Apostille for the supporting documents

Hello!

I have a question and I hope that someone will be able to help me.

I am French and I am in the CR-1 Application process. I will have to collect the supportive documents (for me those are Birth Certificate, Marriage Certificate, Photocopy of Valid Passport Biographic Data Page, Police Certificate of less than a year from France and Germany because I lived in both countries). I assume that all documents need an official translation. But do you know if all of those documents need an Apostille?

To send to NVC, it says to send photocopies of those documents with translation. And for the Interview, bring the orginial with translation. You could Apostille, but not necessary that i believe

Check out the NVC's supporting documents page. You don't need translations of documents in an official language of the country where you're applying. If you're in France, documents in French are okay. But yes, the German ones would need a translation (doesn't have to be "official" - if you're fluent in German, you can translate it yourself).

No need for any Apostille.

Yes - isn't that what I said? Documents in French are acceptable if you're applying for the visa in France. And you can translate them yourself if you're fluent in both English and the other language (i.e. you are competent to translate). They don't require any proof of the translator's competence - merely that signed statement (and that signed statement is the "certification" of the translation).

I will not translate my passport of course.

But birth, mariage and french police certificates that are in French will definitely have to be translated. The  German police certificate will also have to be translated. And all of those by a certified translator. 

But I also found this whioch confuses me "Apostilles authenticate the seals and signatures of officials on public documents such as birth certificates, notarials, court orders, or any other document issued by a public authority, so that they can be recognized in foreign countries that are parties to the Convention."

Okay now I understand what you mean. I am applying for an immigration visa in the USA so I will have to translate everything in English. But I am pretty sure that I cannot translate it myself into English.

You can't apply for an immigrant visa in the USA. Even if you're physically here now, you must return to your country of residence to complete the application and have the consular interview. Presumably, that would be France, so documents in French are acceptable.

If that's because you don't feel that you're sufficiently fluent, that's a fair call. If you're simply concerned about "official" or "certified" translations, don't be - plenty of people here have submitted their own self-certified translations. There's even a wiki page with a template of the declaration you should make.

the USC must apply for this / your spouse

The USC must file the initial I-130 petition. Once that's been approved, the alien actually applies for the visa by completing DS-260 and submitting supporting documents.

Sorry I meant that I am applying for a vis FOR the USA. But I am currently in France and my husband is in the USA. Of course he is the one filling for me. But I have to provide those documents. SOrry for the misunderstanding and thanks for your answers.

Got it. Did he start the process? if so which center did the petition went?

Yes he sent the I-130 in September to the USCIS in Chicago (he lives in NY) and we are still waiting...

Okay, welcome to the waiting game. If his petition went to Texas or Potomac, there are approval around in 6 months and if it went to Nebraska, it is taking 9 to 10 months just FYI.
