Timeline

Hello everyone

My scammer husband posted earlier about me attacking me.. I was defending myself. He was upset because I am not applying for me to stay here. I have found out that he is gay. As well as he had several Facebook accounts. . Once I told him I will not sign papers for him to stay.. he joined several online sites..example a cougar dating site.. looking to scam another older woman. He calls me names everyday.. he threatens me if he doesn't get his way. He laughed about scamming the embassy as well.  This is a sick person.

What...you think he entered marriage in good faith?? He is gay. He is on planet romeo. .a gay dating site. Proof yes.. I have proof that he is a scammer. I have proof he threatened to kill me. I am trying to book him a flight to go back to morocco. I want this over.. I hope and pray I can get an annulment.

Spend your time wisely and take actions that count such as reporting him to USCIS and the cops.

So you have not yet submitted the AOS petition for him yet? Divorce him and move on. Get away from him in any way possible and get yourself to a safe place. You cannot force him to go back to Morocco, but also be aware that the only way he can get a green card is through the original petitioner (you). He cannot aos through another person unless he divorces you, goes back to Morocco and starts the whole process over again, which the Casablanca consulate will certainly see as a huge red flag. Once he finds out he needs you to get the green card, he may try to act like he is sorry, but don't let him trick you. Divorce and stop all contact is my suggestion. Also be sure to keep all proof of abuse.

Have you two married? You said you are not signing papers. Is that AOS papers? He should know that without status he will not be able to gain status without you. 

 

Also, and this is very important... if your household has become violent, remove yourself. Even if you were defending yourself you should not be in that situation. If police are involved then there is a chance he will not be returning to his country until the domestic violence issue is resolved.

 

You say you are buying him a ticket home. Is he willing to go. You also can't force someone on a plane. Be very careful of your plans. Many people think removing a person is a lot easier than they think.

If he has been violent towards you...call the police and file a police report.  

If he has threatened violence towards you...call the police and file a police report.

If you have proof that he has scammed USCIS...inform them and submit evidence to your claims.

If you no longer wish to be married to him...consult a lawyer and start divorce proceedings.

In cases of when it has been revealed that the person is gay, it is not viewed as a a marriage of good faith because the person deceived to marry.  With same sex marriage and can immigrate through this track, she can receive an annulment as he falsely deceived her into marriage.  

 

Look into Florida law on annulment.

 

COntact the police, file a temp. restraining order, and have him removed from the home.

Sure, most states have a provision for annulment and in many collapsed marriages involving an immigrant annulments are hoped for on the basis of fraud. However, the burden of proof is very high. How can she prove he's gay? So his picture is on a gay dating site, so what? Could have been a joke, his picture could have been stolen for that purpose by someone who feels he is more attractive than their own picture, he could be just curious about it all. It's not ideal for a married person to be on a dating website of any description, but it's hardly a reason for an annulment on the basis of fraud. If the husband were now in a serious, committed relationship with another man...well...who's to say he isn't bisexual and was in love with the OP at the time of marrying her? 

 

It's much easier to divorce.
