Time after I130

Hello all.

I'm really concerned about timing everything right.

 

Would someone be kind in telling me if there is a time limit between receiving the post-I130 "packet of forms" and sending it back please?

Explain further. You asked for paper petition forms to be mailed to you instead of filling out the I-130 petition online and printing it for mailing it to USCIS London?

Neither.

After trying to read the mountains of information here, I am aiming to reach America by around Easter time.

I'm juggling with my USC wife's flight there before mine and the Removal Company.

We have not started any part of the process yet, and we still are gathering the document for the i130, and whereas we don't want to delay anything when we start, neither do we want to start too soon.....if it's possible....which is my question.

We're a little confused as to how long we have between receiving acceptance of i130 and filling the other forms

There's two parts to DCF

  • File your petition with the  USCIS office in London. Their website has all the details and a checklist of what to mail. Then you wait for them to approve the petition. Not sure how long that is taking currently, but things slow down during the holidays because the American employees take holiday time off. Then you wait for them to send your file over to the the Immigrant Visa Unit of the embassy.
  • The Immigrant Visa Unit is part of the Department of State, so even though it may just be across the building, it's a totally separate division of the government. You wait for them to receive your file before starting. This is where you actually apply for the visa. They would allow you a year to respond,  but you don't need to dally around. The visa application is the DS-260 submitted electronically. The rest of the documentation goes with you to the interview. You can start gathering that now (  birth certificate, police certificate etc) , and getting any immunisations you need so you are ready. The timing is really in your court at the embassy step. You pick your medical appointment and interview date. Stall if you need to. The only date to watch is the visa medical because your visa will only be good for 6 months past that date so you wouldn't want to do it too soon if you weren't planning on using it before say next September.  Easter is April 1, so I wouldn't mess around if you want a visa by then.

Yep, but after six months of nothing from you they may send you a letter saying Hey do you want a visa or not? We haven't heard from you. That has happened to people who never got a letter informing them the IVU had their file, so they were being super patient and not checking on it.
