before the I-94 expires. You can then file for AOS at any time, before or after and some people have waited for a year or more. The only condition of a K1 visa is the marriage is within 90 days.

To the OP, you will now have to wait until you have the EAD or GC before applying for a SSN. On the I-485 form where it says SSN, just put "none"
