AOS overstay question

on form i-485 part 8 question 17 it asks 'have you ever violated the terms of your nonimmigrant visa'

my answer would be yes i have overstayed an esta. would i explain this in the additional information forms or leave it as they will already know i have overstayed?

also should i leave part 2 questions 3-9 blank as i am the principle applicant and dont have a receipt number of an underlying petition. questions 5a to 9 ask you to write about the principle applicant if you are the derivative, so should i leave this part blank as i am the principle applicant?

sorry for all the questions.

I would also like to know the answer to this question dear VJ members pretty please!

@Scotty23, I have a question for you, on the I-485, what did you put in Part 1. Information About You 24. What is your current immigration status (if it has changed since your arrival)?

Thankies in advance!  :).

Yes but as you have overstayed and therefore violated the terms of the ESTA, shouldn't the response be different?  VWP Visitor is how you arrived but that has changed since your arrival, right?

@Etamkoos

here you go, i asked about a question on the employment application but its just the same as it asks current status.

Thank you, I have read through that thread but it didn't seem very conclusive by that new member.  I have been lurking on here while trying to gather all the information and I wonder if any of the members that have stood out for me on these boards would mind if I name dropped them for a response on this... Well, where I come from they say, "shy bairns get nowt", so here goes!

@Boiler @geowrian @Hypnos @JFH @Ontarkie

Hey guys, please could you advise what someone who has overstayed their ESTA VWP status would put on the AOS paperwork as their current immigration status?  Pretty please and thank you :wub:.

PS.  If doing this somehow violates the ToS, please do let me know and throw me a copy of that link my way.

Cheers :).

Hi @Scotty23 and @Etamkoos,

I am submitting my AOS soon. My husband is USC. I came in on F1, and am on F1 OPT now. As i did not get a job within the 90 days, have been out of status since Jan 2018.

Just wondering, in the end, what did you put (or not put) on

form i-485, Part 8 Question 17 it asks 'have you ever violated the terms of your nonimmigrant visa?'  Did you provide any explanation on Part 14?

form I-485, Part 1. Information About You 24. What is your current immigration status (if it has changed since your arrival)?

Thanks in advance.

@MelandJason

Thanks for your reply.

Did you give an explanation for the overstay or did you just leave it blank? Also, what did you put for "current immigration status"?
