My fiancé is trying to come to the US on a k1 visa. The visa was approved by the national visa center and sent to Kingston for processing 10/2015 . He was called for an interview apt in Dec 2015 and Jan 2016. They told him he need to pay for a waiver for inadmissible to the US. When we talked to USCIS and the NVC in the US. They told us if he never was in the US and did not commit a crime in the US , they don't need a waiver filed. I told them that's what the agent told him in Kingston. He had a crime on his record over 10/12 years ago and his record have been expunged. He have not committed any other crimes. We don't know what to do because Kingston is saying send the money to USCIS in the US for the waiver and the US is telling me they did not request it and if I send the 585.00 to them if want be refunded, because they did not request it. I made an appoint with USCIS in Jacksonville and talked to a Supervisor and they told me , they don't understand why the visa have not been issued. They called the NVC for me and talked to a Supervisor and they said the same thing. Can someone tell us what to do ? Is it anyway I can have an emergency appointment with a supervisor at the Kingston location ? My fiancé keeps getting the same agent every time he goes to Kingston. I don't think he knows what he is doing .
