What are the chances if I am HIV+

I am in the process of adjusting my status from student (F1 Visa) after marrying a US citizen.

My medical tests which are a requirement by USCIS resulted with a HIV+ status.

This is the most devastating thing in my life and am now very worried about my interview and the whole process..

Can anyone help me by advising me on what we should do??

I am afraid that the whole thing is messed up yet I have already lost my student status and on the route to the end of life....

Anyone with any kind of advise please share with me.

Will this lead to rejectection and if so, at what stage?

Is there anything we can do to ensure a smoothness?

I'm pretty sure your AOS will be denied and you'll have to return to your country and file a waiver. The chances of it getting approved, I don't know. Maybe kitkat1 will come by and see this and be able to help...

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

I would have another test to confirm being HIV positive! Mistakes can be made.

I am so sorry for such terrible news. However, it isn't all hopeless after all. There are processes that allow you to attain a waiver. If you are already in the United States and adjusting, you can do it from here.

EDIT: It isn't the end... you still have a chance to adjust, and according to the article, spouses of US Citizens can file the waiver. Best of luck.

First of all, I am very sorry. I hope that you dont feel your life is over, there are drugs that can keep you alive for a long time. Just look at Magic Johnson.

Secondly if you can afford a lawyer, get one! You can get approved.

The biggest issue is, who will pay for your care? The government is more worried about that than any health threat.

Eligibility to file a waivers for HIV+ aliens (those deemed inadmissble under INA 212(a)(1)(A)(1)) is possible under very limited circumstances

One condition is that you are the spouse of a USC

First of all I'm sorry about your news. This is devastating news for you but it isn't the route to the end of your life. There are so many new drugs on the market now that keep HIV+ patients healthy for far longer than even five years ago. Many live full and healthy live with a decent drug regimen.

Secondly, I agree with the others here that you will need a waiver of sorts. Plus I think you also have to consider your medical treatment over here in the States. HIV+ drugs are expensive and I doubt that you would be eligible for healthcare insurance as it is now a pre-existing condition (unless you were covered before the diagnosis).

I'm not sure where your home country is but you are more likely to get decent health coverage there than in the States (specifically cost wise). I think that these matters are more important that the AOS process at the moment. Don't forget that your spouse will also need an HIV test at some point too (probably 2, one now and another in 3-6 months time).

Could you move back to your home country with your spouse (if she/he is HIV-)?

I think I've read that a lot of insurance won't cover a lot of HIV/AIDS cocktails - and they can cost thousands and thousands of dollars a month.
