Change of Address after filling I-751

I am about to change my address online and I am not really sure which receipt number to use. Is it the WAC# from the I-797 letter NOA or the WAC# that I use to check my case status online?
*I've already had my BIO appointment

Either one. 

 

Make sure your spouse also does I-865 for change of address.

I tried the one on the NOA letter and it worked and I got the confirmation on my email. When I tried the other one that I use to check the case online it says it doesn't exist in their database.

"You must select the Form Number associated to your Receipt Number. The Form Number you selected does not match our records for that Receipt Number."

 

My sponsor is my mother-in-law and she hasn't moved so I think we are good.

Not true. The spouse is always the primary sponsor for the CR1/IR1 and, as such, does need to file the I-865. Otherwise USCIS may believe that you no longer live together.

Yes, as above stated, only one of your receipt numbers will actually work for the AR-11

Your spouse is your primary sponsor and has to complete change of address. Presuming spouse moved with you?

I read the instruction and it said when filling affidavit of support and with this process we don't have to do it, so I spoke a while ago with a representative and she told me I don't have to do it, and when I filled out my wife change of address I put my name in Care of.. we did change the address together and we have the proof.

It is required by the law. You have to file both forms if necessary. AR -11 by the resident spouse and I-865 by the sponsor if he/she moves with a change of address. The instructions are clear. 

 

"The purpose of Form I-865, Sponsor’s Notice of Change of Address, is to report a sponsor’s new address. If you, as a sponsor, change your address, you must submit a completed and signed Form I-865 to U.S. Citizenship and Immigration Services (USCIS)".

 

"If you knowingly and willfully falsify or conceal a material fact or submit a false document with your Form I-865, we will reject your Form I-865, and may deny any other immigration benefit. In addition, you will face severe penalties provided by law and may be subject to criminal prosecution".

should I sent a letter explaining why took me so long to send it? and copy of both change is address? we change the address because we were having trouble getting the mails where we living now.

There's a box at the very end of the I-865 form that allows you to add other information. Put the actual date you moved on the form where it asks you to, and then refer back to that question in the "other information" area and write a brief explanation that you weren't aware you had to file that form and as soon as you realized you did, you filed it.

 

It happens all the time - there are, like, a kajillion threads just like this one on VJ and that seems to work for pretty much everybody. I didn't know about the extra form at first either, and that's what we did when we sent it in several months after we were supposed to. They just sent him a letter confirming his address change, and that's all there is to it!
