Finishing up my I-130 packet

Hi guys,

 

I am finishing up my I-130 petition packet to post out today. Could you guys please just cast a eye over my cover letter, which details what I have in my package and let me know if I have enough evidence and everything look good.

 

I am filling outside of the USA, my husband and I both reside in New Zealand which unfortunately doesn't offer DCF.

2.  Completed and signed form G-1145. 

3.  Two (2) passport style photos of petitioner. 

4.  Two (2) passport style photos of beneficiary. 

5.  Completed and signed form I-130, petition for spouse

6.  Completed and signed from I-130a, Supplemental Information for Spouse Beneficiary. 

7.   Copy of petitioner’s birth certificate to establish citizenship. 

8.  Copy of our marriage certificate. 

9.  Evidence of bona fide marriage:

a) Copy of current rental agreement

b) Copy of Mortgage agreement

c) Statements from both joint bank accounts: USAA and New Zealand Credit Union

d) Copy of shared Health Insurance: Southern Cross Health Society New Zealand

e) Copy of 2014, 2015, 2016 joint tax returns

f) Photographs with families

 

Copies of the documents submitted are photocopies of unaltered documents and I understand that I or my wife may be required to submit or present original documents to an immigration or consular officer a later date.

 

I kindly request you to process the above petition and to provide the receipt notice as soon as possible. If you have any questions or concerns on the above matter, please do not hesitate to contact me at the address below.

You dont need option e for this stage.

 

You didn't include the beneficiary's birth certificate.

 

If there's any previous marriages amongst you or the beneficiary,don't forget to include it to avoid RFE.

 

Lastly,if there's any baby born to you both,include the child's birth certificate.

It doesn't say to include a copy of my birth certificate on the guide? Should I include one?

Option e is just receipts of us filing our taxes jointly. I should have specified that, sorry.

No previous marriages or kids yet :)

Damn it, I already sent it without my birth certificate because the guides I followed online didn’t say to include it... I really hope I just get an RFE and not a rejection.

The posters who said you needed the beneficiary’s birth certificate were grossly incorrect, that is not required at this stage.

 

Before anyone else posts how they heard of others getting RFE’s for it, there was a time a few years ago when local offices were adjudicating I-130’s with an outdated field manual hence the incorrect issuance of an RFE for a document that is no longer needed.  If the beneficary’s birth certificate was needed, the instructions would specifically call for it.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Phew! Thank you so much! I was panicking and worried about my petition being rejected because of it and having to pay the $535 again. I’m still going to be stressing until my petition is approved and sent to the NVC, since it’s changed a bit since I submitted my I-130 and I-485 4 years ago. I do feel better now though. Thanks 😊

Hi, I am also about to send my I-130 packet off from New Zealand and need to send this via DHL or Fedex..could you possibly let me know how you did this? I have looked online and the quotes are around $130..did you use your own packaging or theirs? Your advise would be greatly appreciated as I really do not want to mess this part up. Have you had any news yet since you filed? Thanks

Hi there,

We used a NZ Post local or International bag and did international courier. It cost us around $45. 

We’ve had our NOA2 and our petition is on its way/arrived at NVC.

Thanks for your quick response! I was under the impression for the website that you HAD to send it by DHL or Fedex. Obviously not though if you were able to send it by international courier post. That would be so much easier and cheaper..thanks!! Good luck..hopefully you hear from them soon

You’re welcome :)

I thought it said USPS was an option too, which is what NZ post becomes once it arrives in the USA. Also some postage agencies won’t allow you to send Cheques through the mail, USPS allows it. Thank you!

That makes so much more sense now 😊 one more question..did you leave any blanks on your forms or did you write N/A in the spaces. There’s so much conflicting advice around what is correct and I’d hate to get declined due to this. Your post office may not let you use the international courier with tracking as you need to have a persons name for receiving the post, however our post office did us a favor and sent it as if they were sending it instead of a customer, except we paid for it and our details were on the sender info. I have no idea what she had to do on her end, but she managed it! As for the forms, we wrote N/A on some parts and left others blank. We used N/A for previous spouses and if we had children,otherwise we left the parts that we didn’t need to complete blank.

Thank you! We are going to post on Monday so hopefully they will be kind and let us send without a name. One question we are stuck on is question 12 in part 4 - we do not have an address in the USA yet where we intend to live..is this an issue you had? Im not sure we are able to leave blank..if I type same as the form states then that will be my address here in NZ. I’d never thought filing out a form would be so stressful..I’m even doubting my own common sense 😩

So exciting! I think we’ve all doubted our common sense at one time or another during this process. We put my in laws address because we will be moving in with them when we get there. Can you put a family members address in?
