My ex wife is deceased a month ago and even before them i have the full custody of the children.

How can you have full custody of the children when you do not even live in the same country?  Are you a green card holder or a US citizen?

When i file for divorce I'm support to force the law on her but considering she short time to live

Op, get someone who speaks English to come and post on your topic with all the details. 

Here are some questions for you:

-When did you get your green card and how?

-When did you divorce your ex-wife that passed away recently? 

-How old are the children?

-How often do you see the children since your move to the US?
