Hi I had my interview in Mexico 9/07/2017

i had my i601a approved before my interview.. mexico gave me a 221g letter and asking me to file for i601 waiver. Can someone tell me why I need the i601 waiver. I thought the i601a was all I needed.

No the i601a is only for the unlawful presence. I believe that crime falls under CIMT (crimes involving moral turpitude) those do require the i601 waiver.

I was in the us my whole life 25 years was convicted of a fenoly back in 2010 which later was reduce to a  misdemeanor. I  served 14 days in jail and was credited 15 good behavior day for a total of 29 days.. my parent brought me to the us since I was 8 month old(new born). I'm married and have 1 child.. never been in trouble before just that time back in 2010 when I was 18 years old..   

i had my i601(A). approved at the time of the interview but now they want me to file for i601 which I don't understand why?

It was for receiving stolen property.. the letter I got from the consule in Mexico says I need the i601 for entering the us illegally and for my conviction.. I thought the i601(a) forgave me for both things my misdemeanor and for entering illegally..

No the i601a is only for the unlawful presence.

I believe that crime falls under CIMT (crimes involving moral turpitude) those do require the i601 waiver.

It's a bit discretionary whether a crime is or isn't a CIMT. This portion would seem to apply to you however. I agree that you should consult a lawyer for this. 

 

 

"Crimes Against Property

 

Moral turpitude attaches to any crime against property which involves fraud, whether it entails fraud against the government or against an individual. Certain crimes against property may require guilty knowledge or intent to permanently take property. Petty theft, grand theft, forgery, and robbery are CIMTs in some states."
